Court summons for mobile phone driving

Hi all
I was caught sending a text on my phone in standstill traffic in March last year. Silly of me but a police officer was walking past and caught me. I got issued an FPN and received a letter in the post with a £200 fine and then details of how to surrender my license details online. I didn't realise that I also had to send off my license, fill out a form and send that off too. I honestly just didn't read the form properly.
I paid the fine and did it online but didn't send the form off. In September, I received a refund of the £200 and a court summons.
I'm due to go to court on the 23rd and was wondering if anybody had any advice?
I want to just go in and be super honest and say it was human error and I didn't read the form properly. Has anyone ever had this before and received more points or a larger fine?
Do they just reissue the same as on the FPN or am I at risk for more?
Any advice valued please

@Thegoatliesdownonbroadway I don't think you read my posts. I said that I would bring it up to support why I didn't read the form properly. It would be in no way related to the offence itself. My adhd didn't make me send a text to my dad to tell him when I would be home and should in no way be used to excuse it. If I was using it as an excuse for the offence then yes, I agree, I shouldn't be driving. But that's not what I'm saying.

Can you read road signs properly? Speed limits, one way street, no entry, etc.

@YourOwnPersonalCheeses Yeah that's one of the symptoms of ADHD. I take meds which help a lot but I have to really hone in on something to take in information. I've not made a mistake on my course yet because of this but I obviously wasn't paying much attention to the letter.
All jobs require attention to detail, but you clearly think because I missed a section on a (completely unrelated to nursing) letter, then I can't perform my job. Seems silly to discourage a nurse from the NHS because they've got ADHD. Perhaps I should just give up working and go on disability benefits then instead?

Only if it doesn't affect their driving. So it's up to the individual to decide for themselves.

glad to hear that people are getting prosecuted for using mobile phones while driving. they should extend the legislation to cyclists too.

I see that we didn’t even make it to the end of the first page about a driving offence without someone trying to bring cyclists into it.

It's ok that people are angry. Thank you to those who have defended me but I did make a bad choice and I've been rightfully caught out. I just wanted to know what would be the best way to go about it in court. I plan to be incredibly apologetic (as I am) and be 100% honest.
I also haven't disclosed my ADHD diagnosis but my mums said it might be good to bring up because it's classed as a disability. To me that feels like making excuses though. Would it help my case at all?

If I was your mum, initially I’d be shaking my head at you, but I would also be very proud of the fact you are ‘owning’ in full what you did, and have learned a lesson on ‘life’. It won’t do any harm to say in Court that due to your ADHD you find it difficult to do whatever, but, to be frank, they may wonder how you will cope with nursing if you find it such a problem … I dunno; just putting it ‘out there’ . These sorts of cases are a dime a dozen, and whilst it is currently your life, the court just wants to get through as many cases in a day as they can, so I doubt that it will change the outcome to any great degree.

As I said previously, they will probably fine you as per the original paperwork, but because it has had to go to court, you will most likely have to pay court costs and a victim surcharge on top. It has been an expensive lesson for you.

OP it’s clear you are a good person who just made a mistake. I think your ADHD is relevant in terms of not completing the form properly and I would disclose this personally. Soon this will be over and you can put it behind you!

I do find it a bit odd that it’s illegal to touch a screen but it’s fine to send messages etc via voice control, considering that also requires a split of focus and concentration.

being a student nurse doesn’t mean you can send txts while in control of a car.
make sure you read patients notes, reports, results and details properly when you qualify!

You will need to declare any convictions on applying for nursing jobs and they will normally come up on enhanced DBS check.

Well quite. Personally I put my phone on DND driving anyway. Trying to use a phone and driving has been shown to be the same as driving over the limit. Something I have mentioned countless times on MN to no real effect.
