Please do not judge, I'm going to court tomorrow to be sentenced. I have plead guilty to 3 x fraud by misrepresentation.

2 years ago, I was working for a sex chat website and took money from 3 different men and went on to talk to them away from the website. I know I did wrong.

I'm so nervous I have a 5 year old little girl, I've never been in trouble before but can't help think I'm going to prison! What will I do! Does anyone know what I should be packing? Maybe the wrong site for this but I am going to be awake all night...

Fraudulent misrepresentation is very serious. Fraudulent misrepresentation occurs when a party to a contract knowingly makes an untrue statement of fact which induces the other party to enter that contract. Fraudulent misrepresentation also occurs when the party either does not believe the truth of his or her statement of fact or is reckless as regards its truth. A claimant who has been the victim of alleged fraudulent misrepresentation can claim both rescission, which will set the contract aside, and damages.

I would think, however, that pleading guilty and not contesting it, showing genuine remorse would help OP’s sentencing.

£15k 🤬🤬 and no-one seems to think this is a problem?!! I wonder what would happen if a man came in here and said he’d defrauded 3 women of £15k in similar circumstances. I don’t wish the OP any harm but i’m seriously unimpressed by her and all her supporters.

She didn't defraud the men, she defrauded the chat line. The men paid her willingly.

But supermeerkat the men would have paid that amount either way. It just happened that op took all their payment instead of going through the website and taking only a percentage of the money and the website taking the rest. She did the work, she took the money. The men would have paid it anyway. It's like cutting the pump out of the deal, isn't it? Serves them right for being a pump anyway!

Please don't get carried away with reassuring the OP.
I was sentenced to 6 months for fraud and theft.
I stole money and repaid it every month when I got paid.
I had flu and simply could not drag myself into work to repay the £280 I had 'borrowed' that month.
They added everything together, even though it had been repaid and I was charged with theft and fraud. Made an example of as I was in a position of trust ( I was a clerk in industry, not caring for people).
I hope all has gone well for OP, but everyone told me I would be given Community service, from probation to my solicitor.

I'm not sure how she could be charged with fraud by misrepresentation if that's the case. It's fraud against the agency, sure, but unless she was pretending to be the agency, it's not fraud by misrepresentation.

(Unless I'm missing something here!)

My assumption was that the men believed she was still working for the agency and were therefore covered by certain terms in relation to things like client confidentiality/discretion.

I actually thought it may have been benefit fraud when I read this earlier, but maybe not. More likely to be that she was conning the men hence the misrepresentation. Oh well.

So, the man who came forward and reported you to the police, because his wife found out, was quite happy jollying away until he was found out then? Cheek of him! I'm not saying you should have carried on fine had he not reported, but it seems a bit wrong.
So is it that they are saying it is fraud because you took business away from the chat company, by being in contact with customers who had used their site/company etc?

Haven't read up to date posts if you have come on and let us know what the outcome was, but will check now, and hope that it went as well as it could do. They do consider putting people away for such amounts or less, but depends what level of deception they think has gone on, and who it was against. If it is with government bodies, i.e benefits etc, they definitely consider it, they don't care.
Has your solicitor talked to them about repaying money they feel they have lost, I mean you won't have 15k to throw at them just like that, but what benefit will that company feel or the guys involved if you go to prison?!

Lots of ops don’t return to update but in this case I’m thinking perhaps op did receive a custodial sentence. If so from what she set out it would not be long. I’m wondering about her 5 Year old - hoping there is family support and an arrangement avoiding social services.
