I have had my appeal considered and finished by Paypal and they have stated that I do not qualify for a refund as:

"The claim does not fall under Paypal's definition of significantly not-as-described and does not qualify for a refund".

but the long and short of it is (for those bored by reading long threads) is:

  1. The seller does not have to accept a return even if they put on the ebay listing that returns are accepted - they can just refuse to give you their address and ebay will NOT give it to you
  1. The seller can claim in the listing and in the dispute case notes to paypal that the item is an orginal antique and still send you a modern piece and paypal will decide it IS still as described

I have no option now but to send it to Paypal (gulp!) by special delivery and then send the Royal Mail special delivery receipt to my bank along with an explanation and they will do a Visa Chargeback.

According to my bank it will then be up to Paypal to PROVE that the item is antique.

But for the next month I will have no item and no money while I wait for the Bank to resolve it as Paypal have 30 days to prove the item is as described.

So I'm warning you now - your Ebay buys are not covered even when you think you have buyer protection. You don't and I'm telling EVERYONE - my next email will be to Watchdog and then I'm contacting the FSA as a Mumsnetter suggested.

She didn't respond to any emails when I asked (very politely) to return it. That is why I opened a dispute.

PayPal do nothing about a sellers returns. The item is not old that is clear from the picture.

YOu should have gone with counterfeit you would have won an eBay dispute, probably a no fault and got a full refund and to keep the item.

Remember for next time, but def leave a neg.

I have known a lot of jewellers who know jack shit about antique jewellery. Not necessarily saying this is the case here, but do not expect a jeweller to give you very accurate information, particularly if you are not buying from them.

Having said that she should have accepted the return, she had an underbidder who she could have sold it to.

I sell antique jewellery. I cant tell from that photo if it is genuinely AN or not. I would not have carried on bidding on an item that had no clear hallmark, no makers mark, and a seller with no history of selling decent pieces.

Counterfeit what fabbychic? The buyer made a huge error by not reading the listing properly and not asking the seller the right, or any, questions. Oh, and she overpaid massively on what is clearly nothing special!

Fabby, to be fair, you really cannot tell that from the photo. The pearl itself in close up does look authentic. A repro piece would be more likely to have a smooth pearl, not one with ridges on it.

I only tend to sell signed pieces, because that removes any doubt about authenticity.

Squeaky - if I showed you a picture of the back you might be able to tell. It is very shiny and has that sort of engine turned look.

I'm glad you're an antique jewellery seller and even you can't tell because it looked like lots of other 'real' pieces to me - it's very pretty.

If the seller confirms it is a real Art Nouveau enamel piece (which they DID) then I did not overpay - I would have paid the right price.

I'm not sure what you're driving at - the seller does claim it's original Art Nouveau - even if I'd asked them before the auction they would have told me the same. They would still have sold me a modern piece. Paypal would still have found against me.

Which questions do you think I should have asked to prevent the seller from lying to me and winning?

I think you have been totally ripped off - the seller is a disgrace, and I think Paypal are an utter disgrace about this item.

I would be inclined to go to court over this to be honest.

I am going to do a chargeback - the bank said I had to wait til paypal concluded their resolution process.

Laurie where abouts are you? I have a friend who could do you a valuation for court purposes for free - I sell antiques/collectables/crap on Ebay and hate people being ripped off :(

I know if you mention an ebay or paypal claim it will be removed - I think a bank chargeback would be the same.
