AIBU to say he should give me his scratchcard winnings?

This is a lighthearted tounge-in-check debate and DP and I are just messing around with each other

Yesterday, DP filled up my car with fuel and I gave him my card to pay for it.

When he got home from work, he told me that he won £10 on a scratchcard, he then told me he bought the scratchcard with my card at the garage when he paid for my fuel.

We went to the supermarket to cash the scratchcard in - he’s saying the winnings are his, but I think it’s mine as he bought it on my card without my knowledge.

Who do the winnings belong to?

YABU - winnings are his
YANBU - winnings are mine

Are things really bad at the moment where you’re squabbling over a tenner?

Butchyrestingface · 19/11/2022 11:06

Do you have separate finances?

If so, I think it's obvious the filthy lucre is all yours. Are you planning to wait until Monday to hand in your resignation at work?

Workyticket · 19/11/2022 11:06

Yours in my opinion

We'd share though - so a bottle of prosecco or wine to share / crackers and cheese / a big box of chocolates maybe?

BlackberryCat · 19/11/2022 11:06

YABU but he should give you the cost of the ticket.

Are things really bad at the moment where you can't read a single paragraph in bold font at the very top of the OP?

😂

Tiani4 · 19/11/2022 11:09

It's yours as he used your card your money to purchase ticket

At the very least it would be shared fifty fifty with his paying you back half the cost of ticket so for two pounds of scratch cards he gets four pounds from ten pounds winning

Really he's lucky he get anything given he used your card for scratch cards without asking first

MollieMarie · 19/11/2022 11:09

Your card and your money so winnings are yours 😝

(also are people missing the 'lighthearted' disclaimer in the original post?) 🙄

JesusInTheCabbageVan · 19/11/2022 11:10

Anyway the solution is for him to refund you the price of the scratch card. You then go and buy your own scratch card. Hopefully you'll win the jackpot. Even if you don't, tell him you have and that it's all yours.

SleepyTimeTea · 19/11/2022 11:10

Well if you share finances, you get half.

If you don't share finances he owes the pound he stole and then you get the winnings.

So he owes you £11.

Literally at the beginning in bold that they're messing around.

GertrudePerkinsPaperyThing · 19/11/2022 11:11

Yours!

But also why can’t people read the word “lighthearted”, and your disclaimer in bold?

ChardonnaysBeastlyCat · 19/11/2022 11:11

You have to split the winnings.

You have provided the financing of the joint scratch card enterprise, but he did all the admin and provided his expertise.

Only fair to split.

mondaytosunday · 19/11/2022 11:11

Share. He bought it, but with your money. Plus you are partners so should share it even if he paid with his own card. Sadly, can't even treat yourselves to a coffee and a cake each with £10 these days.

Santagiveyoursackawash · 19/11/2022 11:12

2 decades ago after my df was made redundant he claimed JSA with his dw added to his claim. She filled in a well known number based form and won big money. Took 2 years before she would agree df could share HER winnings...
Ultimately lost df his dc and dgc...

CareBear50 · 19/11/2022 11:13

LTB 😆

Hawkins001 · 19/11/2022 11:13

I think legally it's the card owners winnings, morally a split of 50/50 as yes it's your card, but as your dh brought the ticket, then without the ticket, there would be no winnings.

OnlyFannys · 19/11/2022 11:14

He should treat you both to a McDonald's with the winnings

PigglePuggle · 19/11/2022 11:14

The CF has just informed me the scratchcard was £5!! He went bold because he knew it wasn’t his money - I now feel this is reasonable grounds to LTB!?

50/50. Your card bought the ticket, but his decision to buy a ticket.

burnoutbabe · 19/11/2022 11:16

But would he have mentioned it or paid for it if he lost?

I'd be a bit annoyed about it unless you see it as "payment" for him doing you a favour

Shodan · 19/11/2022 11:16

Hmm.

I assume he thinks that because he was the person who paid (as in physically handed over the means of payment) that the winnings are his. However, that would also imply that he believes that the fuel in the car is his.

BUT- the funds that bought both fuel and scratchcard were yours.

So - either both fuel AND scratchcard (and consequently winnings) are yours OR his.

I'm going to make a further assumption that he isn't claiming ownership of the fuel. Therefore the scratchcard (and its winnings) are yours also.

Of course, it does possibly lead to complicated questions over gifts, meals out etc...

On balance, I think it's clear that both fuel and winnings are yours and he hasn't a leg to stand on.

But to be magnanimous - buy a bottle of wine and some chocolates or cake to be shared by both.

SleepyTimeTea · 19/11/2022 11:17

Send him this and tell him you need the ten pounds as hush money.

gogohmm · 19/11/2022 11:18

Yours but the solution is simple - he treats you to dinner today, costing more than his winnings!

BMW6 · 19/11/2022 11:14

50/50. Your card bought the ticket, but his decision to buy a ticket.

50/50 of the profit surely? She's already down £5! She'd only break even with 50/50
