DLA Mandatory Reconsideration 2023

Hi, I’ve been following the DLA wait times thread since I applied for my 7 year old son in October. We had the decision yesterday and it was declined 😭 I was absolutely devastated.

We applied because my son was involved in a serious RTC (we were going on holiday with our friends, he wanted to travel in their car following us, a car came round a bend missed us but hit them head on) understandably he struggles with the fact he was the only one in the car and blames us for letting him in there). He was the only one awake and conscious in the vehicle, he has chronic flashbacks, normal everyday life things (sirens, bangs, travelling, weather conditions and so on are triggers) they send him into a state of survival and all his rational thinking is gone. Nights are horrendous for him, he lives like his life is in constant threat, he fights sleep and often gets dressed in the middle of the night so he’s ready should anything bad happen. Flashbacks are more prominent through the night.

school are aware of his issues. Now he’s under CAMHS school have been asked to stop any mental health interventions as this could interrupt the trauma therapy. hes happy at school because of the structure and routine, no real unpredictability etc.

anyway I’ve done this tread for anyone going through MR and hope we can all support each other through the process!

xxx

Does anyone know if you get universal credit and you have 2 children on DLA do you get 2 lots of the disabled child element or just one?

Lo89 · 26/07/2023 13:21

@Zeela hey I sent it to:
Disability centre 4
Post Handling Site B
Wolverhampton
WV99 1AH
When did you send yours off? Hope it all goes well x

Zeela · 26/07/2023 17:52

@Lo89 oh good thanks, I only sent mine off this morning. Preparing for another long wait x

Zeela · 01/08/2023 12:34

Hi, does anyone know if you get a text or letter or anything once MR has been received ?

Lo89 · 01/08/2023 17:32

So confused finally received my rejection letter but what they have put on there is different to what I was told over the phone the reasons seemed more specific over the phone but the letter states about personal care, bodily functions and not having difficulty with walking so confused now lol.

Well let's see how the MR goes

Lo89 · 03/08/2023 09:41

@Zeela I called this morning to check if they had scanned it. They scanned it the same day it was delivered to them I was quite shocked lol.
It hadn't been sent to a DM yet so the lady on the phone said she would action it now and assign it to a DM she did say 3-4 weeks for a decision.
I would call make sure they have it and see if it's been assigned yet x

Lo89 · 03/08/2023 12:18

@Zeela I've just received this text so I guess that means they've now actioned it as she said on the phone

@Lo89 hey hun. Thanks, they've received ours, he said about 5 weeks to me on the phone 😅

Ll333 · 04/08/2023 20:11

Sent mine Tuesday called today was scanned it was advised 3-4 weeks

Lo89 · 16/08/2023 09:23

So waiting on MR just called for an update. She said it has been assigned but the person has asked for medical guidance from someone else before making a decision and that person hasn't got back to them yet.
😩 I've sent all my note from paediatrician is this them escalating to someone internally? If anyone has any experience ?
Thanks

Ll333 · 17/08/2023 13:10

Called to check on my mr this morning then had a call half an hour later been refused appeal it is

Lo89 · 17/08/2023 13:41

@Ll333 I'm so sorry 😣 was it the DM that called you then? Did they provide you with reasons for refusal? What a nightmare! Let us know how your appeal goes, I don't know if I'll have the capacity to even go to appeal if I get refused at MR this whole process is so demeaning

It’s was absolutely rubbish excuse if I’m honest it’s because he can walk never said he couldn’t. They said the medical expert look at it but my doctor of 25 years had never even heard of his condition as it’s so rare. I will keep going as I believe his entitled. Honestly I was going to give up but I feel that’s what they want. I spoke to them for an update dm called half an hour later with decision I thought he was calling for more information but no to say it was declined. Thanks will update think this will be a long process.

Lo89 · 17/08/2023 15:14

@Ll333 the excuses they give honestly when not all disabilities or conditions have anything to do with walking is crazy to me. Good luck with it all x

But mobility is not what it's all about. If he needs extra care he is entitled to the award. Sorry you're having to fight this it's awful 😞

Lovemyones · 17/08/2023 16:01

@Lo89 have you heard anything yet think our MRs were sent on the same date! Hope you hear soon anyway.

Lo89 · 17/08/2023 16:41

@Lovemyones I called yesterday the DM was waiting on a response from medical guidance. I was too scared to call today it gives me anxiety 🤣.

Have you called yet?

No I feel bad really taking their time because it's just the mobility that I was querying and obviously there's others querying the whole thing and that's more important, was adamant that going to just wait and see this time! Plus even though it was sent on the 25th next day so must've been scanned on the 26th I only received the text to say was acknowledged a few days ago!! X

Well mine was done in half an hour so I don’t think they actually got the medical evidence as when I spoke it had just gone too a dm.

Lo89 · 17/08/2023 19:52

@Ll333 no one has tried to call me yet. I don't know if they do that for MR? I'll probably try and get through tomorrow morning x

Ll333 · 17/08/2023 21:09

Mine was a mr I didn’t expect the call thought they would ask for more information. Good luck x

Lo89 · 18/08/2023 09:13

@Ll333 called this morning declined at MR too I'm so over this now. Will wait for the letter to see why.

Honestly the whole process is so draining it’s so sad that it’s like if you don’t tick the boxes they refuse when all conditions affect people differently and cause different problems for our children and even us as parents. Honestly I said if the mr doesn’t go through I’ll give up. But I refuse. I’m going to get more letters from all the specialist who deal with him and maybe see if I can get some help from someone and do the tribunal.

SpaceRaiders · 06/09/2023 10:57

Anyone else on here still waiting for a decision? I got the statement of reasons through last week, I was furious with the ridiculous reasons. You’d think they’d employ decision makers with a clinical background!

We suspect she’s ASC/PDA and ADHD, quite possibly other overlapping ND conditions. I stupidly sent off a report that referenced her working memory issues/dyslexia and they used this to decline her award, ignoring all references to ADHD/ASC etc. I was also told she was at a mainstream school, therefore she wouldn’t qualify. The DM said dyslexia isn’t a disability!

Anyway I’ve sent off the MC challenging each and every point, quoting the Equality act of 2010 as well as case law stating that presence of dyslexia should form part of the decision making process and cannot be used as reason to deny DLA. I also sent a couple of referral letters and an interim summary report from the psych team. I’m hoping they reconsider but I’m prepared to go all the way to tribunal.
