Who should pay for this damage? Me or company?

A road closure was put up and my vehicle was parked within it, work was being carried out close to me but away from my car. There was also right next to my passenger side 2 cones and a metal post sticking out of the ground, the 2x cones where there i guess to alert for the post but when i got in my car i didnt see them. The cones were 45cm high to be exact. I hit a cone and the temporary metal post sticking out of the ground. Scraping my vehicle. It was 30mph road and very small cones so i didn't see them next to my car when i got in. Is this my fault or should the company who put the cones and post out pay for this? As they should have maybe left a note one my car?

Why is the speed limit on the road relevant? You weren't driving at 30 mph, were you? I imagine the cones were the warning.

They don’t have time to leave notes on everyone’s car, it’s your job as the driver to make sure it’s safe to pull away

Wasn't there signs up on posts for days/weeks beforehand saying that road works would be going ahead on X day/s and that the parking bay would be shut? If that was the case- then you shouldn't have been parked there.

Different if it was emergency works being done on the day, but equally, you are supposed to look around your car before driving off- esp with road works going on around you.

Yeah, not sure how it's the company's fault that you didn't see the cones.

They are bright orange!! I can’t imagine a cone being too small to see.
It is obviously your fault you didn’t notice cones pointing your attention to a hazard and then you drove into it.

Also ‘maybe they should have left a note on my car’ 😂 if you miss the big bright cones I think it’s safe to say you would have missed a little note too.

Regarding the cones.
How big were they ?
Did they have flakes in them?
If so it sounds like your fault - 99%.

As the driver you are responsible for checking all round your vehicle before moving off to make sure it's safe. Not seeing the cones or post is not a excuse and the company has put all reasonable warnings out which you haven't seen.

45cm isn't a small cone to miss. It's obviously annoying you have damage you will need to repair but it's not the company's fault

I really don’t think it’s very good that you hit 2 cones because you didn’t see them. What if that had been 2 small children sitting on the curb or something. Or even a cat. It’s your responsibility to ensure it’s safe to manoeuvre, and that includes making sure there are no blind spots you’ve missed.
