Disabled parking bay outside my house?

About a year ago Next door neighbours got a disabled bay which directly outside my house. This is fine as the husband needed it due to various health issues. However the couple had a big bust up about 3 months ago and he has been gone ever since. He won’t be coming back. Parking space is still there and it’s just annoying me because the wife is still using it and it’s like it’s “her space” she is not entitled as doesn’t have a blue badge.

if someone else parks there she moves her car in as soon as they are gone. It’s very rare that anyone else park in it. We live on a busy road with limited parking and it’s starting to really annoy me when I drive home and the space is empty. I feel I can’t park there as it is a disabled bay! WIBU to ring the council and tell them he is no longer living there?

Notify your local council and they can come and remove it. She can take her chances like everyone else!

Of course that’s not unreasonable. They will ask for evidence from him that he lives there and paint over the lines otherwise. Although they might not be very quick about it.

Does she still have the blue badge?

I wonder why she hasn’t been ticketed yet if she has no need for the space.

Residential Blue badge spaces aren't usually ticketed if used by non blue badge holder. They are for the use of any Blue Badge holder not just the resident that requested it.

I would notify the local council he no longer lives there and they should remove it or at least not repaint it.

We had one on our street that was no longer used by the blue badge holder but her son happily used it to visit her (no badge). Parking is at a premium on our road. So when they came to repaint my Daughters space they asked if that needed repainting. I swiftly said no!

Disabled bays are advisory not law
so anyone can park in them blue badge or not

most of us don’t as we understand the need of a disabled bay and don’t want to cause a disabled person more difficulty

report to the local council and they will come out and remove it
if you report it via your local counciller it will probably be quicker

I watched a documentary specifically on people abusing blue badges and you can't use one unless the person that holds the badge is with you

Apparently bays can be advisory or mandatory and you can be fined for parking in a mandatory one with no badge. No idea how you tell the difference

A friend of mine bought a house many years ago and told me with great pride it came with a dedicated parking space. It was the disabled spot that the previous owner had painted on the street!!

no matter how many times I said she could use it she claimed it was a perk of the house and she had paid extra to buy it!!!

check the rules with your local authroity, we have a disabled space painted outside our house for our use but when they put it in they send it was no legally binding and we don't have to display our blue badge. Some spaces nearer the station have poles with signs saying resident blue badge holder only and blue badge has to be displayed.

My understanding is that If there is a kerb notice it is mandatory, not advisory.

OP: contact the council and say you are are aware that your disabled neighbour has moved away and your road does not house, as far as you know, any blue badge holders. Meanwhile you are aware that non badge holders are using the space, and what can be done?

I would not park there if there is a kerb notice, you might get a ticket. Especially if your long term aim is to free up the space and they send Enforcement round!

My near neighbour’s disabled space is in front of my house because his has a tree next to the pavement which would make getting in and out awkward.

Avoiding lamp posts, drains etc might also be an issue.

White bays are advisory, yellow bays are enforceable.

@FFloralys2 I think they meant any person who holds a blue badge can park in any residential disabled bays- not just the disabled person for whom the bay was painted for.

As a wheelchair user I was so glad when I rented a house with a disabled parking spot outside (it had been painted for the previous occupier who had died). The first thing the next door neighbour did was tell me it wasn't legally enforceable, he was a policeman, he used the space all the time, it was very disappointing.

this enraged me! I would contact his police station and ask how his behaviour is consistent with the code of ethics.

This is simply not true! If you park in a disabled space anywhere you can & will be ticketed if you've no blue badge! I forgot my badge once and parked in disabled in town centre and was ticketed! Please don't dole out incorrect information
