Landlord giving notice Easter week

I moved into a rental property approx 7 months as a “long term tenant”. All rent to date is fully paid and all utilities are also fully paid and up to date.

I went on holiday one week ago for the Easter break as my industry tends to shut down around this time and everyone has a break for 2-3 weeks.

On day two of my holiday I received a telephone call from the estate agent to advise the landlord
is selling the property and notice would be sent to me.

Obviously I am not at home to receive the notice and I had no way of checking as I’m in Spain. No copy of the notice has been sent to me via email nor have I been sent any form of statement to advise how much would be payable in May bearing in mind I would be Moving out mid month.

The estate agent was wanting to get into the property straight away to start showing it to potential buyers. I said no because I’m now away on holiday and I have left out personal possessions that need to be put away before people come in. The estate agent responded he would then serve a section 8 on me for not cooperating.

Had they mentioned the landlord’s intention to sell before I came away I would have put things away and made confidential information locked up etc before I left to enable access. Now it is obviously not possible.

My holiday has been ruined as I’ve had to start house hunting online and arrange people to do viewings on my behalf. Fortunately I have managed to find something on a new development I had viewed last year and I have put in an offer. I’m now waiting to hear if it’s been accepted.

Im really irritated at the estate agent and landlord as I moved in on the basis it would be a long term tenancy. Now I’m having to move again at considerable expense. I am not in a position to keep moving all the time.

Due to the landlords timing I will need to pay for removals around a bank holiday period at double the cost. This could have been entirely avoided.

I feel totally screwed over.

In addition I have had issues with peace and enjoyment in the property due to my next door neighbour being terminally ill. Careers coming three times a day blocking access to the house, blocking access to the garage. Ambulances coming in the middle of night. Doorbells ringing through the house, and even an undertaker knocking on my door at 4:30am in the morning to take the deceaseds body in January. I kid you not!

I’m so frustrated I’m tempted to pay this months rent and move out just before the next payment is due and he can take it from the deposit.

I’ve had no compensation for the constant disruption from the neighbour and he’s not offered any form of offer to assist moving. I’m tempted to report the estate agent for misleading marketing too

I'm completely sympathetic with regards to you being served notice after only 7 months when you'd rented on a long term basis, particularly when you received this info on holiday.

However, your additional comments regarding your neighbour are just awful. I do get that it may be frustrating having your exit blocked, but your neighbour was dying. Why should they have had to go into a home? They may have wanted to stay in the home they knew and loved for their last few weeks, and if having carers attending regularly facilitated this, that's surely far better for them. I'm astounded by your lack of compassion.

We have ambulances and coroners cars. And loud holiday guests.. We also have to move out. Op seriously have you got a current gas safety certificate? If you haven't got one report your ll. Standard 6k fine and possible jail time. Or negotiate help to move costs. We have been offered a canny sum as no gas safety certificate here..

You legally don't have to allow access for viewings at all but tbh the mention of your deceased neighbour makes me wonder if you have been as good a tenant as you claim so might be worth compromising. Presumably you have two months' notice yet to come so not necessarily moving over the May bank holidays, and they may even be flexible if so.

Also. Why would YOUR landlord give you compensation for disruption caused by a neighbour that he has no control over? It's hardly his fault that your neighbour was terminally ill, and I am sure as shooting your neighbour would rather they hadn't been terminally ill.

Plus, the man died in January, according to you and it's the end of March. Catch yourself on.

I felt bad for you until you started going on about your neighbour! How is that anything to do with your landlord? He can't be held to account for any of that situation.

Yes it's annoying that you were blocked in, but that's for you to deal with as an adult, with the carers, the family or if they were blocking your car on the drive, the police.

Ambulances/one random knock in the night are by the by of living near other people and not in a detached with no neighbours for a considerable distance.

How is any of this your landlords fault?
If you owned the house would you expect the bank to let you have a reduction in mortgage payments because of the disruption to your peace? Think about it…

I was actually feeling quite sympathetic and irate
on your behalf until you got to the bit about the terminally ill neighbour. You actually think your landlord should compensate you because your neighbour was terminally and you were a bit put out by it??? I’m sure your dead neighbour and their family were a bit more put out by it! I think you should move out asap, away from your neighbours, they don’t need to be associating with people like you!

Presumably your contract says you can be served notice, and the appropriate notice has been given. The landlord is entitled to sell if he wants. Your holiday is not his concern.

Why are you assuming her landlord hasn't provided one? Just because yours hasn't?

I'm pretty sure given this person wants compensation for a neighbour having the temerity to die, she'll be well up on her rights.

I have obviously not complained about the terminally I’ll neighbour however all I did say a while ago was that the careers were blocking access to the front door and garage which meant I could not get in the property and I could get my car out of the garage to go to work. I do not believe this is unreasonable. I have to get to work like everybody else and if I can’t get out and it stops me from working then it is an issue. I’ve been kept waiting for in excess of an hour for careers to move and there was ample parking elsewhere in the road. They also started parking in my garage on occasions. You would not find this acceptable if you came to go to work and could not get out !

None of that is the fault of your landlord! What did you expect him to do that you couldn't do yourself?

As for reporting the EA for misleading marketing, are you joking?! Presumably the landlord told them the same thing they told you.

What the neighbours do is nothing to do with your contract with your LL so forget about all that.

How much notice have you been given, is it in line with the laws in whatever country you are in?

You found somewhere to go, just move and hope all your neighbours are perfect.

This doesn't make a huge amount of sense.
OP, what tenancy agreement did you sign and what was the term? The most common is an Assured Shorthold Tenancy with 1 year fixed term. If that's what you signed, your landlord can't evict you until the fixed term is over. You say you've been there 7 months? Even if it was only a 6 month fixed term, they still need to follow the correct procedure to evict you, starting with issuing a valid Section 21 notice which will expire in 2 months. You can still stay after it expires and then your landlord would need to apply to court for a possession order. So there's no need to panic.

Look on the shelter website, there's loads of information about eviction there.

Poor you, OP. It really was inconsiderate of your neighbour not to die at a more civilised time of the day. Some people are so selfish.

Carers should try to park considerately like everyone else, but are you seriously complaining about "Ambulances coming in the middle of the night"? Do you think they should have hung on and waited for a few hours til you were up and about before dialing 999?

Seriously, is this a reverse or a piss take? I hope it is actually because I don't want to believe anyone could be this lacking in compassion.

Also you can't do no fault evictions.

Renters know this.

Landlords are trespassing if they gain entry. Everyone knows that.

Just a side note but no fault evictions absolutely do exist in England at least. That's literally what a section 21 is.

There is work in progress to stop them but it's nowhere near being made law yet, unfortunately.
