ive really messed up here and now am panicking
My husband was caught speeding in my car. Stupidly I somehow didn’t realise the letter was addressed to him after he’d opened it and showed me, so I filled out the form genuinely thinking I was the registered keeper (I’m not).
the next form was addressed to me and I was late send this back due to a hell of a lot going on in my life at the time and be just being overwhelmed and quite frankly stupid. I rang the number and they gave me a 7 day extension and said just send it now and don’t worry.
husband received his form and confirmed he was driving at the time.
we’ve now received a court summons as this whole process has taken beyond the amount of time allowed for police to deal with the matter and I’ve wrongly named myself as the registered keeper/filled out a form addressed to my husband.
In realise this is beyond idiotic but was a genuine mistake. Ive messed up every part of this process and have got into such a state with it. I’m a good person, clean lisence would never do this intentionally.
im panicking now but am told all I can do is wait to hear what the court decide.
How much trouble could I get in?!

I know it’s not good. For what it’s worth the points are from years ago and are due to be wiped in November. Not sure if that makes any difference

Nah, it won’t. Although if it was 56 in a 50, I don’t think he’d end up with a ban.

@Halycon the magistrates will decide based solely on the sentencing guidelines and guidance from their legal advisor, thankfully not on what randomer as like you think should happen!

I doubt he will end up with a ban. Hefty fine though depending on income.

I know you said he is the registered keeper, who is the registered keeper on the insurance documents, you’ll need to take those to Court.

Can’t believe that. I really thought it was up to me.

But yeah, you keep being thankful that he’ll dodge a ban until your child is crushed under the wheel of a driver like him.

@Wanttohelpbuthow try not to worry too much. Everyone goes to court if they don't provide the info in the time limits for the police to deal with it, it doesn't suddenly become a more serious offence. Thousands of motoring offences are dealt with in magistrates court.

I dou t anyone cares about the registered keeper bit. They just want to know who to give fines and points to. Which one of you has been called to court? I would suggest you both go.

Driving is a privilege not a right. I'm not quite sure I understand the nuances. If he pressured you, that's a separate issue, otherwise it appears your husband a) sped and broke the law and b) you subsequently committed fraud either accidentally or intentionally. How fast were you going? Is it your/his first offence? I was under the impression the majority of speeding offences were dealt with by a fine and/or an awareness course. I would likely seek legal advice.

Great question. It's unclear if it's fraud or a driving offence. But to be honest, it doesn't really matter. If you can, seek legal advice beforehand, if not contact the court and ask if they provide legal aid and a duty solicitor on the day. I would personally tell the truth and express genuine remorse. Don't miss the court date.

My husband has been summoned to court. When we rung the police number provided they said it was because it’s now outside of the time frame allowed for police to deal with it as a standard fine as has to go to court.

my error in naming the wrong registered keeper and sending the letter back late delayed things too much. The fact I put the wrong person as registered keeper was noted on the phone call and I was told for my husband to just be honest and say I’ve got so confused with this whole process and have accidentally filled the forms out incorrectly

I was also told he wont be physically going to court, we’ll receive paperwork and a statement from him will be read out?

I'm afraid I don't. I'm banned from driving for medical reasons, so my empathy is reserved for people who don't repeatedly commit crimes that can harm others. You aren't automatically allowed to drive - it's an earned privilege. Some people have, through no fault of their own, this choice taken away. It's a lesson when you muck about and have to pay the cost.

Yes but her husband repeatedly sped and I don't feel sorry if he's fined heavily or losses his licence. There would be a punishment either way, and rightly so. Car ownership is a privilege. I see your point but the entire situation is confusing.

He could certainly get a ban. 3 points for speeding is an offer to encourage you just to take the points. It’s very common for these offences to get 6 points if they actually come to court, which means he will be banned under totting up rules.

You should both get proper legal advice.

@MumblesParty no idea!! This is what confused me too. The final letter we got before the court one said my husband had 28 days to respond and he sent a reply in about 3 days. Then he got the court summons after that

It doesn't sound like anything the court will get too excited about, if it was just about who owned the vehicle not who was driving.

Did your husband also think that you were the registered keeper?

Im trying to work out why he gave you the form and let you fill it out.

@CFbillsplitter yes he did, I realise this sounds really stupid. We have a lot going on right now and this was just another thing on the never ending list of things we were trying to sort out at the time so we just rushed through it
