Retailer pricing error

Spoonfulofgin · 26/12/2022 16:33

Saw an item online from a well known retailer... bought it... they called me today to tell me that they had made an error with the price and I can either pay the difference or they can give me a full refund. Anybody know what my rights are please?

Thank you

You don't have any rights. They are entitled to cancel the order just as you are.

Lostinalibrary · 26/12/2022 16:35

Yes, you have none. They can cancel an order where there is an error with pricing.

mintbiscuit · 26/12/2022 16:35

Think they can refuse to sell to you if they haven’t delivered.

PurpleButterflyWings · 26/12/2022 16:35

I doubt you have to pay the extra. Tell them you will see them in court.

PurpleButterflyWings · 26/12/2022 16:36

Oh wait @Spoonfulofgin have you received the item yet?

Ffs🙄

WrongLife · 26/12/2022 16:36

If they haven't despatched it, they can cancel. I don't think you have any rights in this situation

FOJN · 26/12/2022 16:36

Has it been dispatched/delivered yet?

DumpedByText · 26/12/2022 16:36

You have no rights, Google 'invitation to treat' that will explain it to you. It's a genuine error so they don't have to sell it to you at that price.

luxxlisbon · 26/12/2022 16:36

You don’t have a right to buy an item which was priced incorrectly. Some people seem to think they have to sell it to you at the low incorrect price but they don’t.

If they haven't shipped the item yet, they can cancel the order. If they have shipped it, I don't see how they can force you to pay the difference. They willingly sold it to you at the advertised price.

Shopping online

Your legal rights depend on something fairly tricky in the law: whether or not you have a ‘contract’.

Depending on the company’s terms and conditions, you’ll have legal rights (and a contract) either:

once you’ve paid for the item
once they’ve sent it to you
You’ll need to find the company’s terms and conditions to find out where you stand. Contact the Citizens Advice consumer helpline if you need help. It may be too tricky to work out yourself.

If you have a contract, the company can’t usually cancel your order, even if they realise they’ve sold you something at the wrong price. They’ll only be able to cancel it if it was a genuine and honest mistake on their part that you should’ve noticed.

If you don’t have a contract and someone realises they’ve told you the wrong price, they can cancel your order.

LubaLuca · 26/12/2022 16:38

You have the right to choose from one of the options they've given you. It is a very big difference in price?

PurpleButterflyWings · 26/12/2022 16:38

FOJN · 26/12/2022 16:36

Has it been dispatched/delivered yet?

Also waiting for OP to confirm this. I assumed from her OP that she already had it. If she HAS then of course she doesn't have to pay the difference. If they have not yet sent it, then they can cancel the sale. Context is everyting.

Blimey it's the season of goodwill everyone

It’s not an invitation to treat.

I'm not the one posting sarcastic rolly eyes emojis at someone's post. So if that's aimed at me YOU can have a Hmm too.

Spoonfulofgin · 26/12/2022 16:42

Thanks all for your replies so far!

I only bought it yesterday in the sale, paid online, got a confirmation email, not yet delivered, called me today (Boxing day which is strange) to say pricing error so I can either pay the extra £700 or cancel...

I was incredibly lucky with something similar a few years ago.
I'd seen a gorgeous big rug online which was just perfect for my living room.
It was about £50 which was a really good price anyway, but l had an e-coupon for 10% off, so l ordered it.
After the payment went through, l noticed that the 10% hadn't come off so l emailed them, thinking, shy bairns get nowt....
I got a lovely email back from them, saying that the price on the site was actually wrong, it was for a much smaller version (my rug is 5' x 7') and that the cost for mine should actually have been £129. But they were happy to honour the price l'd paid (!) but unfortunately they couldn't give me the additional 10% off.
I was thrilled to ribbons. And l still have the rug.

Yeah, you have no rights. They can cancel. It is also a significant pricing error, you have no rights to force the sale.

I don’t think there’s much you can do as they haven’t dispatched and they’re offering to refund. They made an error and they’ve given you options with how to proceed, sorry OP.

No OP, do not listen to this plainly wrong advice.

Unless it’s been dispatched already, they don’t need to honour the price, especially when it’s an obvious error.

Beercrispsandnuts · 26/12/2022 16:49

This is quite common, they don’t need to honour it if it was an error. Plenty of examples and legal cases. The retailer is allowed to recognise an error and say no

Spoonfulofgin · 26/12/2022 16:50

Just want to highlight the £700 is relative... it was a high value item and it's not an obvious error if that makes a difference.
