To have given my neighbour short shrift on the phone after I allowed access under false pretences

Neighbour is almost at the end of a first storey extension.
i never opposed any of the plans and as she was extending to the end of her garden I figured that it would give my small garden a litttle bit more privacy. I can see having reviewed the plans her builder has built out 1400 more than was on the plans.

she messaged me to ask if her builder could come into my garden as he needed to make a small hole - there are three brick vents n the new bit so I summised he must’ve been adding to it.

my DD text me at mid day to let me know we had a window facing directly into my garden - I check on my CCTV and she was right.

i phoned the neighbour aghast and asked her what the hell she was playing at and that the window was definitely not on the PP application-her response
‘we needed more light’ 😩

I told her under no uncertain terms that her builder was to vacate my property and to stop work

AIBU to ask them to brick up the window and return it back to how it was - I’m tempted to call the planning enforcement officer so they can see all the other gaffs they’ve made but panicking that she might get asked to tear it all down - which although I’m really cross about I’d not want that to happen.

so immediate response is to report to council planning department - which you have done

do not under any circumstances water or sprinkler to the window, damage to another property could potentially get you into more problems than the window itself

planning permission is required for a window on second floor if overlooks a neighbour (opaque) and opens !!!!!

pursue this to the very hilt. if a window was required and more light needed, then a roof light should have been installed.

We are rooting that you have a good council person.
Council man doesn't sound as spectacular as man chicken though...

Yes I was willing to overlook this as by doing this is made my garden more private anyway - see diagram
on the right hand side - they built
their flat roof extension all the way up to the exterior wall which is the boundary for the whole site

however this window that has appeared in a matter of hours looks directly into my garden, my kitchen and faces my bedroom window - my daughter could throw stuff into their open window it’s that close to her bedroom window too

Contact the building control officer. They will serve a stop notice on them and it will cost a fortune to get it put right. Bollocks to just putting up with it.

Wow! We have an extension and we would never have dreamed of doing this! We got a velux.

Would something like this help?

That sounds hopeful

Counsellor was quick as anything - responded asking for more detail!

Great but why haven’t you reported to planning enforcement? This is what they’re there for and neighbour clearly stalling. They should’ve been your first port of call after telling neighbour off.

Already done. Read all of OP's posts.

Why haven't you read the whole thread? Or even just the OP's replies.

She reported it yesterday.

2doglady · 25/09/2024 13:28

I got the impression op had reported to council enforcement but had copied the Councillor into her email?

The Councillor is probably a bit quicker off the mark than the Planning Department.

Iamiams · 25/09/2024 13:43

I think with the number of breaches I hope they will be told to take it down. The neighbour and builder show they have no consideration for the planning process. And shocking puttying around that window - looks like playdoh.

They will never sell the place if it’s breached pp.

Invite your councillor round fora look. A good councillor is worth their weight in gold.

montelbano · 25/09/2024 14:02

OP please do not do anything to directly antagonize your neighbour at the moment , and that includes spraying water at the window. You simply should not give the neighbour any ammunition that you are being difficult. Polish your halo and leave it to the authorities to sort out. She has broken at least two planning regulations, and perhaps more.

if they don't, then that is when you roll out the stinking compost bin, winter fish barbeque, basketball net, extended trellis (nail two together) with fast growing climber ( e.g. Virginia creeper) etc., etc.
Good luck.

nosmartphone · 25/09/2024 14:04

Before the extension, what was there? A fence? Have they literally built on the boundary line? I thought you weren't able to do that anymore. We have a run down garage that is, and already been notified that when we rebuild it, it has to come back from the boundary and a fence go in down the side.

I just can't see how you've suddenly got someone's else's wall as a back fence.

As for the window - that has been installed by absolute cowboys. Planning will agree I'm sure.

stanleypops66 · 25/09/2024 14:05

From inside neighbours house will they be able to see out the window? It looks like it's high up.

jeaux90 · 25/09/2024 14:23

I posted earlier about planning office etc.

But PP suggested bamboo if nothing is done about the window.

I concur with this, I have a wide planter with bamboo in (has to be in a planter)

My bamboo is about 3m high including the planter which is about 60cm high.

It's beautiful and will block the window out a treat.

That's what I was wondering too. Not sure if the OP has answered cpbut I couldn't see that she had

Don’t do bamboo. It’s like Japanese Knotweed

Not in a planter it's not

stanleypops66 · 25/09/2024 15:20

@HoppyZippy that's what I'm wondering. If it's a window thats above head height that someone won't be able to see out of without a ladder then I don't see the issue.

HateMyselfToo · 25/09/2024 15:23

I think you need a decorative pub sign on a pole right outside the window that squeaks and bangs against the sill in the wind.
Maybe the pub can be Ye Olde Cockwomble or similar

To have given my neighbour short shrift on the phone after I allowed access under false pretences
MusicMum80s · 25/09/2024 15:24

I'd just attach something to the brick wall and block it and refuse access for her to remove it until it was resolved by the council. Outrageous!!

WhistPie · 25/09/2024 15:30

All the people suggesting that the OP should grow a tall plant to hide the window seem to be forgetting that the neighbour can open the window and cut it down

That would be criminal damage and OP has already mentioned have CCTV in the garden

Cailleach1 · 25/09/2024 15:38

WhistPie · 25/09/2024 15:30

All the people suggesting that the OP should grow a tall plant to hide the window seem to be forgetting that the neighbour can open the window and cut it down

So, the neighbour would push the window open into the op’s property, reach over into the op’s property in order to damage the op’s property.
