no one to talk to, need advice re pension split

ive just had a mediation session, we have 52k house equity to split. he has offered me 5k more so 55/ 45 split
i would have just under 31k in that case and he just under 21k

pension he has £78989
he has offered 40/60 split of his pension

we have been married 10yrs at the time of separation and the pension was accrued the whole time we were together.

i think i will accept the 5k offer on the equity but does 40/60 pension split sound fair? i just assumed it would be 50% pension.

apparently he has said he wants to avoid Solictors as much as possible to save cost, as do i dont have the availible money for any of this.

any advice welcom

Thanks for all the advice. I have decided to go with what he has offered. He is very stubborn and punitive if I said even suggest court or solicitors he will just tell me to go ahead and the whole thing will drag on further

I've been quoted £1500-3000 for pension on divorce advice for a teachers pension so it's probably not worth it for you to argue as the extra would all get swallowed up anyway.

Why isn't he contributing 50% towards DCs clothes, clubs etc? I'd throw that in.

He will not contribute anything other than maintance, ive asked and asked again and its either no or he ignores my email.

He really does wear me down.

That’s what he’s relying on! You need to stand your ground - tell him you want to see his CETV from his teacher pension - he’s not being honest with you as. Teacher pension does NOT have a pot as such, he knows that and he’s trying to fool you into giving up more of the joint assets.
I’d look at having all the equity in the house and not touching his pension at all - but honestly, getting some decent legal advice could same you thousands in the long term.

I don't have direct experience of the teachers scheme, but given the fact CETVs have fallen dramatically in recent years, 80k after 10 years in the scheme doesn't seem completely unreasonable, especially if that's based on early years of a career. However there shouldn't be any reason why he can't share a recent CETV obtained for the purposes of divorce.

He won't show me, there is no point in asking. I only have his word that he told mediation the truth.

The only way I will get to know if hes being honest is if I go to a solicitor and then its going to cost a fortune because he will fight. This man would rather lose it all on solicitor fees than let me have anymore than hes already offered. I was shocked he offered 5k more on the house and 40/60 on the pension

I dont know what to do, i have a solicitor appointment next week but the last thing I want is a battle but at the same time I dont want to be shafted.
