4 yrs for cutting down tree, no jail time for rape

Why are 2 men being given custodial sentences for cutting down a tree when men convicted of rape regularly get suspended sentences.

Is an important tree more important than a random woman! Justice system seems to think so.

I was gobsmacked too - I think it’s far too lenient.

Gloriia · 16/07/2025 17:19

It is absolutely crazy to give a custodial sentence for cutting down a tree.

A fine, community hours great.

Wtf is wrong with our judiciary system when violent criminals get less.

I was absolutely gob smacked when I heard this. I appreciate that you can't just go around felling trees because you feel like it,but 4 years does seem a tad excessive, considering rapists get off much more lightly. I think community service would have been more appropriate.

Exactiy! It was a tree fgs. Yes vandalism is bad but perspective is needed.

Tiswa · 16/07/2025 17:22

Everyone one really should read up on the sentencing and transcripts

and as I said look at Mrs Justice Lambert the judge who did it

Four years for two working class blokes for upsetting a few middle-class walkers! A tree worth about £400 and they didn't even take it away.
Middle Class students who smash very expensive windows and vandalise statues causing thousands of ponds of damage in the name of "Just Stop Oil" usually get conditional discharge.
It is certainly 2 Tiers for justice.

Indeed.

God, our nearest neighbours lopped down a tree that was lovely I had no idea I should've called the cops.

BBQmuncher · 16/07/2025 17:26

I thought the same but then, I think the issue is that rape is de facto legal in the UK. If convicted, there are custodial sentences but with the conviction rates we have, rarely anybody is ever found guilty. Men can go and rape women in this country knowing that they almost certainly will get away with it

I just heard what was reported, one of them had a very troubled life the other not so much. Court transcrips tend to be rather longwinded, bit like the sentencing itself. I wonder why no one shouts get to the point at the judge?

It was a tree. Community hours gardening would've been more apt.

Is this information really available to the general public?
I know one of them had a serious conviction in the past.

I’m sure a lot of posters whose minds are already entrenched won’t bother but if others are interested I’ll give a link to the Judge’s sentencing remarks.
Link to Sentencing Remarks

It can be seen, previous record and mental health issues are taken into account

Can you do it in a nutshell? Were they actually murders and rapists aswell?

Why? Do you think they are a danger to the public and may have turned up in your garden to chop trees down Shock

The should've just burgled someone or assaulted someone, they'd have been fine.

Sorry, the document isn't very long so I don't see the need for a precis but it shows the Judge followed the correct process and how she arrived at the sentences.
Your comment about rapists and murderers is not relevant to this sentencing.
You could search for sentencing remarks for this or other Judges' sentencing remarks for rapists and/or murderers to see the process and rationale for them.

4 years is extremely harsh. These idiots should be punished but not locked up. I actually feel sorry for them.

I wouldn't, truly.

The national trust has already spent £30,000 making the site safe!

One seems to have previous convictions for domestic violence (battery)

Well presumably you don’t live on a world heritage site and they didn’t do any damage to an important historical monument?

EarthwormJem · 16/07/2025 18:24

Can't get my head around the sympathizers.

Ten of thousands of damage (coming oit of a charity's pocket, including thousands of damage to a UNESCO World Heritage site (the wall itself), premeditated, all for a laugh, and lied and denied all the way through the proceedings.

And people think they should maybe have to do a little gardening? Unreal.

'Important historical monument'. It was a tree. A very nice tree, but not a monument by any stretch.

The time should fit the crime and once again this doesn't. It was vandalism, far far worse things go on and folk get an ankle tag and community hours.

I know. It blows my mind the way some people are seeking to trivialise it.

It’s about being proportionate and comparative.

men don’t get prison sentences for having the very worst category of child sex abuse images. Almost always.

its a tree. Its loss has caused to any individual a small amount of possible distress. They could have been required tonrepay

Have you read the sentencing transcript because yes it is about proportionate and comparative and it sets out exactly how the sentence is that

I think Hadrian’s Wall is an important historical monument 🤦‍♀️ They damaged the wall when they cut down the tree.

They caused damage to Hadrian’s Wall. Maybe read up a bit on the actual crime before making your of so insightful comments.

Well yes damage to a historical wall is bad as is cutting down the tree, both bad. It's the 4yrs custodial sentence that is ridiculous when actual violent criminals get sent on their way.
