Court summons for a parking ticket - but I don't have the logbook for the car

I bought a second hand car in Jan. Sent the new keeper slip off on the way home and thought no more of it. Despite me writing to the DVLA multiple times, spending hours on the phone with them and even paying the £25 for a replacement log book, I still don't have it and as far as I can tell the car isn't in my name despite the DVLA insisting the log book has been sent out and it is!

Overstayed slightly (literally 12 mins!) in a car park in Feb - because I had an accident in store - and the previous owner is getting hounded by the parking company. She's just messaged me and said she now has a court summons for the parking ticket.

I have no idea what else to do. I feel like no one at the dvla is understanding the problem and to be honest I'm fucking scared stiff by the idea of a court summons. Never been in trouble in my life!

Will ring the DVLA again on Tue and will write to them again but what else can I do? I don't have any of the parking ticket details!

It's a private company car park. Will contact the shop and see if they can do anything!

She hasn't fucking inform the DVLA that she sold the car.

Just found out and I'm incredibly annoyed with her for lying to me this entire time! She's now also telling a friend everything because apparently she "can't get in contact with me" which is a lie because none of my details have changed.

I feel like blocking her and just letting her get on with it.

So she didn't tell them that she sold the car and now SHE has a court summons for a parking ticket on the car she is legally still responsible for. Keep out of that part of it.

But does the car have tax and MOT? You can check on the DVLA site. If it doesn't then you can't legally drive it until both are resolved. You can obviously MOT it if needed but if the tax has run out and you aren't the legal owner then I don't think you can tax it.

It won't have gone to court yet. I doubt she's had a letter before claim already

It's in her name.
Leave her to it.
If it comes your way- join the FB group "challenge your private parking ticket"
Don't contact the company or accept any kind of liability (or name yourself as the driver-)
There are only certain technicalities that will get it quashed. It depends if they have followed correct process etc. your reason no matter how valid won't be accepted.

The previous owner needs to declare that they sold the car prior to this parking ticket, and show proof. Then the parking company should contact you and ask you to pay the fine.

If the car park is intended for use by customers of the store, they should be able to get the fine cancelled on your behalf. all they need to do is inform the parking company that the owner of the car was delayed while in the store.

Sounds like a scam to me! The only thing she has sent you is a blurry pic of a letter? That could be anything! Is she asking for money from you?

You don't send the new keeper slip off - you keep it until you get the new V5!

And she clearly hasn't either registered online or sent the old V5 in with the new keeper details section filled in.

Honestly, did either of you read the very clearly written instructions on the V5?

You have absolutely nothing proving that you are the keeper of this vehicle.

I'd do exactly that!

If she'd been straight with you from the start and admitted she'd omitted to notify DVLA, I'd feel differently, but her fucking about is just ridiculous.

I wonder if the parking company will reissue the ticket to you once she's changed the details, or if they'll carry on trying to get her to pay?

Serves her right if it's the latter, imo.

Those private parking companies are bastards, too. DP and I once went to a meal in a pub that had a monitored car park (it was near a station, and it was the only way they could stop their car park getting full up with commuters' cars).

We put our reg number in the terminal in the pub as required but got a ticket from them a couple of weeks later. We explained, the pub manager explained but they wouldn't cancel the ticket and we got threatening letters for months. In the end, I emailed the managing director of the pub company, as did MIL, who had hosted the entire extended family, and it all got resolved.

We got a £50 voucher for a meal in any of their pubs, but the food was shite and I wouldn't eat in one of their pubs again if you paid me the £50 for doing it.

It has both - I taxed it and checked the mot online before I bought it!

I have both scans and photos of the slip. I'm not a total idiot - I just didn't know what else to do! Nothing I was doing was getting me anywhere and the seller wasn't helping at all. I even sent a form off and it was returned to me by the DVLA!

I know why now 😬😬

No reason - it came back unopened!

(I'm assuming it reached them but maybe it didn't? Not really sure what happened, just that I came home and the envelope was in my post box 😬)

It feels like legally it's her responsibility. She didn't hand over the correct forms for you to be the legal owner. You don't have the log book. It's not in your name. Quite frankly legally you can just block her and she has to deal with it.

Leaning towards this, honestly. I'm so sick of her not telling me the truth! The amount of stress she's caused me is unreal.

Car is going on Friday so that's the end of it for me.

It's going to scrap with a local company and they're okay with it not having the v5c - I'll inform the DVLA online.

I just want the damn thing out of my life at this point and I don't want to keep driving it but have nowhere off road to SORN it.
