Parcel put in the bin and taken away on bin day

I bought new pyjamas, a dressing gown and slippers and the total was about £100. They put it in the bin in the evening which I wasn’t aware of and it was collected in the morning. Do I have a claim

Yes, unless you told them your safe delivery place was the bin. You've contract is with the seller not the delivery person. Get in touch with the seller and see what they say

Thedishwasherbroke · 19/12/2024 20:41

Contact the retailer - unless you specified the bin as a safe place I’d say the courier or postman didn’t deliver it properly and you’re therefore entitled to a replacement. It’s for the retailer to then pursue the courier or Royal Mail.

ThatCoralMaker · 19/12/2024 20:43

You definitely have a claim unless the bin is your safe place.
At this time of year I ask for the green bin to be my safe place as there is no garden waste collection until spring and it is by my door under the security camera.
I did have to argue for this to be a safe place though as delivery companies are aware of the risk of your situation.

JohnofWessex · 19/12/2024 20:44

The contract is with the vendor not the courier so just deal with whoever you bought the stuff from

TestingTestingWonTooFree · 19/12/2024 20:45

You absolutely have a claim, against the retailer.

Magssss · 19/12/2024 20:47

Yes this happened to me with a White Company gift my friend had sent me. She emailed them and showed them the slip that said it was in the bin. They replaced it without any issue. It’s a ridiculous place to hide a parcel, clearly not a “safe place” or hygienic!!

stargazerlil · 19/12/2024 20:49

Did they send you a pic of it in the bin so you knew where it was? if not then claim from the retailer. I once had a large John Lewis order put in my neighbours bin and a photo sent of a stone on the ground as confirmation. I was running all up and down the street looking for m6 order,Ridiculous.

catphone · 19/12/2024 21:00

They sent an email to say theyd left it in the bin in the evening but I didn't know it was in the bin until the following day after the bins had been taken so if id of checked my emails then id of known but I didn't

I don't think you have any recourse since they told you.

Ridiculous, what if you don’t come home before the bins are emptied?!? How do the delivery people know when bin emptying is?

Hardly. OP doesn't have to be monitoring her inbox 24/7 and she is allowed to leave her house and not be in close vicinity to the bins that night. The package shouldn't have been in the bin in the first place.

SuzieNine · 19/12/2024 21:13

Incredibly, this is a thing: amp.theguardian.com/money/2014/jan/19/yodel-fail-deliver-ebay

OP said they were emptied next day.

brentwoods · 19/12/2024 21:18

It was delivered into your bin?! How idiotic is that? Of course you have a claim. They can't rely on an email as appropriate notice of delivery if they didn't take care to deliver it to a safe place to begin with.

MyrtleStrumpet · 19/12/2024 21:20

Why do delivery companies think it's acceptable to put deliveries in the bin?

Say there is no safe place and collect if you're not in, or order things to a collection box.

And if she was away overnight? 🙄

OldJohn · 19/12/2024 21:22

I have a notice on my door that says to leave parcels in my blue bin. I change it to leave in my grey bin depending on which is due to be emptied. So far it has worked well.

MintyFreshest · 19/12/2024 21:24

Omg I have just found yet another Xmas present delivery that had been chucked into our recycling bin. The bottle one too so wine/beer has dripped all over it.

They don't knock, they don't put a card through. Nope just chuck it in the bin and leg it.

Makes me so fucking angry actually!

dillonbarks · 19/12/2024 21:25

@Kikibee

And if she was away overnight? 🙄

She wasn't though, whataboutery not relevant.

I'm not saying it s right that she should have no recourse btw, I'm saying from their POV, OP was told. I think putting parcels in bins is utterly stupid and I'm surprised it's still happening.

PiggyPigalle · 19/12/2024 21:31

A bin man here comes way ahead of the actual collection, checking inside every bin. They empty half full bins by hand into another to make collection faster.
If a parcel was sitting on top it couldn't disappear as you described.

It doesn't matter. They did not deliver it to OP. They put it in a place that she did not allocate as a safe place.

She is absolutely entitled to a claim with the seller who will have to pursue the courier if they want to.

You can't just do whatever you want and say "well I told you I was doing it." How long is reasonable to expect OP to see the email and collect before it gets taken? Is it ok to pop it in the bin an hour before collection as long as they email? 3 hours? 6 hours?

dillonbarks · 19/12/2024 21:34

@DoughDear

I'm not saying it's right; it's not my opinion just how I think their stance will go

You’re talking nonsense. That may happen where you live but it certainly doesn’t happen where I live.

Shallana · 19/12/2024 21:41

The delivery men around her have stopped bothering to knock and now just leave parcels in front of the door, several times I've opened to door to them walking away having just abandoned the parcel there!

Came back from walking to dog earlier to see that they had been and left two parcels for our neighbours in the middle of their driveway - despite the neighbours having been home all day!

I understand. I'm saying legally it doesn't matter. The seller owes OP her products and they were not delivered. The law is on OPs side. If anything, she helpfully has email evidence that they put it in the bin.

Whatever ridiculousness the courier wants to spout about why they thought it was acceptable to put a parcel in a bin is nothing to do with OP. The seller will have to take it up with them.
