In expecting the council to provide a house that i can actually move into??? (long, sorry)

Some background first - my hubbs died last August, and now my children and i have to move home. We were living in an adapted bungalow as my hubbs was disabled, and now the council need this bungalow back. Which is fair enough, before we moved here i did sign a waiver saying that should anything happen to hubbs then i would be willing to be rehoused.

So, on December 19th, the housing officer calls round here and tells me that a house has become available for me, and that they need me to move in within a fortnight - my tenancy is due to start on the 5th Jan. Despite the fact that it was Christmas week, and despite the fact that it was our first christmas without hubbs i took it on the chin and got cracking.

I was given a £50 decorating voucher as neither of the childrens rooms have been stripped ect, and the wallpaper was hanging off, so enlisted the help of some friends and we started to strip the walls. Behind the wallpaper, the walls are in a terrible state - holes big enough that i can fit my hand in, and holes with random pieces of wire sticking out of them ect. An inspector came out and had a look and said that yes, they need work carrying out on them and that the plasterers were about 4 months behind. I explained that i was due to be in the house quite soon, and he told me... oh well.. just stick some old newspaper in the walls and some polyfilla over it

I then spoke to my housing officer who asked me to take both children in the same bedroom as me for a few months until the work has been done - i told her that that wasn't happening. My son has health problems which sometimes mean he has very disturbed nights and whilst i can manage that, he tends to disturb the baby if they are in the same room, hence me having a 3 bed house in the first place.

SO back to the house - there is no electric or gas there currently - the previous tenant left debts on both meters, and am waiting for the utilities to send me out cards so that i can get them back on. Then the council need to come and do an inspection of both gas and elec, before i can move in.

Which brings me back to the state of the house. The council have boarded up the fresh air vent that comes in from outside - now i'm not a whizz at things like this, but i do believe that that might be dangerous and could lead to carbon monoxide poisoning, especially as there is a gas fire in the front room which has a boiler behind it? There's also a three inch hole in the ceiling where they have resited the lights and not bothered to fill, hence being able to see directly into the electrics.

Then there's the bathroom - they haven't connected the bath properly, so when i happened to turn the tap on, water flooded all over the floor.

And yet they still expect me to be moved in by monday - or they will start charging me double rent.

AIBU in the fact that i want a home that i can actually move into - at the very least i won't move in until the heatings been on a while - i'm not taking my baby into a freezing home when i have the keys to a lovely warm bungalow.

What do you think - AIBU?

PLease do nt mve into a house with no air breather and a gas heater / boiloer: could be deadly.

Yes shelter, very good diea IMO. And press if needed. Council willing to put your life and that of you children at risk with this- disgusting!

Local MP asap.In our area we have Homeless Welfare - what they dont know about housing is not worth knowing. Essentially as many people that you can get to listen. Definitly loads of pictures as other posters have said. Dont think people like Transco would want you to move in without proper ventilation with regards to gas.

Does anybody at the housing really understand what you have gone through this year? You need to have a small rant and explain how difficult all this is for you.

Hi folks.

Sorry for only getting back to this now. I did try ringing council today, but they are all closed until Monday.

I know there is absolutely no way on god green one that i will move in the new house until it's of a reasonable standard, i have the keys to this bungalow and if they want them back they will put the house right.

Today i went around compliling a list of every single thing that needs doing in the house, and took photos too, to back this up.

On monday i intend to go and see my housing officer and tell her that i'm not moving in until it's put right. I fully expect her to tell me that they will start charging me rent - i'm in recipept of HB at the moment, but HB won't pay HB on two properties at once - but surely i wouldn;t be liable for this if i can't actually live in it?

I'n in Swansea, and i've found out my local MP is Sian James, and her next surgery is on 9th January, but if i get no joy with the housing on Monday, then i will be ringing her.

TBH, i'm a bit loathe to go to the papers, but i will do if i have to.

To get the keys to the new house i had to sign a tenancy agreement, and the tenancy is due to start on Monday, but as i haven't had the cards from the gas or elec as yet, the council havent serviced them, so i couldn't move in yet even if i wanted to.

I hope i haven't made the house sound too bad - it is a lovely house, or rather it will be when the things that need doing are put right. I just want to be able to make it into a home for my children to grow up in.

If you go to the papers in the right way, local businesses might also send you free moving in stuff, eg hampers, DIY kit and so on, you never know.

I know this sounds pedantic, but there is a very good reason for my question, are you a Council Tenant or a Housing Association tenant?

This makes all the difference as if you are HA the Council is a seperate body and as such you can enlist Environmental Health to help you, as the HA are seen as a 'Private Landlord'. Is worth a shot honey, good luck.

God this is shocking.

My HA were wonderful, I moved in to a completely magnolia'd house with new kitchen and bathroom! (previous tenants had completely trashed it)

It's council.

There's only one thing worrying me - i've paid out well over a thousand pound to have flooring put down, and on top of that paints and wallpaper ect (that £50 decorating allowance didn;t stretch far!)

What if the say that they'll offer me somewhere else instead?

Bugger.

I think you could probably get this back from them if you went through the formal complaints procedure very systematically, if they failed to provide you with housing that met legal requirements (eg with the gas vent blocked).

We have a 'Minimum Letting Standard' for our homes, if it doesn't meet this standard then allowances in the form of B&Q vouchers may be paid to you to redecorate. In addition, in some instances, some minor repairs may be carried out to your home after you have moved in."

you need to sound like you know what you are talking about. be confident
ask them for a copy of their minimum letting standards policy document.

Then ask them firmly if they will put in writing that they think the repairs to your home are 'minor' please also ask them to add - in writing - their request for you all to sleep in the same room, considering your childs medical condition and the loss of their father recently - and it being just after xmas.

tell them that you intend to use the information which they have given you and tell your local councillor, MP, local newspapers and radio stations.

Stinky - i want to wait and see what my Housing Officer has to say. Last time i spoke to her she seemed nice enough - even commenting on the fact that she'd sprung this house on me a few day before Christmas and i was taking it all very calmly - she'd expected me to hit the roof or something i think. So, i'll put my side across to her on monday and if i don;t get the answers i want, then i shall contact Sian James - i feel i need to give them a chance to respond, iyswim?

Bear in mind too they are breaking the law in relation to the gas issue and if the gas board find out, they will condemn the boiler until the situation is remedied and you will probably be without cooking facilities, heating and hot water. Not acceptable at all for a family in January.

You want the house. You have invested in it already and you have a tenancy agreement on it. Put your foot down and insist they make it safe. Take the DC and be waiting at the door Monday morning. Take a friend or relative so you can talk without being distracted by the DC but you need them their for "effect".

I suggest the polite but firm approach, state your case and get answers, do not let them waffle and make promises. Get them to make the call to the works people while you are there. Then tell them you will give them back the keys to your current property when you can move in to your new one.

Then go to CAB about the double rent issue!

You will get through this, there is no way they can get away with treating you so badly, just bare in mind you might have to take legal advice so papers should be a last resort so you don't influence the case.

I work for a council in Housing and having read the heading to your post was ready to jump in and defend council. However as you know your council are behaving v.badly.
The Council cannot insist you move into a home with no heating or hot water, or one that has leaking pipes. These are emergancy repairs which have to be sorted out within 24 hours of being reported.

The amount of vouchers you have recieved, also appears derisory. We offer at least £250.00 in cases were the tenant is left re-decorating a property. As you say £50 simply does not cover it!

The charity Shelter have expert support they can provide in these cases and I would DEFINATELY contact them. Really for you but you sound like despite everything you won't take things lying down - good on you! Best of Luck

request a copy of the gas safety certificate before you move in and tell them that you will seek legal advice re: the rent until you get it.

tbh, i have looled at the audit commission website, wales .gov, housing corporation and swansea. lots of councils detail their MLSson their website but swansea don't -that i can see, i also can't see a regulatory document setting out what it would usually contain.

there are lots of other ocuncil examples and they are fairly much the same

non of them mention plastering per se, but i think you have them on the gas issue deinatley and you could push for an extension on your current house becuase of health issues

a few months behind - smacks to me like - new financial year - yes indeedy april

whilst you in the meeting you could ask if the HO will take minutes - let you read through them and print them up

if you push for it in writing, it really gets the ball moving

Thank you all for your wonderful advice. TBH at the moment i'm finding it a bit of a struggle. I have no family down here apart from my dad, who's been wonderful and has looked after my son during the day so i can crack on. Apart from him, and my in laws that i don't know all that well, there's no one else i can turn to. My family that live away seem to be of the opinion that it can't be all that bad, and i should ust get in there and sort the problems out then - but there's no way i'm doing that.

I have some wonderful friends who have been great - giving up their own holidays to come and help me, and i think i'll ask one of them to come to the council with me on Monday.

Thanks Faeriemoo - i didn't like to say anything over there, as i said before - i think people will be sick of me winging by now!

Cynic (a good friend) just agreed to come to the housing with me on Monday, so am suddenly feeling much more confident!
