Pedestrian vs car

Car is stationary waiting for traffic to move. Pedestrian walks in front of car, car moves forward, the pedestrian has to bang on the bonnet of the car to get the car to stop, at this point the car has hit (but not dramatically) the pedestrian, the car bonnet is now against pedestrians leg. Car drives off, no word from the driver. Who was in the wrong?

If the car has briefly stopped along the road then the pedestrian should not have walked out.

So if a car is stationary a pedestrian should not cross but just hang around waiting to see what the driver is doing? 😂 There are plenty of places which aren't pelican/zebra crossings but have a dropped kerb for pedestrians to cross. Obviously you don't cross while cars are moving close but you do cross when cars are stationary because if you waited till the road was clear you'd be waiting all day! Car drivers just need to pay attention and sometimes wait 2 seconds for someone to finish crossing in front of them!

Not a crossing but like a junction into a car park. Many people cross there

Probably pedestrian, but the car owner is a dick for not letting them cross and if they didn't notice they shouldn't be driving if they lack basic observation skills

If you've driven in to a pedestrian, you cannot possibly be in the right. Walking in front of a car makes you an utter twat, but that doesn't mean the driver has the right to run their car into you

I agree, especially as I'm assuming this was busy traffic. Car is in the wrong (unless there was a proper crossing for the pedestrian), but still seems like dick move from driver

Car driver is in the wrong but pedestrians should not use this fact to cross in dangerous places. Doesn't matter who is right and wrong if you are dead.

But the Highway Code still includes the Green Cross Code for pedestrians crossing the road. The first step is to find a safe place to cross. Between 2 queueing cars is not a safe place. They weren't stationary unless parked.

But how is it safer to cross where cars are moving at speed? Obviously junctions are places pedestrians need to cross and cars should be giving way to allow them to do so. They have dropped kerbs to allow pedestrians to cross. Not bothering to look if there is someone crossing the road before you pull off is hardly driving with pedestrians safety in mind!

Pedestrian- I know people do it all of the time but pedestrians really need to find a safe place to cross. If it was a zebra crossing or crossing it would be the cars fault.

although the driver really should have been alert and checked that nobody was there before moving off and really should have stopped - sounds like they were in a daze or something. Very weird.

I think in relation to the highway code the car driver is.

My understanding is that once a pedestrian is on the road they have right of way.

The car driver should also have definitely stopped as they hit someone - ok not badly but they still hit someone.

I'd generally check if a car is blocked by busy traffic, not just about to pull out into a gap, before I'd cross. Or I'd cross behind the first car making sure the driver of a second car has seen me. Car driver is still in the wrong though.

If the pedestrian was in front of the car before the car started moving, then the driver is clearly at fault. Don't drive into people!

If the pedestrian was not in front of the car before the car started moving, and both went into the same place at the same time, I'd say both at fault but the pedestrian wasn't clever expecting the driver to stop.

Regardless, it sounds like speeds were so low that this was pretty much a nothing incident anyway.

People will cross through stopped traffic. I've never found it difficult as a driver to not crash into people crossing.

I am trying to imagine a situation where someone was close enough to bang on the bonnet, but far enough away that the car could move forward and the pedestrian not end up under the car.

This, but with people now interpreting new rules as 'pedestrians can walk in front of moving traffic with impunity, and traffic has to stop mid manoeuvre', this will keep occurring.

Both. Pedestrian was fucking stupid, walking in front of a car without any confirmation that the driver had actually seen them and wasn't going to move. Driver was also fucking stupid not to look before moving off and should have been paying more attention to what was going on in front of them before they kill someone. Classic case of idiot meets idiot.

Presuming you're the pedestrian OP.
This is why I never do that without first making eye contact with the driver to ensure they've seen me. To walk out assuming they'll look is way too risky given how people seem to drive these days. Too many drivers texting etc while they're not moving (which is of course not ok).
As a driver I would've looked and not driven forward until you were safely on the pavement but as a pedestrian I wouldn't have stepped out without checking the driver knew what I was doing.

Of course you can walk in front of a stationary car, but if it's stationary because it's waiting to pull away then you're a bellend. Just cross behind it, or wait for it to go. "Stationary" and "parked" are not the same thing 🙄

Unclear which voting option is for which but the car is wrong. The car need to take extra care at all times as pedestrians are the vulnerable road user (even if they are annoying!!).
