To ask for a contribution to a parking fine?

I met a friend for drinks a fortnight ago who suggested a pub I was unfamiliar with. There was a car park behind. I received a £100 demand for parking where apparently shouldn't. Admittedly I didn't look at signs but as my friend lived nearby I took their word for it.

I picked up the friend from home and drove them back too. What do you think?

If I was the friend , I would pay half the fine. I’m inagining you were chatting away, she said it’s fine. You trusted her local knowledge and got stung. A 50/5” situation in my book.

Motorina · 21/05/2023 22:49

I think £100 fines are outlawed ie it's extortion - check case law - is there a smaller fee to pay instead?

They’re not, and the relevant case law (Parking Eye) has already been linked to.

Caelan2018 · 21/05/2023 22:59

So you expect your friend to pay a fine you got for parking in the wrong place are you for real 😧

pleasehelpwi3 · 21/05/2023 23:56

You copy Suella Braverman's example and ask your friends at the Home Office to intervene, if you have any

theGooHasGone · 22/05/2023 00:01

Very glad to hear your friend is a good person and offered to pay half. Also glad I'm not friends with all the self-righteous freeloaders posting in this thread who refuse to accept they could be in any way culpable!

Deathbyfluffy · 22/05/2023 00:06

You didn’t bother to read the signs - it’s on you.

Check if you should have logged in at the bar. If you have proof that you purchased drinks or food you may be able to appeal, or talk to the manager.

This

also is it not substantially less if paid within 10 days? Usually they say £40 if paid within 10 days and £100 thereafter!

Also if it’s a private car park is the fine even forcable?

ChocChipHandbag · 22/05/2023 00:38

Yea, private parking fines are enforceable @T1Dmama. Google Beavis v Parking Eye. UK Supreme Court.

T1Dmama · 22/05/2023 00:59

Any updates? What did the pub say? Is it a private car park/invoice? I’d go back and photograph car park signage and appeal of the signage isn’t at eye level.
This happened to us once; the sign was so high you had to look 0 meters up to see it! We came out and had been clamped (in the days when that was legal), if it happened now there’s no way I’d agree to pay.

What’s that the only case ever where a private company has taken someone to court?

ChocChipHandbag · 22/05/2023 01:18

It's a Supreme Court case. All other courts have to follow what it decided. Cases go to the Supreme Court so that the law can be clarified.

Before that case there were a number of differing opinions between judges as to whether private companies could legitimately enforce parking fines.

Judges can no longer declare all private parking fines unenforceable as a matter of principle.

However an individual case may be successfully defended if the parking company has made a mistake like not having a clear enough sign or not having good evidence of the over- stay.

So you don't read the full thread and misinterpret what I'm saying are you for real (?)

Completely fine for friend to offer. It’s what any friend would do.

But entitled and lack of personal responsibility to expect or demand, which is what OP was doing.

I havent seen anything by the OP to say she expected it - and she definitely didn't demand it ffs 🤦🏼‍♀️

Phew @Zenana . A normal nice person then. I thought this thread was, like many threads 😂, absolute batshit.

Yes! Mental!
If I had been driven to a pub which I suggested by a friend who had never been before, and (as OP has said) there were no obvious signs, no pay machine etc, if the friend got a ticket I'd absolutely offer to pay half. Some comments on here are bonkers 😬

pleasehelpwi3 · 22/05/2023 20:14

If you do go back to the pub and speak to them, don't get another ticket by making the same mistake as before!

Zenana · 25/05/2023 08:15

All sorted now. Thanks for all your help. The pub cancelled it.

Fantastic news.

It happened to my friend, and 2 of us were with him. We both offered to split it with him automatically. I'd be quite shocked by someone not doing so.

Amazing update

nosunshinewhenshesgone · 25/05/2023 17:03

I'm glad the pub cancelled it, but more importantly, I'm glad your friend offered to pay half unprompted. I would have found it difficult to stay friends with someone who hadn't offered even half. It's about the principle rather than the amount.

I'm not a driver, and if I'd been in this situation as the friend, I would have insisted on paying on the whole fine. I'd have expected you to decline, but I would have have then pushed it, and I would have paid.

If someone does you a favour, they shouldn't be more out of pocket than they had anticipated.

Zenana · 28/05/2023 11:11

Thanks everyone, I'm doubly observant now!
