Being sued by a disgruntled former nanny

Has this happened to anyone else? It seems like everywhere I turn, I hear stories of disgruntled former employees suing their employers for money - often on made up grounds. It’s scary!

Absolutely you do. However, once you've employed them, you have to abide by the law. Which would mean you couldn't sack the nanny in this case as pregnancy is a protected characteristic.

If I hadn’t known she was pregnant I’d probably have persevered with the warnings about lateness but once we knew we just thought it would be so disruptive for Ds to get more attached to her and her being unable to carry him etc that we decided to act immediately

So you sacked her for being pregnant! And then lied about it!

Well I’d have been stupid to say I’d seen her and was sacking her due to that so we used the true reasons we had available to us which were legal !

You fired her for being pregnant, lied about the reasons for the dismissal and boasted that you got away with it.

It's illegal and if she'd had the energy and resources to fight you you'd have lost.

You aren't in the right here. The only "other side" you're showing is why we need laws to protect workers from people like you.

I’m not - I’ve agreed that yes I did choose to sack her due to finding out she was pregnant and yes that was illegal. She would not have been able to offer da the level of care he needed and we would have had to pay ! So as she had no idea we knew she was pregnant we were able to refer to the repeated conversations about lateness and the fact I was changing to PT which was legal

Don’t understand the outrage, you employed someone to provide consistent care for an SEN child and to be physically able to lift etc. Your new employee would presumably have been unable to provide such care in a few months and would go on mat leave for at least six months.

It's illegal. And it's been illegal for decades to fire a woman for bringing pregnant.

It's that simple.

What you did was wrong, incredibly so and there is no excuse or justification for it yet you seem weirdly proud of it. There is nothing that you have posted that makes it in any way excusable.

But she doesn't need anyone to excuse her.
She did it, got away with it and presumably the family got a Nanny who wasn't late and who wasnt (probably) able to properly fulfill her duties within a matter of months, take time off and then might never have returned.
What this person did was the best thing for HER SON so why should she apologise for that?

Because we didn’t lie we officially sacked her for issues we had already raised with her and could prove that? Yes the real reason was that we knew she wouldn’t be around for long and wouldn’t be able to lift ds etc

She just couldn’t prove she had notified us of her pregnancy prior to us sacking her - because she hadn’t ! I’d just seen her leaving with her maternity folder
