Blocked in a car who parked in my space

To be clear I own my flat and the parking space is part of my lease and is legally mine. If anyone wishes to use it they would need to have my permission as they would be trespassing otherwise. The space is on private land in a secure garage that requires fob access.

I have come home today from being away to find a random car parked in my space, I do not know who it belongs to. I paid to park on the street outside for an hour hoping they would move soon but no one did. Not wanting to spend any more money unnecessarily I have now parked in front of my parking space which has blocked them in. It is not impacting anyone else's space and allows free movement around the car park.

I have left a note on the car and put a message in the block's group chat but no one has responded. AIBU to block them in until I get a response?

I have nowhere else to park and I don't want to pay to park outside as its £4 an hour and I have no idea when they will move (So far it has been 3 hours that I am aware of). The managing agent is closed for the weekend but have been useless anyway when my neighbours have the same problem and as its a civil matter I can't call the police but according to google the car owner can call the police on me for blocking them in. I am also concerned in case they damage my car, again where would I stand legally if they did given that I have blocked them in?

Hi everyone, sorry I haven't been replying but had a busy evening which thankfully took mu annoyance away for a while!

I went to bed around 10pm with phone on silent as thought no way am I going to get out of bed to move my car but lo and behold just now someone has been furiously banging on my door. I ignored at first until it became clear they wouldn't stop.

Turns out a neighbour had said their guest could park there as she saw my space had been empty this week and didn't think I would be back over the weekend?! It's a very large building so never even met this person and slightly perturbed to know my car/movements were watched....

Despite my promises I wouldn't I ended up moving my car to let them out at midnight as I thought they probably wouldn't go away. The actual driver of the car was apologetic and it was clear they had been told by the neighbour they could park there so it didn't feel right to leave them stranded.

Definitely going to invest in signs/bollards as I can't risk this happening on a day that my husband needs the space and it would probably be cheaper than the amount it costs to park outside!

Blue badge holders also do get free parking for three hours IF the blue badge holder is with them and they display the blue badge. There's no difference in practical terms. You park your car, go home and get on with your day.

All of the spaces are allocated. I am not willing to trespass on someone's private property just because someone has infringed my rights.

I can take civil action if I wish to do so, that just wouldn't have resolved my problem today which was the goal.

Yeah blue badge parking on street is free isn't it.

Only if you display the blue badge and the badge holder is with you which as I explained upthread he wasn't and he had the blue badge with him, hence my need to pay or I would have also been lumbered with a parking fine.

Nope! She also wouldn't tell me what flat she was from! I will be keeping an eye out for her from now on and put a message on the group chat but unfortunately not really much I can do except try to prevent future CFery!

Thanks for the update.

Sounds as if you don't have a problem associated with a random person using your space, but instead have a problem with a CF Neighbour.

Must be a flat that has a view of your parking space, unless the person walks through the car park and sees your car.

If the person has parked there in error and you have left your phone number, I think the chances of them ramming your car to get out are low. I think some people have over active imaginations.

Plus it's fairly likely there's CCTV.

In a previous property, I had a very similar set up to yours OP. Large complex and each apartment had one designated car parking spot, accessed by a fob.
Frustratingly, people would decide to park there esp if I had been away on hols.
Contact the management company and ask for details of a towling/clamping company they use. There were signs all around our carpark with the phone number to ring and when it happened, we rang the number provided and the car was towed.

Boring thread but I'm going to add my boring two pennorth. We lived in number 18 but our parking space was number 15. FIL parked in no.18 and was blocked in with a note saying 'contact me no15 to move your car'.
I went up, apologised profusely for the totally understandable mistake, and the bloke didn't give a monkey's fuck.

Well l wouldn't have moved if they wouldn't tell me which flat, simple. Not that l would've answered the door once in bed, not a chance. Who was hammering anyway, was it the neighbour or their guest ? Cfers.

Ok this is the basics of it.

private land with no clear signage/road markings then nothing you can do but wait it out.

You call call a tow truck but it’ll be out of your pocket and could lead to them taking legal action against you for possible vehicle damage or claiming back any costs they’ve had to pay out to recover their car. You also don’t know if it is maybe a disability car. Just because there’s no badge doesn’t mean it is on PIP/DLA

id support buying one of them poles you can put in the ground and lock when the space is empty but I love the level of petty and I’m here for it

The knocking would have failed for me. Once I'm asleep I don't hear a thing. For example a car crashed through my front fence, 10 metres away from my bed. Police attended and apparently knocked on my door. I heard absolutely nothing. I used to have a phone (landline) beside my bed and would wake up to messages on the answering machine... I'm a good sleeper.

my neighbour was having work done in her house and asked the day before if I could park my car somewhere else so her skip collision could be done. I said no BUT if I was awake/indoors when it was being collected I’d happily move my car for it to be done.

Well she was blowing my phone up at 7am, school holidays and THEN was banging on my front door like police!

I told her she could f right off!! I wasn’t moving my car for shit now! Banging on my door, walking my son up earlier then he gets up when he’s going to school! See ya later mate’

You should have said if you can’t tell me who is telling people to use my property, I was asleep and I don’t see why I should move my car. Why would I trust you to explain to them how unacceptable this is? It’s a disabled spot because my husband needs disabled access, did you not even notice that?

There's not a chance in hell I would have got out of bed to move my car especially if she wouldn't even tell me who the neighbour was. I would have berated her for daring to bang on my door like that in the middle of the night and slammed it in her face.

We don't live there now but we were the first street without double yellows around the rail station ( think about a 10 minute walk from there )
Cars would park up for the day and catch the train into London .
I had one man that would repeatedly park across the dropped curb stopping me being able to get on the drive .
When I had enough of it I parked off street blocking him in . He knocked and asked if it was my car , I told him it was my sister's and he asked that she moved it . I told him she worked in London and not yet back so he had to sit in his car and wait .
After about half an hour I went out and said I'd managed to get hold of her and she told me where the spare was .
Never had the problem again !

Someone did that to me once, worse actually as they parked so badly they had taken up two resident spaces.

I left a note, never happened again. There are 2 visitors spaces marked with a V but they couldn't be bothered to use them, there's also the road out front with no parking restrictions.

This doesn't surprise me that a visitor had used the space having noticed it wasn't in use that week. It used to happen where I lived however that was only a small block so easy to go round knocking on doors.
How good is the management company in sending out memos? Can you get them to send something out on any correspondence reminding people to only park in allocated spaces and that there are no spaces allocated for visitors.

Would you prefer you had to live next to a skip full of accumulated shit forever more? I don't understand people like this. She asked, politely, you said no? What is she meant to do with the skip? Pointless negativity and unpleasantness.

OP, glad they are not still there now. Hopefully you won't have the same issue again and it was a genuine whoopsie on their part.

That would have been a condition of me being further inconvenienced by having to move my car at midnight. Car would have sat there until she gave it up.
