No they can't if it is first stage milk.

They can discount follow on milk.

I had to look twice as it was hungry baby milk, but it was definitely newborn onwards. Was SMA in a blue-y carton

Asda have got an offer on a milk at the moment, I wondered about this earlier...

No they can't. If formula is suitable from birth it is not allowed to be discounted or promoted in any way. 6mth+ milk can be discounted and promoted.
Blue SMA is suitable from birth.

y nice indeed. He said it was of special interest to him as his wife had just had a baby and was BFing Grin Then he asked how I knew so much about the law and I pointed him at the Baby Milk Action site which he said he'd read and show his wife!

I saw the Asda offer online earlier. Didn't pay much attention as we bf but I think it was yellow.

~I usually take a photo of the item. Then ask the management to remove it and educate their staff. If they don't (Asda never do)you can report them here. You can report them anyway but I like to give them one chance Wink

I've found it in the Co-op in the past as well. I complained and they said they would remove it but have seen a similar offer again.

It's red stage 2, I can't paste url on phone but It's in the grocery bit not Asda direct. I did notice a tonne tippe electric pump on half price though..

My local Boots had some the other day, the cartons. I think it was Hipp. TBH I didn't say anything as I think the cartons are more of a luxury than a necessity.

Wow! I really think you're mean to report them. If someone is formula feeding are you going to deny them a "bargain" or do you honestly think that someone is going to give up breastfeeding because of a "money off" sticker? For real?

Alpinepony, discounting infant formula is breaking UK law and there is a good reason for the law. It is about the big picture, not about a few tins of discounted formula. If shops wanted to fell parents afford formula nothing is stopping them from permanently reducing its price. The ABM has a business card size copy of the regs which I keep in my wallet. My local sainsbos sometimes has infant formula on its reduced items shelf.

I think it is actually about ff-ing SAFELY as well. It is trying to keep the price of formula stable so that it can be properly budgeted for if it is needed by a family. This is top avoid people using methods to make formula 'last longer' when it is not on deal for example, thereby endangering the baby.

snicker well, I used to. DH nicked it somehow and started to use it as a bookmark and now I have lost track of what he has done with it.

Now I am just a brazen hussy and I stand there and inform them sweetly but assertively that they are breaking the law. It hasn't yet taken the mention of Trading Standards to get them to apologize and take it off the shelf.

But the next time i see it in my local shop, i will just photograph it and take contact TS anyway. I have told them at least 3 times about discounted formula - near sell-by date. Once is enough. They need to train their staff properly.

I wrestle with my conscience over this one TBH. I hate the idea of wasting food which could quite easily be used, and it seems silly to throw it out, because at full price most people will bypass something which is going to be out of date soon in favour of other tins which have a longer shelf life. But I also agree with the budgeting reasons, although I think this is probably more a cause for concern with offers like BOGOF or 20% off deals which are illegal.

Bertie, the manufacture of formula carries such a large carbon footprint so binning a few out of date cartons is hardly going to increase it by much.

that is my rationale anyway.
