To have given my neighbour short shrift on the phone after I allowed access under false pretences

Neighbour is almost at the end of a first storey extension.
i never opposed any of the plans and as she was extending to the end of her garden I figured that it would give my small garden a litttle bit more privacy. I can see having reviewed the plans her builder has built out 1400 more than was on the plans.

she messaged me to ask if her builder could come into my garden as he needed to make a small hole - there are three brick vents n the new bit so I summised he must’ve been adding to it.

my DD text me at mid day to let me know we had a window facing directly into my garden - I check on my CCTV and she was right.

i phoned the neighbour aghast and asked her what the hell she was playing at and that the window was definitely not on the PP application-her response
‘we needed more light’ 😩

I told her under no uncertain terms that her builder was to vacate my property and to stop work

AIBU to ask them to brick up the window and return it back to how it was - I’m tempted to call the planning enforcement officer so they can see all the other gaffs they’ve made but panicking that she might get asked to tear it all down - which although I’m really cross about I’d not want that to happen.

From inside neighbours house will they be able to see out the window? It looks like it's high up.

Well, somebody’s accessing it and opening it out into the op’s garden airspace.

Anyways it is an oppressive and dominating feature from the op’s property. Having the eye of Sauron hitting your eye line as it just alongside the boundary, if not on. Spoils the amenity, not forgetting it is being used in a manner that encroaches on the op’s property.

Also, being done without planning permission, and covertly installed.

Counsellor was quick as anything - responded asking for more detail!

Hoorah! You need a jobsworth on this to apply the letter of the law.

Not in a planter it's not

@Happyher there are clumping non-invasive bamboos that are OK for gardens.

But a planter would work too

So, the neighbour would push the window open into the op’s property, reach over into the op’s property in order to damage the op’s property.

And judging by what's happened so far, do you honestly think that will stop her? Ooh, mustn't open the window and trim that bush that's growing underneath, somebody might complain! 😂 Get real.

She's shown a blatent disregard for authority in all her doings!

LEWWW · 25/09/2024 16:12

that’s crazy OP.

In the meantime just smear it with mud and dirt 😁 refuse access to clean it, I imagine trying to clean the outside from the inside would be very hard indeed.

Cailleach1 · 25/09/2024 16:13

@WhistPie . I was merely pointing out that everything you suggested the neighbour might do if damaging the op’s items would be whilst trespassing on the op’s property. Not a simple ‘what the neighbour might did next’, as if it were without a criminal element.

And I was pointing out that she's installed a window which opens into the OP's airspace. Do you seriously think that she doesn't intend to open it? Of course she does. And whilst opening it, could easily trim any growing foliage

Cailleach1 · 25/09/2024 16:26

Nope, never said she never intended to open it. You’re the only person with that statement. Indeed it is probably open as we type.

LondonPapa · 25/09/2024 13:22

Great but why haven’t you reported to planning enforcement? This is what they’re there for and neighbour clearly stalling. They should’ve been your first port of call after telling neighbour off.

i have

Fingers crossed that Planning (with Councillor’s support) will have it bricked up again.

If not there will be options open to the op which will make sure the window cannot open out onto her property, so that the neighbour won’t be engaging in any criminal activities from that space.

Bottom of window starts at about 2700 I’m guessing

@TooManywines

Sounds like your idea of a basketball hoop would be about perfect then!

2.7m is just under 9ft and the NBA standard hoop height is 10ft, so that window should be suitably fully obscured by the backboard, as long as you get one with a full/regulation size board.

Butterworths · 25/09/2024 16:41

There was an opposite thread to this one where the OP was the one with the window overlooking a garden in this sort of set up and everyone agreed that the OP should ignore the neighbour's requests to remove it.

Had that person just added it in without it being on the planning permission?

You could hammer on extra at top or sides if needs be.

Any suggestions of what we can do/add in front of that window - on a low budget gratefully received

Trellis and flowers over it.

A huge cardboard cutout of a celebrity of your choice.

A surfboard resting on it.

A huge fuck off parasol.

A basketball net just above the window. Practice shooting hoops. Invite all the local kids to practice.

An archery target.

A Donald Trump style Mexican border wall.

,😂😂😂

Rainbow1901 · 25/09/2024 18:47

You could try a sun sail shade or very smoky barbecue or fire pit!! ⛵🔥🍔
Or a very bright light from the bottom of your garden directed at the offending window!! 📡
An automatic light that switches on with movement or in the wind would be even more irritating. Imagine a flashing light going on and off at all hours?? 👹

That brickwork is shocking!!

stewart10 · 25/09/2024 20:23

Please do not allow your neighbour to build up to your boundary. We have had this issue in the past and its a nightmare. Every time any work needs doing on that face of the extension they will need to come into your garden for access, along with any scaffolding if needed etc and you would be hard pressed to say no. You may not mind but I certainly wouldn't buy a house where a neighbours house is up to my boundary. Good luck.

TooManywines · 25/09/2024 21:00

I have an update!

DS told me there was much opening and shutting of window during the day then took a photo when it was quiet
The window aperture -it’s covered internally with plasterboard
don’t know if it’s been propped or attached

🤷‍♀️

Giant garden windmill. But like we did with bicycles, put playing cards in it to make a flutter noise.

They think you're nosey and want to prevent you looking in.
