Speeding under 77 in a 70 is still liable to a fine, yes?!

Please settle argument with friend.

He reckons if you do a little over 70 on the motorway you don't get fined - he reckons you get a bit of leeway and only get fined if you're doing more than 10% over.

So 22 in a 20 zone, no fine. 33 in a 30, ok.

YANBU, he's wrong. You can get fined for doing anything over the speed limit

YABU - he's right. A little over never results in a fine.

I often do 80 on a motorway and am certainly not the fastest driver on the road!

I haven't been fined in 30 years of driving. But I do slow down if I see a camera.

It depends how you measure "over 70". If I set my cruise control at 74 I will by doing 69/70 according to GPS, so I'm not actually breaking the limit..

But, if they feel like it they may do. They fined my friend for doing 36 in a 30 zone. We don’t know why. She had to do a 2 day speed awareness course to avoid points on licence. 😐

An automated camera will fine you for being even 1mph over. A human being would probably allow a 10% margin.

Because 36 is 20% over the limit and the difference in survival chances for a pedestrian hit at 30 vs 40 is quite significant I believe. 36 in a 30 zone is more dangerous than 76 in a 70 (or even 86 in a 70 probably!)

i got pulled over for doing 72 on motorway and proper told off. Plus they wanted to know all about how I got my car - was PT Cruiser so a little unusual- they didn’t believe it was mine. Don’t know if they were bored or near end of shift. They ignored other car that sped past me doing at least 80 and when I pointed that out he got very shirty and said I was incredibly lucky they weren’t calling it in!! 😳

A lot of 50 zones tend to have average speed cameras, and I'm not sure if those give you the 10% leeway?

In Bristol, apparently (according to people who've done speed awareness courses) you generally get 10% over, but not in the numerous 20mph zones. So you can technically get fined/points for 21mph.

You can be, and for some reasons are, fined for 1 mile an hour over the limit. My husband picked up points on an average speed check during motorway roadworks at 52 in a 50.

For static cameras though the area I'm in is 10% plus 2 but each force can make up their own rules so yes anything over speed limit is potentially going to get you points.

It depends on the police force, so I’ve heard. Teeside police always used to leave no leeway. No idea if that’s still the case though.

Your friend is right. Guidance and general practice is that 77 or under is not followed up on in a national speed level, and so on.

Any excess speed at all is illegal, and could be prosecuted, but in general it won’t be.

Speedos are not allowed to over-read. You can be doing 77 on your speedo but only be doing 70mph but it is illegal for your speedo to show 70 and you be doing 77mph.

No, the other way around, they may not under-read.

Same, one had done 32 in a 30, one had done 21 in a 20 mph.

It’s definitely illegal, but doing 71mph up an empty M11 at 10pm in mid-July being “disgusting”? Don’t be so ridiculous.

Yes, the speed awareness leader on my course also told us that the 10% rule is followed to an extent but there are definitely cameras that are set up so if you go even 1mph over, you will get caught. I was doing 53 in a 50 so the 10% isn't always the case.

I had to do a speed awareness course for driving at 22 mph. (London). Used up a days leave too!

Everyone on the course had been fined in the same London borough.

Not true (in my area!) went on the speed course and they said the 10% thing is not true as 20 - 22mph is a big difference if you hit someone.
I got a ticket at 33 and the course at 34mph in a 30.
you can only go on a speed awareness course if you are within a certain amount of the limit - so not dangerous driving

"Can be" and "will be" are different though.

You can be fined for going 1mph over - doesn't mean you will be.

As a PP has said, you will look like a right muppet if you try to argue you were only doing 76 so therefore it's ok. If you're doing 76 then you're risking a fine, it may be unlikely but it's certainly possible.

Where are people getting the +1mph from?

It's +/- 2mph, so 10% +/-2mph.

So at 70mph, the tolerance could be 75 OR 79mph and dependent on the rules for the particular county.

Although a PP is correct that they can decide on zero tolerance if they feel like it.

10% isn’t a rule and I’ve had a friend get fined for 52 in a 50. However I think it’s extremely unlikely in general to get a fine under 10%
