New regulations?

Getting conflicting information and am so confused.

In my personal life I have in close contact with a positive case so I am now self isolating. No symptoms and feel fine. I wasn't contacted by tracing ... The person let me know they tested positive and I rang my GP who said to isolate for 14 days. Gp said only get tested if symptoms develop.

I work in a children's nursery so no such thing as ppe or social distancing. I thought I was doing the right thing isolating.

However my boss has told me there are new regulations, and directed me to go get tested today, she said I would have results in 24hrs, and back to work in 48 hrs if test is negative and I no symptoms.

Initially I couldn't get a test booked as I've no symptoms but boss insisted (really sternly insisted) so I booked a test online by saying I've symptoms.

I've just had the test this afternoon at a drive through test centre. They results in 3 days

Does anyone know or can give me a link about the new regulations my boss is talking about?

I'm more than happy to be in work as I'm fine but just worried if what she is saying is not correct we would be breaking rules?

What she's saying is not correct. There are no new regulations.

Who cannot get a free test

You cannot get a free NHS test unless you have symptoms, have been asked to by your local council live in England and have been told to by your hospital, or are taking part in a government pilot project.

This applies even if:

you live with someone who has coronavirus
you’ve had close contact with someone who has coronavirus
you’ve come to the UK from a high risk country
you’re planning to leave the country
your employer or school has asked you to get a test

You can pay for a private test. Do not use this service.

www.gov.uk/get-coronavirus-test

Test and trace is broken.

SleepingStandingUp · 16/10/2020 13:47

Yeah I think she's trying it on.

How many days since your friend was symptomatic / took the test?

Twistered · 16/10/2020 13:48

I've already had the test.
She told me I had to tick symptoms so I could get the test.
When it comes back negative she says come back to work. Is this incorrect?

OP posts:
Twistered · 16/10/2020 13:49

Positive person tested positive yesterday. I was with them on Tuesday.

OP posts:
SleepingStandingUp · 16/10/2020 13:50

How many days has it been since your mate was symptomatic and since you saw them?

SleepingStandingUp · 16/10/2020 13:50

Sorry cross post

Twistered · 16/10/2020 13:53

So can I back to work like she says after a negative test and no symptoms? Or have I to isolate as per what I can find on NHS
Why is she telling me I can come back , surely this could have issues spreading to co workers and kids in nursery if I have it incubating? Or will negative test no symptoms enough for safety?

OP posts:
CokeEnStock · 16/10/2020 13:59

I'm in Belgium but the rules make clear you dont test before day 5 of isolation.

LangClegsInSpace · 16/10/2020 14:02

When it comes back negative she says come back to work. Is this incorrect?

Yes that's incorrect.

The reason for contacts to self isolate for 14 days is because that's how long it can take for the virus to incubate. You could test negative today but positive in a few days time.

Your employer must not knowingly allow you to go to work if you have informed them you need to self isolate

www.legislation.gov.uk/uksi/2020/1045/regulation/7/made

Has your friend been contacted by T&T yet? Hopefully that will happen asap and you'll get the official authorisation to isolate.

Oaktree55 · 16/10/2020 14:03

If you’re in contact with a positive person you need to self isolate for 14 days regardless as the tests have 20-30% false negative result anyway.

DumplingsAndStew · 16/10/2020 14:04

Do you work for a local authority nursery?

Ask your employer to show you this new legislation. I'd also be expecting them to cover the costs of the test.

dementedpixie · 16/10/2020 14:07

Your employer is wrong and telling lies basically. A negative test does not release you from isolation early

Twistered · 16/10/2020 14:08

Why is a nursery boss giving wrong info to staff? I can't believe she would knowingly do this as risks a full closure surely. She is adamant there are new regulations and I be back in a few days
We are very short staffed but her making staff do the wrong thing could just be a disaster
I keep pushing back and saying show me the new regulations so I can check them out myself. But I'm afraid of her thinking I just don't want to go work.

OP posts:
LangClegsInSpace · 16/10/2020 14:14

She's an irresponsible employer who doesn't want you to take time off because they're short staffed. Are you in a union?

Here's the workplace guidance, can you show her this and say you are expecting to hear from test and trace shortly?

www.gov.uk/guidance/nhs-test-and-trace-workplace-guidance

DumplingsAndStew · 16/10/2020 14:20

Don't be afraid of what she thinks. Keep asking for the regulations, and keep to hand the ones that suggest she is wrong.

dementedpixie · 16/10/2020 14:24

From that link;

Do not order a test if you do not have symptoms. A negative test does not mean that you can stop self-isolating as you will still be in the incubation period, and you could go on to develop COVID-19 in the following days.

Shieldingending · 16/10/2020 14:27

I work in a school, her advice is wrong. You HAVE to isolate for 14 days and should not have a test unless you have symptoms

LangClegsInSpace · 16/10/2020 14:28

If T&T contact you and tell you to self isolate and she still tries to make you come in (regardless of your test results) she will be committing a criminal offence and can be fine £1000 for a first offence.

ChaChaCha2012 · 16/10/2020 14:32

If she claims the guidance isn't up to date, here's a link to all the legislation. It's updated daily. Ask her to confirm which instrument she's referring to.

www.legislation.gov.uk/coronavirus

LangClegsInSpace · 16/10/2020 14:34

Useful info here:

www.acas.org.uk/coronavirus/self-isolation-and-sick-pay

It's all a bit up in the air until T&T shifts its lumbering arse into gear but it says to follow your usual sickness procedure and you can self-cert for the first 7 days.

EasterIssland · 16/10/2020 14:39

She’s giving you wrong info because she’s short in staff.
However , I might be wrong but you can only self isolate if contacted by t&t so she can ask you to go back

LangClegsInSpace · 16/10/2020 14:45

Yes, technically OP is only entitled to stay off if contacted by T&T. However she's now waiting for test results having been pressured into telling the government website that she has symptoms so she can't go back til she gets the results anyway. Employer has shot herself in the foot. She could have told OP to come to work until T&T said otherwise.

LangClegsInSpace · 16/10/2020 15:14

You might already come under official self isolation rules because your GP has told you to isolate. Although the website funnels you towards T&T only, the regulations say you can be notified by -

(a) the Secretary of State;

(b) a person employed or engaged for the purposes of the health service (within the meaning of section 275 of the National Health Service Act 2006(7) or section 108 of the National Health Service (Scotland) Act 1978(8));

(c) a person employed or engaged by a local authority.

www.legislation.gov.uk/uksi/2020/1045/regulation/2/made

I'd get proper advice on this - CAB or ACAS

Twistered · 16/10/2020 15:29

Gp told me to get an isolation note online which I did so officially my note says I've to self isolate until the 28th

Boss still saying to come in once my test comes back negative as she can ok it.

Let's just hope it doesn't come back positive or she will have to isolate and some of the kids and my co workers!

Then she is already breaking the law.
