To demand a refund?

I bought a ring for 2.5 K at the weekend. I only wore it straight after buying it to get a coffee and then put it back in the box until last night. I looked at it with my phone light to look at the sparkles and I noticed it’s got a scratch on the band. I’ve emailed the company and they are basically saying that I must’ve done the damage and they can only offer a polish and the 18 carat gold is known to be fragile. I am saying that I would like a refund under the consumer rights act 2015 as I was made unaware that it was this fragile, although I’m pretty certain the damage was not done by me they are offering to polish et cetera but I am saying that if it is causes damage by this light use then I do not want the ring as I was made unaware that I wouldn’t be able to wear it for three hours or less without damage see photos they are claiming it was not damaged when it left the shop but surely it is my word against theirs and I myself did not notice the damage until actually my light on it. Does anyone here know that consumer rights please and could advise me on where I actually stand as obviously I don’t always trust AI thank you.

bought it on Sunday, wore it as I said just to go home pretty much - I was at work for 3 days where I’m not allowed rings or even nail polish, so it was put back in the box and left there.

this is your engagement ring? I couldn’t stop gazing at mine. Whereas you seem to have worn for a coffee, shoved it in box without a second look, left it untouched for 3 days and then got it out to finally actually look closely at it. Strange

Yes, it seems surprising the OP didn’t want to show it off to friends and family at all during the first three days

EmeraldShamrock000 · 21/10/2026 19:45

It is easily done. I would expect them to repair the damage at least.

Or even look it herself!

I work at a jewellery manufacturers and this thread is infuriating.

We have had rings bought back to us within a week where the customer is claiming the item is faulty despite admitting that is has been through a washing machine cycle, stood on by a horse and trapped in a car door!

Yes, the scratch could have been there in the showroom, unlikely since it was examined by yourself, your partner and the sales assistant. Or it
could have taken a ding in the couple of hours that you wore it. Either way, the store is offering a re-polish which will make is look as good as new.

If it’s a case of you having cold feet, Philip Stoner will probably just take it back as a 2.5k sale is unlikely to be worth a fight for them.

It won’t be a fight. They’ll have CCTV

Yes, OP needs to be honest with them and herself, have a sensible conversation without the demanding attitude.

It looks quite worn already. Not brand new. I’ve had an 18ct gold ring since 2012. It’s nowhere near that scratched.

Edited

I’ve been wearing my 18ct gold wedding and engagement rings since 2000 and neither of the are scratched like that.

WhatHappenedToYourFurnitureCuz · 21/10/2026 20:01

This story makes absolutely no sense and the jewellers will see that from a mile off.

Take the polish. It's a generous offer.

PurpleH · 21/10/2026 20:13

Polishing rings can make a surprising difference. I had my engagement ring polished before our wedding day (and had been wearing it over a year) and it made it look like new

prh47bridge · 21/10/2026 20:13

Tortephant · 21/10/2026 17:42

It’s not faulty!

I didn't say it was. I was responding to someone who was misstating the law regarding faulty goods.

XenaSharples · 21/10/2026 20:14

If they polish the ring it will be as good as new. You don't need to baby it, as scratches in gold will get smooth with wear.

Cucurella · 21/10/2026 20:15

I understand why you're disappointed OP, I.would be if my ring looked like that so soon. Take them up on the offer of a polish and see what happens.

ClairDeLaLune · 21/10/2026 20:17

My wedding ring is 18ct gold and 32 years old, and doesn’t have a scratch on it. I would demand a refund.

Notaninfluencertype · 21/10/2026 20:21

How are we demanding a refund? Just standing there stomping our feet?

I purposely avoided gold because of how easy it is to scratch. It makes no difference how old the ring is, you are just unlucky you’ve scratched it immediately rather than in a year or two. Whatever you have done to scratch it would have had that same impact no matter when you did it because it’s a split second action.

GrantMyWishes · 21/10/2026 20:22

I think you've probably hit the nail on the head with this one OP!

Just because you’ve been more careful than op doesn’t mean she’s entitled to a refund.

Boopeedoop · 21/10/2026 20:26

My wedding band is 22ct, 110 years old. It doesn't have any scuffs on it like that. Almost looks deliberate.

SallyPatch · 21/10/2026 20:29

Had an identical situation with my engagement ring. They said it was porosity, and recast it for me x

squarecrow · 21/10/2026 20:34

muddyford · 21/10/2026 19:16

I was stunned when I took my 18 carat wedding ring for resizing. It's just a plain band, £87 30 years ago, to replace is £1000.

That’s crazy. I had a quote from H Samuel to resize mine for more than the ring cost. Took it to a local jeweller (5 mins walk away), and they quoted £50. I got it back and they had also polished it at no extra charge (I assume they have to, considering they’ve cut and soldered it). This was last year, 18ct gold. I would ask around if I were you! If it’s not a complication of the design as you said it’s a plain band, I can’t imagine why it would cost £1000.

Sorry - I’ve just reread and think you’re actually saying it would be £1000 to replace it, which I can believe considering gold prices if it’s thick!

LowlandLucky · 21/10/2026 20:34

That ring is not new,

Yes. £1000 was the replacement cost. Sizing up is £70, still sharp intake of breath!

The reality is that you can’t demand a refund, the law doesn’t allow it. As @ColdAsAWitches said it’s a refund, repair or replacement at the seller’s discretion and a polish in this case would be a repair.

This is not true. It’s only at the seller’s discretion if it’s over 30 days since purchase. Before that it can be rejected under the Consumer Rights Act 2015 if it doesn’t conform to contract. This means it has be of satisfactory quality, as described, fit for purpose and last a reasonable amount of time.

The onus is also on the seller to prove that it does conform to contract, rather than the buyer proving it doesn’t. That said, enforcing these things isn’t always straightforward.

OP, I would take it to another, independent jeweller and ask for their opinion first all, if you can.

You could also contact your card provider to enquire about a chargeback/Section 75.

I don’t suppose anyone’s careful with a wedding ring for 32 years. Mine’s in better condition after 26 years. That ring’s faulty.

Get chat gpt to write you a letter - honestly I get all my refunds this way!
