Who should pay for this damage? Me or company?

A road closure was put up and my vehicle was parked within it, work was being carried out close to me but away from my car. There was also right next to my passenger side 2 cones and a metal post sticking out of the ground, the 2x cones where there i guess to alert for the post but when i got in my car i didnt see them. The cones were 45cm high to be exact. I hit a cone and the temporary metal post sticking out of the ground. Scraping my vehicle. It was 30mph road and very small cones so i didn't see them next to my car when i got in. Is this my fault or should the company who put the cones and post out pay for this? As they should have maybe left a note one my car?

I feel for you a bit here OP, if they weren’t there when you arrived and were on the passenger side, I can see why you didn’t see them getting back in later on the driver side. At that sort of height they might not have been visible in your mirrors.

Why we’re they working so close to your car ? Were there signs up saying the road was going to be closed for repairs - normally there are ?

i appreciate your annoyance but think you will have a hard time claiming against them.

This is your fault. If you'd hit a child would you argue that they should have put a note on your windscreen?

Wine4whine · 23/11/2022 21:29

Did you hit a trolley in the supermarket car park the other day and blame the supermarket by any chance!

WeeOrcadian · 23/11/2022 21:47

I assume the cones jumped out in front of your car?....... No?

Jeez. YABU. Your fault.

Bumply · 23/11/2022 21:56

I feel for you.
I had something similar when they were digging up my road so I moved my car to a side street out of view.
It was during lockdown when I wasn't using the car very often and when I next used it I found they'd moved the cable laying to that street and I was almost blocked in by machinery etc.
I was able to move the car, but closing the door caused the side windscreen to completely shatter. I presume something had knocked it and left it with a weak point.
I just accepted it was bad luck and I should have checked where the road works were happening. Paid for the window replacement myself

If you were driving within a road closure your insurance might not have been valid

onepieceoflollipop · 24/11/2022 00:15

Yep your fault I’m afraid.
I did similar in a conference centre car park, sadly I got the cone wedged under my car which was somewhat embarrassing.
best just to admit you made an unfortunate error and do something to cheer yourself up.
I recommend a large bar of galaxy!

How did you type this with a straight face?

mashh · 24/11/2022 02:02

Why were you trying to drive your car as normal when the road was closed tho? I would have expected mishaps and been on high alert if I tried

Wingedharpy · 24/11/2022 02:14

Should've gone to Specsavers.
