lost parcel and time limits ?

hi there,

I paid for a bundle of stuff on the 12th Oct was posted on the 19th and it never turned up.
The seller has been nice and polite and we have checked both ends to no avail.
It was sent parcel post.
I have asked for a refund and the seller has told me I have to wait til she gets her refund from post office.
Should I file a claim as well in case it is not refunded I really cannot afford to wait but don't want to annoy the seller ?

no the seller is wrong - she should refund you now and claim herself from Royal Mail

you have 45 days to raise a not received dispute, you can start it now if you wish then escalate either immediately if it is a paypal claim or 10 days later if it is an eBay claim. I don't think you are being unreasonable, you have been patient so far so don't worry about upsetting the seller. Why not tell her she has to refund you and claim, and if no joy you could then start a dispute?

An item is considered lost after 15 working days, which is 3 weeks, so she can claim from tomorrow I think?

I will send her a meessage and start a claim then I have asked for a refund and she has said I have to wait.
I have no real doubt that I will get a refund but do not think I should have to wait.
I have refunded before now for a parcel lost in the post its why i send most of my sold items recoreded or signed for.

Even then some postiesdont bother getting a signature its a minefield :(

she said I have to wait as she is out of pocket for the items, postage and ebay fees ?
So I am filing a claim with paypal even so found myself kind of saying sorry but have to cover my back sort of thing.

It was for over £25 so not cheap :(

snowball, I have this now too, mine is for £41 Sad I haven't had a reply from seller yet but I have had to ask for a refund today as waited over 3 weeks now. They've been very nice and pleasant but not once mentioned a refund,just not sure how else they can hel me Hmm so will be interesting to see what they say! But I know what you mean about apologising and stuff, i almost feel like it is all my fault!!

maxy I would start a paypal claim too if I was you.
My seller has til the 18th of novmber to reply to the dispute i escalated it in paypal straight away as I need the refund sooner rather than later

no e-mail yet from her
it happens I would not send anything over £20 without insurance :( .

I think I will snowball, they have just replied telling me to claim from RM Hmm I have explained it doesn't work like that so if i don't hear back again tonight, will open PP claim in morning!

Maxy the seller has the contract with RM so they have to claim. Also as a seller it is their responsibility to get the item to you, that is part of the PayPal agreement - so trying to pass the buck like this is not on. They will learn the hard way if you have to open a claim. You are quite right, don't let them tell you otherwise.

ok so this mormning all nicey nicey now this

I have just been to the post office to get a claim form and it is possible for you to make the claim on items that are not delivered. I feel that I have fulfilled my part of the deal what happens after I post the item isnt my responsibility. There is an option for you to make a claim against the post office, I posted you a copy of the receipt I got from the post office when I posted your items. They have confirmed that it left their depot and I don't feel it's my responsibility to make the claim.

I do sympathise with you and I have had to claim against the post office for goods i bought on ebay they have damaged as this isn't the responsibility of the seller either

did you tell her it is her responsibility to get the item to you then. I could type more but I feel whatever you say to her will fall on deaf ears. I do feel your pain!

and of course you can leave appropriate feedback in due course :)

a PP claim can be escalated immediately - did you do an eBay one instead which can be escalated in 10 days?

No fergoose have done Paypal one but it keeps saying

"Some required information is missing or incomplete. Please correct your entries and try again" it makes no differewnce what i do, what response I put, if I tick the box, don't tick the box, type in the box don't type in the box it just keeps saying this Hmm help me!!!

I have tried telling them, but they say I can claim with a COPY of a receipt from their PO they sent me Hmm

In the first instance you need the original POP and it says this in big black letters on the RM form (I know as I have one in my hand as I type!)

The form does allow for claims to be made by either the sender or the recipient, buy as it says they can take up to 30 days to respond you'd be out of time to make a claim from Ebay should they decide not to pay out!

Ebay should side with you and get the sender to refund you as Fegroose says they have an obligation to get the bought item to you

Sorry Maxy I have never heard of that before, that sounds really weird, how annoying - I wonder if you need to call paypal to sort it or maybe email then?

The case has been opened though? i wonder if there is a temporary glitch?

I thought as much dizzy about the original receipt, have just said that to DH.

Funny though as how can they (RM) get proof of confirmation it did not arrive for the person who is saying it did not arrive? Confused I always thought it was the person who made the contract with RM?

I managed to get it to escalate now so lets see. It's £41 and was something for my son Hmm so now we have no toys and no money Sad I also think both Husband and wife were emailing me tbh as the messages always had a slightly different tone. He (signed his name) said only this monring yes he thought I had been more than patient, then I get that this afternoon...............ah well, blardy ebay

ok, now it says awaiting my response Hmm and this is there saying seller has respded to tracking info.......and it says this, it literally says exactly this and nothing next to the tracking or delivery Hmm

no - paypal are giving you the option to close the case if the tracking number is correct and you have received the item. if you do nothing, it won't close, they will review it and then give you back your money
