Daughter accidentally scratch car on street!

SmellyNelliey · 03/09/2023 22:15

Hi all today my DD 7 accidentally scratch a car on the street while riding her bike.
Shes only been aloud to play out this week and now that privilege has been take.)

I've spoken to the Dad of the car owner. i've apologised for what my dd has done and they can get a quote for the damage as will I I'm willing to pay the cost.
He's now demanding 500 pound says his mate will get a new bumper and we will call it a day.
I'd also like to get my own quote but he doesn't want this.
The thing is this scratch is a very small light scratch on the bumper.
Am I being unreasonable to say we will go through insurance and pay what ever the quote rather then his friend? There is no way this car needs a new bumper.
I've spoken to online police chat who said they won't be getting involved and with being an accident and a child of 7 that we should come to some sort of agreement.( they have threatened to ring the police)

(DP is saying he's not paying nothing from a "friends" quote and we should go through correct channels if they want the scratch sorted but this is a whole other thread!)

I had a huge scratch/scuff (size of a melon) done at a garage for £150. It’s so advanced now, you only need a new bumper of it’s dented & scratched badly.

Water or ogen? The melon 🍈

Northernsouloldies · 03/09/2023 23:45

If the car wash damage was more prominent and he'd done nothing to rectify it but is creating because of that small scratch he's one chancing fucker and if its the quote route its only for that small scratch and not any other previous damage. Personally I would tell him Tcut or just fuck off.

PlipPlopChoo · 03/09/2023 23:46

The police will not care. It is a civil matter.

Canisaysomething · 03/09/2023 23:51

Disengage with the neighbour, he sounds like a bully.

PyongyangKipperbang · 03/09/2023 23:55

Is there a reason why he might think he can take advantage of you? Seems a bit mad to go to £500 for a scratch that I couldnt see until you highlighted it, so I wonder if he thinks that he can bully you into paying that.

I think that you should definitely insist on the 3 quotes from companies of your choice (no WAY will that cost £500, a woman scraped the shit out of the rear wing on my 4x4 and it cost less than £300!) or that he claims through his insurance. Chances are, they wont do it through insurance as it will cost them waaaaay more than that in increased premiums even though it is no fault.

Fucking arsehole chancer can jog on.

Mostlyoblivious · 04/09/2023 00:07

I’d personally try the t cut in the morning if it’s in your shed already. He will have such a wonderful start to his week when he realises he can’t scam you out of £500.. cheeky bastard!

Quitelikeacatslife · 04/09/2023 00:11

My DH scratched our car all down the side driving too close to a hedge. It came out with polish , ask if he will let you or someone more experienced have a go? If still there then need professional. Do you have local garage you use and trust?

Not relevant is it? The op has taken full responsibility and is just enquiring about paying what it is worth.

It's pretty relevant tbf. A 7 year old can't be held legally liable for their actions and for liability to pass to the parent there'd need to be evidence of negligence. As the OP has confirmed they were supervising their daughter it would be very difficult to argue negligence imo.

Morally the right thing to do is to pay but, if the owner is going to be unreasonable they can go through their insurance and accept accidents happen.

Anxioys · 04/09/2023 00:21

Insurance. This guy is taking the piss out of you and the moment you call the insurance his premium will go up, assuming he has the bollicks to make the claim.

I hope you have all of his correspondence in writing and safe. If not, then get it.

He's greedy. And greedy people need to be gently corrected by making their demands cost them, not others.

I'd be telling him to swivel, and get himself to bodycare buy a Rimmel 60 second drying red nail polish and tell him to jog on. £500?! What a knob

That looks like a very light scratch?

If so would just need some t cut.

If it's too deep for that it definitely won't cost 500 ffs.

Where was he parked? Was he on the pavement? To be honest unless he was parked on a private driveway which your daughter was trespassing on I wouldn’t be paying anything, it was an accident and that’s why people have car insurance. A 7yo isn’t liable, it was kind of you to offer but he’s trying to massively overcharge you and if it was me that would remove any initial goodwill. Let him go through his insurance.

You obviously have no idea how liability works - if any party crashes into or damages a car parked up they’re automatically responsible.
Its a parked object, to hit it you must be negligent.

You’re liable as a parent of the 7yo, and titre teaching them to weasel out of things in life if you think they’re not.

Luckily for the car owner they can just sue you for the cost of the repair (they’ll have your address as they’ll see where the child goes home to, and can pay £3 for homeowner details from the land registry).

I’ve gone down a similar route in the past for damage by a minor, and the family soon paid up when a summons landed on their doormat 😅
