To not give refund on Ebay???

Hi, had a clear out of my sons things and sold some of it on Ebay, we have 100% feedback 434 feedbacks!
sold 4 lots of different things on same day, a friday - sent them all monday, not recorded, but i have the receipt showing i paid for 4 different packages,
3 have been recieved and had great feedback, but 1 person hasn't recieved the item, it was only a £3.99 item ( swimming shorts )
and tbh ive never had an item ive sent not show up before so do i give refund or not?

Its not really my fault the PO didn't/havent sent it on time or they have lost it etc.
should the buyer go to their sorting office and see if its there?

please advice would be welcomed!

Ebay is full of con artists at the moment, people claiming to have sent things which never appear, I'm £30 down myself right now and others are having the same problems.
You have to refund and then claim through the post office, it's not optional and why would you risk your feedback for £3.99 ?

of course you have to refund. the PO failed in its contract with you but that doesn't give you the right to fail in your contract with the buyer.

The Post Office say to give all items 14 working days before making a claim for lost items (I think it's 14, it's on their website)

Like i said, ive never had this happen before, ive also seen on lost of other items a disclaimer ie: I am not responsible for items being lost in post etc - wasn't sure if that was a given or you had to state it on the listed item.

with the item not being sent recorded,, how does the receipt help me?

Agree with Milly. feedback of 100% invaluable - not worth losing for £3.99. I send recorded delivery and dont sell to people with crap feedback. Lots of scammers out there - if in doubt, back out

you have to refund cos they can get it back thru paypal dispute anyway so you've not got much choice really

If they do a Paypal dispute it will find in the buyer's favour.

I sent something wrapped in about eight layers, including two sturdy boxes, bubble wrap, brown paper etc and a part of it was still supposedly broken. I have photos to show it wasnt when I packed it but still Paypal found in the buyer's favour and I had to refund them.

Over £30 and I got the broken item back. Yeah thanks, wtf do I do with it now?

I will never sell or buy on eBay again. It is full of shops and power sellers now, and professional con artists.

It has lost the community feel it had five years ago and I hate it now.

its very annoying, especially since i sent 3 other items at the same time, and they all got there the next day!
doesn't make sense to me
I just though the buyer was the type who didn't leave feedback, so wasn't worried about it.
the buyer has 100% feedback but only a small number nxt to star, the message i got was a little abrupt, which made me feel like i had done something wrong lol

Your receipt is your proof of postage offering you up to £34 (approx) compensation if parcel is lost by PO. If doesn't turn up fill in form they will pay eventually.

Whatever you put on your listing it is your responsibility to get the item to your buyer. If not you refund them - after a reasonable amount of time. If you mean last Monday I would apologise and ask them to contact you if parcel has not arrived by say this Weds and you will refund.

How long have they waited for it to arrive?
If less than 2 weeks, i would tell buyer you will refund after 2 weeks as it could just be delayed.

I sent it on the 8th of Feb and all other items were recieved 9th/10th, and all feedback great, except this one.
so it has been just 14 days since i posted it.
I emailed and asked if maybe they could check their local office, see if there might be a backlog etc, i know its a pain, but it would save all the hassle, and they would hopefully get the item!
if not i will refund and claim, i know its only £ 3.99 but im perticular about every penny that comes in and goes out.

On a side not, I get so irritated when I see that little disclaimer that sellers like to put that says "not responsible for items lost in the post but happy to provide proof so you can chase it up". Grrr - they do have to refund, and they dont seem to realise that the post office will not follow up claims from the non-receiver, only the person who sent it. I always feel like sending them a snotty message about it even if I have no intention of bidding!!!

Yes, OP, tell them to give it a few days and if it doesn't turn up, you will refund. I always send items recorded. It doesn't cover you any more than a proof of postage when it comes to compensation, and its not trackable along the way, BUT it does stop the buyer from saying they never got it, which stamps out people getting things for free. And I make them pay the recorded - its the only option I give on my postage methods and its factored in to the cost. Worth considering for future sales I suppose.

Sorry, you have to refund. Not necessarily shady by the way - where my cousin used to live, post boxes were regularly vandalized and things didn't get through. So the person complaining may be genuine if he/she has been the victim of this and hasn't yet realized there's a problem with the post service.

I think you should wait 14 days, as royal mail suggest for non-recorded parcels, and if it doesn't show up either make a claim yourself or forward the receipt for the buyer to make a claim. If they won't wait that long i'd just refund and claim yourself.Good luck!

ive been ripped off too i sent a few postal orders off a few wks ago and the £3.70 one never got there seller said never got it but yet the £50 one did cant get cash bk as lost my recipt

The buyer cannot make the claim on the OP's behalf, the post office will not allow this, and nor should they have to. The contract is between the OP and the post office/royal mail. The buyer only has a contract with the OP.

Imagine if you ordered something off mothercare and the courier stole it, yet you had to chase the courier company and claim yourself rather than just getting refunded by Mothercare. Wrong wrong wrong.

This is why I always always use recorded delivery, even if they item is only 99p (except now I don't sell anything for under a fiver, because its not worth it)

If you've had over 400 transactions and you've never had this happen before, you must have been due for it.
Things just do go missing in the post and the more you use it the more it is bound to happen sooner or later.

chandellina - why do you immediately accuse the post office of failing to honour its contract with the op? The items were not sent recorded. There is no evidence whatsoever that the Post Office has failed to honour its contract. It is just as likely that the item actually has been delivered. Ebay is full of scammers who will always deny receipt if they are aware that the item wasnt sent recorded.

paisleyleaf - yes we are due for something lol, ive had a few probs when buying something, but never sending anything, i always send the next working day aswell, as i hate waiting weeks for things!
expensive stuff i send recorded, but most of the time its first class parcle/package.

Hopefully it will turn up, otherwise im gonna be a grumpy bum at the PO lol.

also your right it is unreasonable to not refund, just wish i didn't have to for the hassle !! argggh

You should always ask for a proof of posting for each item when you post them - they can go by regular post and not recorded, but you will have an individual receipt for each item with the address of where that item is going, which gives yhou a bit more clout when claiming from RM or proving to buyer that you did send it.

I hate ebay atm,i sold a pair of UGGS last Nov,i got £75 for them & took them down to our post office to send them off.

They were really busy & the clerk didnt send them recorded as i had asked just insured upto £100,anyway the buyer didnt get them obviously & i have had to refund her & then claim for the money back from the PostOffice.

They had sent her a form asking her to confirm whether she had had them or not & she never bothered her arse responding so i have only just 2 weeks ago had my money back.

Ebay went down the pan when they stopped sellers being able to leave neutral or neg feedback,buyers know this & some are just out for what they can con off you.

I too get a bit peeved when I see 'I dont do refunds, happy to give receipt so you can take it Up with the PO'. To me what they are saying is .. I dont give a damn once I've had your money so I never bid on those items. Even though legally they would have to refund.

I know OP you havnt' done this but you have to refund. Chances are the buyer could be genuine and the item not received or could be a chancer as it wasn't signed for.

Do ask if they can check it isnt at the sorting office. This happened to me with an Amazon sale that didnt arrive. The buyer asked me to check and I didnt think it would be there but it was. The PO guy swore a card had been left but there was no way I had missed it.

Cwtch - im confused you said the clerk didnt send them recorded as you asked but "insured up to £100". To be insured up to £100 didnt the item go Special Delivery where the minimum insurance is £500 anyway?
