Almost all murder trials are run on circumstantial evidence. It is rare to have direct evidence - ie an eyewitness or a ctv recording - of a murder. Even DNA is counted as circumstantial evidence.

A confession isn’t circumstantial- most convicted murderers in Victoria and Australia have entered a guilty plea.

If they've admitted it and entered a guilty plea, then there's no trial. We are talking about trials, ie where the person has denied it. Most of those are going to be circumstantial.

It’s a hallmark of ND esp autism to be interested in finding out about stuff, even really morbid and dodgy stuff, just for the sake of curiosity.

maybe most cases that turn into a podcast or attract public interest are? But “almost all” murders, I don’t think so.

Circumstantial evidence pointing to the acts being done is one thing, but here it’s being put forward to support her intent. Which is very different.

The mushroom expert said that it was extremely unlikely that foraged or dangerous mushrooms would find their way into any shop accidentally, even a small one. They are all grown in bulk commercially.

No, and in fact they had a mushroom expert from the botanical gardens give evidence saying how this is so unlikely to occur.

death cap mushrooms only grow in such rare conditions it would be ridiculous to try to grow them for sale or forage for them - they are hard to find - they only grow above the roots of certain breeds of oak trees (an exotic tree in Australia) which are only in a handful of areas in Victoria. Even then they only grow at a certain time of year in certain environmental conditions.

it is extremely unlikely that they could end up in a shop.

In the past in the UK we've had deaths, particularly older people, caused by things like listeria in cheese. Obviously the stores didn't knowingly sell poisonous cheese but it somehow got into the system.

Of course cheese making is far more prolific than very rare mushrooms, so adverse incidents more likely to occur.

@velvetandsatinapologies I didn’t explain myself well- most murders involved a confession and a plea- it doesn’t come down to circumstantial evidence at all. Ones that go to trial - I can’t find statistics on. I suppose, thinking practically, you would only risk going to trial if you felt the evidence was spotty or circumstantial and you had a fair shot of wiggling out of it.

but if we think about it in terms of the number of convicted murderers sitting in Victorian prisons right now- most of them aren’t there on circumstantial evidence.

But with her version now she doesn’t even need to blame the Asian shop mushrooms-it’s just a tragic mistake that she
a. Accidentally picked deathcaps (even though as pp said they only grow in a few locations)
b. Accidentally mixed them up with the shop bought ones

I’m not sure about in Australia, but apparently here it’s rare to depend upon one piece of evidence, and usually it’s a number of pieces of circumstantial evidence that are considered together.
