I have never seen any signage at Tescos to say there's an age-limit on using their P&T spaces, nor have I ever shopped at one using the permit system - which is, incidentally, probably the most sensible way to deal with this.

After all, a sign that simply says 'Parent and Child' is open to interpretation - I have wondered, idly, if I could use them if my mum was in the car with me (not seriously, honest).

From what the lady concerned has said in her responses to the article, I gather that it's not the first time that she's used these spaces with her child, and she's never either been told that he's too old or seen any signage to tell her that he's too old.

Given that, and given the lack of information from Tescos to users of the carpark about a change in policy, I suspect that she's got a very good chance of fighting this fine.

That said, I would love to see Tescos and other supermarkets fining those who misuse P&t and disabled spaces.

My dc's are 6 and 4 and we never park in P&T spaces any more. There is no need. It just becomes about parents too lazy to walk at that age IMO.

I think she deserves the fine TBH. As long as they are fining all the people who park in them with no children of any age aswell.

When dd was less than 6m we were headed for the last p&t space in Sainsbury's when we were beaten to it by a young chap in a sports car. I jumped out and said "I'm really sorry, but you've parked in a p&t space and you have no idea how much difference that extra width makes. Would you mind moving your car?" He smiled, got back in and moved it.

I think they should just get rid of P&T parking altogether. It just causes far too many arguments.

Yeah right love, no spaces in the whole car park except in the parent and toddler bit. We've ALL seen that .

She has said to one poster: "I actually feel quite sorry for your children for having such an ignoranus as a parent."

JackBauer - thats my local paper too! I saw it earlier and thought she had made herself out to look so stupid as she clearly didnt need the space with an active able 9 year old. £70 does seem a bit steep though!

I saw a middle aged man and a twenty-something woman park in in parent and child space recently. I politely called out to them 'you do know this is parent and child parking, don't you?' to which he replied 'she is my daughter'. I answered 'my she looks mature for her age!'

TBH she looked more like his 'niece' than his daughter...

Are there any legal eagles around that can clarify the comments that the fine isn't enforceable ?
DH was shopping and then had lunch in the Trafford centre and got fined £70 for parking for more than 3 hours, he paid it but I had a feeling he shouldn't have.

Sorrento, not a legal eagle, but aware of these things...

It's not a fine (i.e. one broke the law), but a parking charge notice (i.e. one broke a contract). The distinction is that only police can impose a fine, whilst any "authorised" person can impose a parking charge notice - and this is only enforceable (in law) if they can prove the contract was enforeable. AIUI such proof has yet to be challenged in court.

I would have thought that for a contract to be enforceable, the parties both have to be aware of the terms, so if a supermarket doesn't have clear signage of any restrictions on certain parking spaces (ie you must have one of their permits to use a {&T space or the child must be under 5), then a court wouldn't uphold the charge.
