I don't know tbh.. I had a cafcass report exdh wasn't happy as it went in my favour ( actually the ds's favour).. the report stood and wasn't changed.

gardeningmum05 · 30/04/2009 18:24

i had a cafcass report go in my exh favour, and she admitted to me she was pushing for dads at the time to be politicely correct.
he is a non working, non paying 39 year old living with his parents.no job, no life, no parner.
t
the judge found in my favour completely, so take heart.

saleena · 30/04/2009 23:45

the report has gone on my favour my x is not happy and wants his solicitor to sit in the next meeting when he meet his son at the cafcass center what shall i do?

OP posts:
saleena · 30/04/2009 23:49

OP posts:
saleena · 01/05/2009 13:32

does anyone know plz help

OP posts:
BCNS · 01/05/2009 13:35

I did nothing tbh.. the judge agreed with it.. and that was that.

racmac · 01/05/2009 13:45

Tough if your ex isnt happy - that not your problem - the Solicitor wont be allowed to sit in with your son - the Solicitor shouldnt even be suggesting it.

BCNS · 01/05/2009 14:03

If I remember rightly.. Cafass will want to have a natter with ds on his own..not with a solicitor there.

Litchick · 01/05/2009 14:25

Don't worry - tis a tactic.
If the report doesn't go your client's way you're going to need something to hang your cross examination on.
So you argue they didn't spend enough time with all the parties and kids. And you argue CAFCAS is biassed. If you ask to sit in and you're refused , you say, aha, you're biassed, and you can hang your questions on that.Did you ask x? Yes. How can you prove that, you wouldn't let us sit in? How did DS sound when he said x? How can we believe you when you wouldn't let us sit in. Is it possible the child meant x when he said y? How can you ptove that...you see how it goes. An experienced officer won't bat an eyelid.

saleena · 01/05/2009 15:18

my x claim I have lied and the report is not true now he want his solicitor to sit in the next meeting he is going to have with my son but the report went in to court last Monday and i am due in court in a few weeks time can the report still be changed ?

OP posts:
Litchick · 01/05/2009 15:27

Well he can ask, but if the final hearing has been listed the Judge may well say no.
If he's saying you lied to Cafcas and the report is based on falshoods, his lawyer can put that to her in cross. Or that's what I'd argue if I were your lawyer.

saleena · 01/05/2009 17:26

Litchick are you a solicitor?
Even though the meeting is book with my son, x and my x?s solicitor can I still say no this meeting? That this meeting cannot go ahead . My x can have the meeting but not with his solicitor present or shall i ask that if his solicitor is going to be at the meeting then my solicitor will be to
thank you for your feed back

Litchick · 01/05/2009 18:25

Was a family solicitor for a long time, though not practising now.
Do you have your own sol? If so, you really need to speak to them and find out what tactics they'd prefer to use.
If his sol is there, your sol may very well feel that he/she should be too. Certainly I'd want to make sure that his sol was there as an observer only and took no part what so ever.
Or you may object altogehter to any sols being there. But then don't be surprised if a lot is made of that at court.
You need to decide with your sol how you want to play it.
But don't worry, it would be unlikely for CAFCAS to totally change their mind and do a u turn.

Litchick · 01/05/2009 18:26

Should add that if they did do a U turn, your sol would simply tear them apart in cross saying they'd bowed to pressure.

saleena · 01/05/2009 23:12

thank you very much feel much better after reading your feed back i'll ask my solicitor to be there too at least then it can not go against me thank you once again x
