To think I could get the sack?

I do a job in a licensed field and I have not been fully granted permissions. It's a role I moved into with my employer from a different role in the company which I was authorised to do.

Now I may lose my license (due to failing some tests) in which case I'd want to go back to my old role but I'm worried it's no longer available as they've just recruited.

In which case would they have to put me back into the old department? I didn't sign a contract in the new one and I'm still under the old contract.

I'm also now off sick, which I'm worried will add to things. Does anyone know is it possible I could lose my job?

I think it's going to be impossible for people to answer. Could you ask for a meeting with your manager and HR just so you know exactly where you stand?

Depends what sort of tests.

If it’s an assessment they may ask you to retake the test and make it a condition if your employment that you pass within a certain time frame.

If you failed a drug test you might lose your job.

Yeah a lot more context is needed. What field? What tests? How long have you been in the new role? What's the requirements to get these 'permissions'?

Nothing in the contract about it. Don't want to say what tests it's outing but these are mandatory government body tests that mean you cannot do this particular job without the test. There will be an opportunity to retake it but not for another 6 months.

I never signed a contract for the new role

They hired you without the qualifications though? So you might get lucky and they let you resit.

So you have been switched to a role you are not really qualified to do then , having failed the tests

I don’t see how it’s outing given you’ve name changed? You can’t be the only person who has failed - if you give more detail people might be able to help

No it's a role you can do under supervision - I've been doing it under supervision

Why does the role matter? It's a regulatory test someone can't trade without it (not alone) they didn't hire me unqualified I simply moved departments but to be 'signed off' you have to pass certain tests and I haven't

It's not up to the company I work for the resit, and I have to wait six months to do that in which case I can't do the job I was transferred to do and my old department has just filled my vacancy

So you can't do the job then if you failed the tests

It won't help being off sick.

It will come down how easy it is to replace you and the plan you will show for ensuring you pass the resit.

I'm not sure about the old contract..I think an HR Pro could answer that without more detail. But you must have had some communications re new role? Might be helpful to review them.

I've had promotions but never signed a new contract.

Yes I am not allowed to do the job without getting the sign off - but isn't there an obligation to put me back into the old job?

Can't you continue in the role for 6 months until the resits? Do you think you will pass them next time?

I think it depends on what basis you took the new role. If you were seconded from your previous role then perhaps.

Is it possible for you to continue to be supervised for the next 6 months until you can retake the test again?

In cases like yours, the person who backfilled the role would tend to be moved out and you would tend to be moved back into your original role.

Did you know this when you sat the tests ?

You really need to ask your employer not a bunch of randoms on an internet forum

I'm guessing it's something like accounting, where you have passed parts of your qualification but not all?
If your company knowlingly put you into the position without you being qualified, and then sacked you for not being qualified its them who are at fault. You could perhaps argue constructive dismissal if they sack you? I agree with those who say you aren't helping yourself by being off sick.

@Wonnle I didn't know this when I sat them. It is a legal question guess I'm asking - I don't want to ask my employer as not really appropriate is it
