To be worried…speeding

Dibble135 · 05/03/2023 21:04

Received letter today for last weekend. 73 in a 50. I thought I was still on motorway but it seems the relevant bit was a dual carriageway. It was early morning and quiet so did not have other cars to compare to.

No cameras either. Caught by a mobile van but didn’t see it.

Sent my details off but feel awfully guilty and worried for what happens next.

So come on vipers. Give me both barrels. I deserve it.

@RoseBucket the tables I was showing are still correct despite age. For speeding only at the speeds on the table, that's the penalty. And that's a fact. There has to be something more for anything else to happen.

You wouldn't be prosecuted at 35 in a 30. I didn't say you would be and I didn't read the full articles but I'm sure they didn't. Even the police state their limits for an NIP are 10% on the speed vans.

@SofiaSoFar states the same correct information that I have. OP will have a £100 fine and 3 penalty points. Nothing further. 76 would be another story.

Judges are far too lenient in my opinion, perhaps they will be with you if you have never had previous convictions.

EnthENd · 06/03/2023 20:14

If you get a fixed penalty notice, if it was me I'd accept the points.

If you get a court summons, or want to dispute the FPN and go to court anyway, get a motoring lawyer. Problems with the signage or technical mistakes by the police could get you off the hook. If you've got no such excuse and you plead guilty, you still want a lawyer to give the best mitigation and answer any claimed aggravating factors.

Anyway, right now not much you can do except wait, and be more careful about your driving in future.

Dual carriage ways are 70mph limit. That's what I was told in my very recent speed awareness course. Can you go back to the road and take a photo showing it's a dual carriage way with a clear central reservation?

Well, I think you were told incorrectly!
I have been driving to and around Cardiff this weekend, on a lot of dual carriageways which varied between 70mph, 50mph 40mph and even 30mph!
You can never assume that just because it is a dual carriageway that it will be 70mph and really need to have your wits about you as there are lots of cameras/average speed cameras too.

Judges do not deal with speeding- Magistrates do.

Dibble135 · 16/03/2023 11:11

The police have now responded with offer of fixed penalty so £100 fine and 3 points which I will accept immediately!

Thanks for updating the thread @Dibble135

Exactly as expected then! 😉

BlueSpark · 16/03/2023 19:43

Well that is shocking and unexpected! 😂

Glad it's over for you now.

Did you fall asleep during the next bit where they talk about how you see the default speed limit is modified by signage?

Could appriciate some advice as cant find anything on google about this , I'm feeling so bad and angry with myself I was on the m5 and it was one of those 50 variable speed bits and I thought it ended and I got caught doing 66 I recived a NIP through the post but I'm so worried that I will loose my lisense over this now, as I'm still in my first year of passing my test I don't have any other points on my lisense but I'm so worried I will loose my lisense now, will I loose my lisense and will I jave to go to court over this?

MrsSkylerWhite · 06/12/2023 11:15

If you e a clean licence, don’t worry. Fixed penalty or £100 I believe.

It’s just outside the threshold for a course but well within that of a fixed penalty. It’ll just be 3 points and £100 fine. Be careful though, if you get caught again in your first two years you’ll be back to a provisional and have to re-take your test.

ChippyTeaYesPlease · 05/03/2023 21:09

I believe that's band b which would be a fine and 4-6 points or disqualified 7-28 days. It can't have been a daul carriageway as they normally have a higher speed limit. Have you been caught speeding before?

Plenty of dual carriageways have 50 limits.

DesdamonasHandkerchief · 06/12/2023 12:26

You'll get 3 points and a fine (£100 I think) you probably won't be offered a speed awareness course as 23 miles over the speed limit is outside the tolerance level. However if you haven't done a SA course in the last 3 years you would be offered one if you are caught speeding again within the tolerance levels: This is usually between the ‘speed limit + 10% + 2mph’ and the ‘speed limit + 10% + 9mph’ (for example, 35-42mph in a 30mph zone).

No censure from me as I've been in the same position, going past a camera on a dual carriageway at 60mph when it transpired the speed limit was reduced to 50 on that stretch.

DesdamonasHandkerchief · 06/12/2023 12:29

Oh sorry just seen your update! At least you can stop panicking now.

Millhaz88 · 06/12/2023 12:47

Okay thankyou will be waiting nervously for the letter back to see what the outcome will be , I will most definitely be driving more careful and checking all speed signs etc

Millhaz88 · 06/12/2023 12:47

I won't have to go to court will i?

Have you read the rest of the thread?
The OP was caught at a higher speed than you, and got 3 points and a £100 fine. No court etc.

You'll be fine.

Millhaz88 · 06/12/2023 12:53

Oh okay thankyou I suffer with a worry disorder so I just want this dealt with sent the reply off just now next day delivery so hopefully end of next week will have something in the post

Peacheroo · 06/12/2023 19:58

@Millhaz88 it's six points isn't it in the first two years that could mean you lose your licence? You will get 3 points and £100 fine. Make sure you tell your insurance. You just have to be really careful for the next year or so until you can get twelve 😜

6/12 points doesn't automatically mean you lose your licence - you can argue you need it for work. Fleet news did an article a few years back of some delivery drivers having 20/30/40 points

Millhaz88 · 06/12/2023 20:53

Peacheroo I will wait for the reply and then what the outcome is will tell my insurence let's hope I can still drive aye 🙏

Peacheroo · 06/12/2023 22:08

I did 65 or 66 in a 40 and got three points. You'll be fine.

Peacheroo · 06/12/2023 22:09

Peacheroo · 06/12/2023 22:10

I did 65 and at 66 I would have gone to court.
