Money taken from account...now in an awkward situation.

I've AIBU for traffic.

A couple of months ago, I purchased some fitness classes at my local gym. An invoice was sent to my email and I paid for the classes with my instructor. After the sessions, another invoice was sent over (the instructor had incorrectly billed me) but I paid the invoice anyway and notified her of the error, which she just said she would take off next time. There was absolutely no indication at any point that I had signed up to any type of subscription. It was simply an invoice with the amount for the sessions and then the option to pay for the classes using my bank card. There was no contract, and I didn't sign anything that reflected I had entered into any type of agreement.

Anyway, after two block of sessions with her, I notified her that I wouldn't be continuing as I felt confident to do my own thing. No invoice arrived - but a large chuck of money left my account. I've reached out to her to query this, and her response is that she needs 14 days notice and I must continue with this block of sessions. She didn't tell me I needed to give her notice, and she didn't tell me at any point that it was a subscription I was entering into. I don't have a clue how this has happened tbh. Why send me invoices, and then suddenly no invoice but an automatic withdrawal.

I feel awkward now as I needed that money for DD's birthday and now it's gone and will have to continue with classes that aren't even needed.

I first spoke to my bank a couple of days ago about it. They said as the payment is currently 'pending' (Visa is holding it ) they will write a note to Visa notifying them of the situation and asking them to release it back to me. This usually takes 3 business days.

The other option is, if she claims it and it gets funded back to her account, and she refuses to transfer it back to me then my bank can do a chargeback dispute. I'll also need a new card.

I then spoke to Stripe, who were useless. They just kept saying it's the merchant (instructor) that I'll need to speak to about it and nothing they can do from their end.

She is now saying that she needs 14 days notice if i want to discontinue classes, and basically we'll need to continue the block of sessions. I've sent her quite a direct email asking why payment was automatically taken (this was before I figured out what she'd done).

Waiting on her reply...

That’s disgraceful carry on. She used a different method AFTER you had cancelled. Did she think you wouldn’t notice?
I agree with everyone else, get it back, and if you feel scared then do it for the others that won’t stand up to her. The CHEEEEEEK of it!!!

Stripe is just the method the money moves accounts with.
It really is with her and your bank. Do a chargeback. Merchants get billed for those, so that will cost her. And if you signed no contract then she had no rights to say you owe anything

I voted Yabu only because you are just letting her steal from you then instead of sorting it out you're going to let her get away with it?
Grow a backbone!
Your dd should come before your fear of being challenging her.
Go and tell her you want the money refunded now before you take it further.

She's completely out of order; it's an unauthorized payment, ie, theft.

I'd complain to the gym if she doesn't refund you immediately.

She may have also been under the impression I wanted to continue as I totally forgot how many sessions we'd had, and so I told her I would see her the following week. I do hold my hands up here as I genuinely thought we had 2 sessions left, and that's when I was going to say to her that it would be our final week as I'm confident to carry on alone now. I had no idea she needed 14 days notice. She never said. No contract was ever signed.

The next day the money was gone.

But.. what kind of person just goes ahead and takes it automatically?

you really need to sort this as she's going to do it to the next person OP, who might not be able to fight it but need the cash. it's utterly unacceptable and unprofessional, not to mention potentially criminal.. she can't just make up terms and conditions, not communicate them or get your agreement in legal terms, then take the cash. it's bonkers.

Sounds like you did authorize it by booking the next week then.
This is totally different to how you made it sound

You still can’t take client’s money without a. Sending and invoice b. Asking for authorisation.

Stop asking her, stop being polite, stop negotiating.

Email her and tell her that you do not authorise the money transfer she's attempted to process.

Detail the dates of your sessions. The amount you agreed to pay per session. The date you told her you'd no longer be using her services.

Summarise the amount you owe for the sessions you've had, and the amount you've paid (not including this disputed payment).

Say you have no contract with her and will not be using her services again. Request that she removes your image and any testimonials you've provided from her marketing materials.

Factual, fair and final.

There is no contract unless she has made it absolutely clear you were entering into one. She is ridiculous, reputation is everything and she could easily lose her entire business over this.

Have you inadvertently set up a Direct Debit. If you have you can't just cancel it at 'your end' she has to do that.

She definitely won't keep charging your card if you do a chargeback. She knows you'd do another chargeback.

I'm going to send her an email now (polite but formal) and just ask her what's happened because I'm genuinely battled. Perhaps I have somehow signed up to a subscription with her. I can only ever recall paying two invoices using my bank card. That's it.

Tell her you are getting the police involved because you think someone has been siphoning money off your account.

Just contact the bank and put a stop on this. You have been conned. I had Three weeks of trying to sort out a similar situation. If you have a banking app just stop all DDs.Its a bwll ache but percevere

She can dispute the chargeback and provide evidence. The bank decides who is in the right.

It takes a long time to get the money back if she disputes the chargeback claim, which she probably will, because she's given time to submit evidence and then the bank is given time to decide on the outcome.

She's also got a case for winning if she can show she's provided the services paid for to the OP.

Def do a charge back. You have no contract so no payment can be expected. What a CF.
