I won auction by mistake and I don't want to pay

I stupidly bid on a piece of clothing without noticing that it was 2 sizes too small.
I realised after I won the auction.
I asked seller if she'd be so kind to do second chance offer to other bidders.
Apparantly this happened but there was no response and now seller has sent me an invoice insisting I pay.

If I was selling something and a buyer quickly said they'd made a mistake I'd let them off the hook. I wouldn't insist they.

I know iabu, technically, but I think she is a bit too.

What's the worst that will happen if I just don't pay. Negative feedback?

You enter into a binding contract I think when you bid on Ebay. You must pay up and resell or re-gift if the thing isn't suitable.

Yes it is a binding contract, but I can't see why the seller won't co-operate and just offer to the next bidder. 1 strike on your account for not paying for 1 item isn't going to make any difference. And the seller can easily get their fees back

Pay for it and resell it. It's unfair to expect someone else to pay for your mistakes and it would be very unfair to leave bad feedback for a seller because you made a mistake.

if the seller files a non paying bidder case you won't be able to leave feedback anyway

just dont pay, you told the woman. She had the option to cancel it, and she can still put a NPB. Be careful next time

Not the sellers fault that you didn't read description properly.

Why should they be out of pocket?

the seller has no need to be out of pocket - they can cancel the sale and offer to the underbidder.

I would just pay and resell it too. Chalk it up to experience, and read the description properly next time. You never know - you could end up making more money off it

Yes seller can relist and claim fees back but it takes time & is a pita. Especially because ou then gave to wait a week for the auction to run again and are not guaranteed the same price. If you're flogging stuff because you are completely broke and need the cash to get you to the next pay day it's an utter utter pita. Just pay up and sell on and treat it as a reminder to read the listing properly.

honestly just tell the seller to cancel the auction - I can't understand why they won't do it. Either that or they should open a non paying bidder case. They aren't going to sue you or leave neg feedback, at most you will get a non paying bidder strike on your account - and if there is no reply from seller just ignore.

I did that once. I was too ashamed to even contact the seller to ask about not buying it myself. I just paid, received the unwanted item and just learned from my mistake. With me I bid on something then changed my mind about the item so a little different from not reading the item properly, but either way lesson learned.

No I haven't paid, and I told the seller I wasn't going to again.

I have done this before, many times and I've always paid up and resold. Twice last month in fact something arrived, I didn't like it and I resold. My fault. No problem.

If the seller had been more sympathetic I may have done this time, but she wasn't. She's selling so much designer gear that I can't believe she's short of money. Also she doesn't put garment measurements or uk sizing on half her auctions so I think she should expect problems.

She has opened a non-payment dispute case, rather than cancelling the transaction so I assume she's in no hurry Hmm

I can't belive you are getting annoyed and considering leaving negative feedback for this seller............ . yes ok as far as I understand ebay the transaction can be cancelled but from the sellers point of view you made the mistake and (s)he has done more work to try and resell it.

Maybe the seller is new to ebay and not aware / does not know how to just cancel the transaction...... I have never had to and did not know it could be done .... so some people breating this seller for not doing so might be wrong is assuming this is deliberate /obstructive.

You made the mistake and if you just ignore the seller as someone suggestion then you are not exactly being very fair are you ?

well if she has opened a non payment case it will close in 4 days and you won't have the option to pay any more or leave the seller feedback

she will have opened the case to get her fees back, if you refuse a cancellation the seller won't get their fees back so non payment case is only way to guarantee a refund or the seller

Just ignore and move on is my advice

to prevent a retaliatory neg and to allow buyers to leave honest feedback without risking their own record through no fault of their own

So why not pay and relist this time? Also you say that she doesnt always put her sizes up properly, but you know that this is a size 8 so she obviously has done this time.

I never sell on ebay and very rarely bid for anything, I just buy it now for a lot of things. Im very cynical though.

I dont think its fair that a seller cant leave negative feedback for buyers, there are often stories floating about where the seller has been ripped off and they cant do anything about it.

Why would she cancel? Surely she has to open a non-paying bidder case on order to claim her fees back? Can she get them back if she cancels?
