Dear MN’s, I need your help please.

Scenario- you arranged to collect someone from London meaning you knew in advance that you had to enter the congestion charge zone. This was pre-planned and so they asked for your car details so they could sort the congestion charge in advance and said it had been done by adding it to their congestion charge account ( no reason to doubt as they already have two cars set up). Fast forward and a fine for non payment of the congestion charge arrives because although the car has been added to the account it had not been added to autopay meaning it did not automatically get paid. You tell the person about the fine and they offer to go halves with you.

so this is the question and what I would like some help with please.

I am NOT being unreasonable to expect the person to to pay the whole fine as I believed the charge had been covered as promised

I am being unreasonable and it’s totally ok to go halves on the fine

You were doing them a favour. You shouldn't be financially penalised for their failure to properly set-up the autopay.

My thoughts entirely unfortunately, they don’t see it that way as they believe they have done nothing wrong and the website should just autopay once the car has been added to the account

Either they forgot to add you, in which case they should pay in full, or they should challenge the PCN due to the autopay failure.

They say they didn’t add my car to autopay when they added it to their account as a message says, you don’t need to add the car to autopay if you’re sure you don’t need to pay any charges, hence they didn’t add it. Fine had been challenged on the basis the car was added to the account (but not autopay) which has been rejected.

That makes no sense whatsoever though as they knew that there would be charges to pay on the prearranged day you were driving them.

I don't have autopay anymore so can't check but basically you log into your autopay account, click on add another vehicle and it looks up the details and asks you if they are correct. You click on continue and it adds the car. I can't recall anywhere you could add a new car to your account without adding it to autopay, and why would you even do that anyway? They should definitely pay this fine, although I fear you have no hope of getting more than half out of them.

They absolutely should pay it but in this situation I would probably pay half and never do that person a favour ever again.

They should pay the whole thing, the tight bugger. They should also be mortified that you’ve had the inconvenience of having to deal with this. Never do them a favour again.

So due to their incompetence, they want you to pay £45 for the privilege of doing them a favour and collecting them from central London? No.

They pay the fine because they took responsibility for the charge.

If they hadn't you could have set it up yourself properly and asked them tk just transfer the money. As soon as they took responsibility directly ANY payment or fine for non payment is theirs (morally).

The lesson learned is to never rely on others which is too late now but you won't ever do the same again.

I’d pay the half and ask for the receipt so you know the debt has been cleared, but pull back a bit from the friendship and certainly never do any favours again.

Next time they ask for a favour just calmly explain that last time you helped them out they let you down making sure the charge was paid for your car and you didn’t appreciate having to pay half of their fine for them.

my priority though would be making sure that fine was resolved though

Pay the fine then ghost them once you've received their half, you don't need people like that in your life. As the old saying goes, fuck me over once, shame on you, fuck me over twice, shame on me - so get out now.

I'm with others. They should pay but you know they won't so pay half, make sure you get proof of payment and then sack them off. I'd have no problem telling them why either.

I think they are being a CF TBH. You are doing them a favour ,maybe say to pay half but dont offer any favours like that again!

I paid the fine last week. She sent me half and then obviously thought about what I’d said about moral obligations and said she would send an additional £45 last Friday. Guess what?? Yup, it didn’t arrive. I feel so disappointed and can’t believe what I thought was a good friend would behave like this
