Should this ring be covered under the jewellers guarantee?

Partner bought an engagement ring on Boxing Day, promised New Year's Eve. I noticed after a month or so the stone was lose, stopped wearing it and returned for a new one in March. They agreed it was a manufacturing fault.
Today I noticed the stone was loose again, but not as loose as before so I kept it on and I was going to take it off when I got home. Earlier I noticed the stone was missing, hunted high and low in my office and eventually after an hour I found it, phew. Would this still be considered as a manufacturers fault?
I haven't banged it and I work in an office so no manual labour etc?
I am hoping to return the ring again and get a completely new one as I have lost trust in this design. I saw online the reviews and the same thing is happening to other people. Spanner in the works my OH didn't get any ring insurance on it.

Did you buy it from a shop or online?
Is it fine jewelry or costume?

I would imagine after this length of time they may offer a repair or replacement but not a refund.

The ring was from H Samual, and I have only worn it for 5 months, normal wear really, take it off when in shower etc and I work in an office

All you can do is ask. Mine came with a 24 month warranty.

I was wondering what the standard warranty was anyway on a ring without paying extra for the insurance. Understandable after a year or a couple of years wear then fair enough but it's only been 5 months, I think it's not fit for purposes. I am going to ask them to swap it for another different ring, and I will have to return the wedding as too as I bought that to match the engagement ring. I am gutted as I love the ring but I can't trust it.

I've had my engagement ring for 13 years. It's white gold, diamond is a third of a carat and it wasn't hugely expensive (by engagement ring standards!). I've worn it every single day for 13 years for everything - swimming, gardening, house renovation including wielding sledgehammers and knocking down walls - and the stone is still solidly set.

A stone coming completely loose after only 5 months is very poor imo. In your shoes however I'd actually go visit an independent jeweller first for a chat and their opinion. Find a small, old school proper jeweller (jeweller on site) if you can and ask them to have a look.

They may be able to tell you if the setting appears inappropriate for the shape of stone or is warped or something else. Would be good knowledge to have before heading back to H Samuel.

If you're emotionally attached to the ring and keeping it is important then I would definitely visit an independent jeweller. They may be able to fix/amend it so that it doesn't happen again and you could keep it. Annoying that you should have to, but I would rather pay an extra couple of hundred quid and retain the same ring -(if poss).

When I have inspected the ring it looks like one of the claws has snapped, there are 3 claws and it's the one that is on its own, see the picture. How hard do you have to snag it before it snaps, as I don't recall it being banged or pulled on anything, it must be faulty, like the last ring and the others from the reviews.

Should this ring be covered under the jewellers guarantee?

I'd take it back with the reviews as well and ask for a replacement. Get a different style though. One with fewer stones.

I think I might take it back and choose a different style, but I do like the idea of taking it to a jewellers and asking them to fix it and maybe reinforce it but I will be forever checking it, I already was before the stone came out.
I feel like on principle I shouldn't be out of pocket because of their shoddy craftsmanship, getting married next year and I hope this isn't a bad Oman.

This is the review from over a year ago, so same exact problem, how can they sell them, surely there must be others that have complained.

Stones do become loose, but usually after a good few years. I lost the stone out of my engagement ring of over 25 years, I had also lost a stone in an eternity ring. I took them to the jewellers who said you should get jewellery checked every now and then. I think that a stone shouldn’t become loose after 5 months, but I expect they will send it to be repaired rather than let you choose a new one, but it will be interesting to see what they say, as there’s clearly a fault with the design.

Theoretically they should send it off to their repairers to have it assessed and if it's deemed a manufacturers fault they should agree to change it to the same value that it was bought for

@Hawdyerwheesht yes we have both, I wasn't thinking about this route when I couldn't find the diamond, I had everyone looking for it and I was under my office chair on the plastic bit, no idea why I chose to look there but I'm so glad I did, it was like a found a golden ticket for the chocolate factory when I saw it.

I was told I couldn't get a refund on a ring when a diamond came out of it after I had it for just over a year. I researched on Martin Lewis's website about my consumer rights and quoted my rights in an email to the retailer, within a couple of days I had a full refund. This might be worth you looking into also OP.

Seconding the recommendation to go to a proper jeweller, rather than H Samuel. An actual jeweller will know what they’re talking about. However…

‘Would be good knowledge to have before heading back to H Samuel - yeah, please don’t do that. Why should a proper jeweller give you the benefit of their experience and expertise for you to go back to H Samuel?

You should get a 12month manufacturing guarantee on the ring which is why they'll want to send it off for inspection

Same thing happened to my ring from h Samuel. Only it was just 10 days old. When I took it back the (snooty) manager looked at the ring and informed me I wouldn’t be getting a refund as I’d “sheared the prong off”. I calmly explained that all I’d done was put my hand in my jeans pocket and the prong had caught on the material. He took this as admission that I had broken the ring 🤦🏻‍♀️

i asked him to call the head office and check. He popped behind a screen and seemed to think this mean I couldn’t hear him say “well she’s had it 10 days and broken it, we can’t justify a replacement. I’ll quote her for a repair”. At this point I couldn’t believe how he was speaking about me and I did, unfortunately, loose my shit. Inform him I could hear how he was speaking about me and suggest he passed me the phone. He went quite pale and passed the phone into me. After hearing my call for the phone to be passed over, the last on the phone (head office apparently) informed me that she was just checking the stock as if they didn’t have one at the shop they would ensure it was there before closing time…

I’ve had the replaced one for 4 years..I still don’t trust it and check it after I’ve put my hand in my pocket!

@Serialcatmum are they known for having poor quality rings?
Can't believe putting your hands in your pocket caused it to break, that's normal wear isn't it, nothing special like mining for coal.
That's why I want a different ring now as I check it all the time through out the day, causes a bit of anxiety and it's meant to be a happy symbol.

@Lorddenning1 Like you , I checked the reviews and they were terrible for my particular ring!

They were really pushing me to buy a 3 / 5 year guarantee and as I’d seen that the manager would have been seen as good for selling me the insurance, I got it from a different provider. Cos I’m petty like that.

This happened to mine twice and they changed it twice (different jeweller ) I did get told the 2nd time to make sure I didn’t wear it in bed and I always take it off before I go to bed and didn’t have a problem since and that was 3 1/2 years ago
