DLA Mandatory Reconsideration 2023

Hi, I’ve been following the DLA wait times thread since I applied for my 7 year old son in October. We had the decision yesterday and it was declined 😭 I was absolutely devastated.

We applied because my son was involved in a serious RTC (we were going on holiday with our friends, he wanted to travel in their car following us, a car came round a bend missed us but hit them head on) understandably he struggles with the fact he was the only one in the car and blames us for letting him in there). He was the only one awake and conscious in the vehicle, he has chronic flashbacks, normal everyday life things (sirens, bangs, travelling, weather conditions and so on are triggers) they send him into a state of survival and all his rational thinking is gone. Nights are horrendous for him, he lives like his life is in constant threat, he fights sleep and often gets dressed in the middle of the night so he’s ready should anything bad happen. Flashbacks are more prominent through the night.

school are aware of his issues. Now he’s under CAMHS school have been asked to stop any mental health interventions as this could interrupt the trauma therapy. hes happy at school because of the structure and routine, no real unpredictability etc.

anyway I’ve done this tread for anyone going through MR and hope we can all support each other through the process!

xxx

@Star2386 oh bless you (sounds very similar to what I did) specifically what I thought they should have considered etc and why!!

you’ll know in the next few days before the letter if you’ve been awarded as it’ll appear in the bank, usually an indication tbh xx

also can I ask if your form was received on 24/10 or was that when you sent it? I sent it special delivery as signed for never arrived 🤦‍♀️😩🙄 xx

Star2386 · 08/11/2023 19:55

The forms where received on 19th June and declined on 23rd of October put straight in for mr the 24th October x

Jneill2021 · 11/11/2023 18:44

Hiya I'm going to do a Mr for mobility for my son who I believe should get hrm but only got awarded lrm, just wondering if anyone has been successful with a Mr lately? X

Shauna2866 · 11/11/2023 22:05

@Jneill2021 hi I done a MR this month for my son they refused his claim so I done a MR and got it turned over the decision maker called me and said he was sorry it should of never not been awarded and he was confused to why they said no definitely do a MR if you feel your son is entitled to the higher rate
I wasn’t going to do it as I read all the negative stories and I’m so glad I did I only waited just under 3 weeks to get a decision x

Jneill2021 · 12/11/2023 07:47

@Shauna2866 amazing news for you and your little one, I'm just waiting for the statement of reasons then going for it fingers crossed xx

Jneill2021 · 12/11/2023 10:14

If anyone has done Mr for mobility to try and get hrm what evidence did you send, the Mr process is so draining x

Specialchild2019 · 13/11/2023 12:18

My claim got declined on 10/11and did a MR via phone do anyone know how long it is taking for a reply. Anyone with similar date because the lady on the phone said 3 weeks just incase it has gone more or less.

Jneill2021 · 13/11/2023 12:29

@Specialchild2019 there saying 3 weeks at the moment ino someone who recently had a decision in 2 weeks xx

Specialchild2019 · 13/11/2023 12:39

Thank you, i have done a mobility claim see what reasons was your child claim had when they declined it and reply back to what they said and smi and vuw flow chart is really helpful for the mobility claim say why you meet the criteria.

Mummymummy22 · 15/11/2023 17:19

Hi All

I've been awarded mrc but no mobility, done MR over the phone today was told it will take 3 to 4 weeks.

Anyone know how accurate that is? As some saying 2.5 others saying 6 weeks...

Shellbod81 · 15/11/2023 20:27

Hi all , does anyone have any idea on how long it’s taking to get to DLA tribunals please? My appeal was received April so I have been waiting for over 7 months now x

Mum0f4delights · 15/11/2023 21:05

@Mummymummy22 apparently it’s taking 2/3 weeks for MR I did call to update some details on Monday and mine was at 2 weeks then, hadn’t been assigned however said it shouldn’t take too long because the turn around was much faster.
I’ve not had a call yet, so not sure if that’s a good or bad thing 🤷‍♀️
I resigned myself to the fact it’ll probably be an appeal, however just waiting and stressing out anyway because that’s all you can do!!

Good luck to you, and everyone else waiting!! 🥰

Mummymummy22 · 16/11/2023 07:01

@Mum0f4delights thank you for your reply really hope you hear soon. Please update us when you hear...fingers crossed for everyone!!

Jneill2021 · 19/11/2023 09:45

Mum0f4delights · 19/11/2023 11:57

Hi all, I received a letter to say thanks for asking us to look again at your claim etc, please fill in and send back any forms we have asked you to fill in……

you don’t need to contact us, if you haven’t heard after 11 weeks then can call,

is that a standard letter?

just wondering as it sounds like the original letter they send, they did tell me Friday it was with someone.

Ll333 · 19/11/2023 13:09

Hi yeah that’s the standard letter I received the same

Mum0f4delights · 19/11/2023 13:11

@Ll333 Oh ok that’s great thankyou!! 👌

ARH36 · 21/11/2023 10:49

Hi everyone, I’m just parking myself here. I called on 07/11 for a MR (2 weeks today) and hoping to hear something soon. Congrats to those who got theirs overturned and good luck to everyone waiting 🍀

Mummymummy22 · 21/11/2023 11:27

@ARH36 hi I applied for MR on 15/11 only a week for me....they sent a text saying could take upto 4 weeks. Feel like calling as need to know. My son awarded MRC only (no mobility). Appealed on phone straight away.

SpaceRaiders · 21/11/2023 11:40

Does anyone know if you can appeal a MR decision?

We got denied the first time, so I challenged it. They then awarded Dd with lrc and lrm. A few weeks later her formal reports came back confirming diagnosis, so i’ve asked them to look again at their decision. I know it’s based on need as opposed to diagnosis but it feels like they awarded her the lowest rate on the assumption that I’d not challenge it again.

Lougle · 21/11/2023 17:52

Yes, you lodge an appeal with the tribunal.

ARH36 · 21/11/2023 19:34

@Mummymummy22 aww hope you get the decision you deserve! Keep us updated with how you get on. 4 weeks is great to hear, I received a letter last week saying they can take up to 11 weeks, it did seem quite a generic letter. Hopefully we can help each other with timelines.

Mum0f4delights · 22/11/2023 20:43

Hey all, said I keep you updated!! Called today MR had been with DM since last week, decision made today…….caller just said no award.
Just advised that decision was made and I asked if there was any reasons the caller advised not 🤷‍♀️🤦‍♀️
I asked if I would receive a letter!! To which the reply was yes, no option of what will happen next, or what I should do next if I disagreed with the decision. Which is odd as the last caller I spoke to several days ago did give me that advice…..
Appeal it is then…….🥲😩😩

Wish you guys all the best, and if anyone has the smallest piece of advice please share 🙏

Mum0f4delights · 22/11/2023 20:45

@SpaceRaiders hey good to hear your award after challenging MR!
I called and was advised no award from MR also, so am just querying did you re-challenge the MR or did you appeal? Thanks in advance

SpaceRaiders · 22/11/2023 21:19

@Mum0f4delights I’m currently challenging the MR with late evidence which are DD’s Autism/ADHD and Ed psych reports. The lady I spoke to last week said they’ll put it back before the same decision maker and if anything it should also increase the length of the award.

I think like everything they expect you to give up. They’d first declined DD for some silly reasons, one of which was that Dd is in mainstream school, nor did they define dyslexia as a disability. I very nicely quoted the equality act and then found reams of DLA case law which I duly referenced.🤣 Unfortunately for them, I’ve become pretty good at fighting DD’s corner, I’m not here to play silly games. If I have to go to tribunal for mrc, that’s what I’ll have to do.

My advice with MR is to always challenge each point in writing. I know some here have challenged over the phone, but in my view it’s always best to have a paper trail then no one can argue what was said.
