Who is in the wrong here?

There has been a fuck up regarding deposit transfer for our wedding venue. The contract which we signed has a section that states 'all bank transfer payments must be sent to' and the company's account name, sort code etc. Therefore when we signed and sent back the contract, we deposited the money into the stipulated account. The wedding co-ordinator when she sent me the paperwork said 'here is the contract attached, please see bank details below for deposit transfer' stupidly, I did not realise that they were two different accounts (I know I should have checked!) but why send out a contract with the wrong details!? Surely this is the legally binding document and it should be correct. Had the email read 'please transfer to the account below as the contract is wrong' I would have paid a lot more attention. She got in touch asking if we had sent the money as accounts haven't received it. I know I've fucked up but, surely they should honour this if we can't find the money!?

Yabu - my fault
Yanbu- their fault

Who owns the first account? Either it's still open and someone will be able to access it or it's closed and the money will bounce back. Have they said they can't find the money?

AprilShowers82 · 24/02/2022 15:05

You haven’t enabled voting, but I think their fault. Although sadly I don’t think you’ll have a leg to stand on. Who’s account has the money gone into? Any chance if it being transferred back or recalled by the bank?

weddingwoes1 · 24/02/2022 15:05

They have just this minute told me the account doesn't exist and should bounce. Phew.

Idontgiveagriffindamn · 24/02/2022 15:06

Their fault - a written signed contract can only be amended by another document signed by both parties.
If the payment details were in the contract that both parties signed that’s binding

dizzydizzydizzy · 24/02/2022 15:07

YANBU!! What a bizarre situation. Totally their fault

Lime37 · 24/02/2022 15:07

Call your bank. But surely they have access to the account they gave you and can either send the money back or transfer it.

Tbh tho it’s there fault not yours. You can prove you paid it. If they haven't received it due to given you the wrong details that’s not your problem

weddingwoes1 · 24/02/2022 15:12

We are going to phone the bank. Wedding co-ordinator said the account no longer exists and it should bounce. DP doesn't think it will come back and will stay with the bank. Fuckkkk.

dementedpixie · 24/02/2022 15:19

It will either bounce back or be in a holding account in the receiving bank. Your bank should be able to investigate

Why on earth are they using paperwork with the wrong bank details on? Idiots

Hugasauras · 24/02/2022 15:22

Your bank will be able to deal with it. If it's closed that's good news as it can't 'go' anywhere. Either bank has custody of it and will get to back to you or it will just return anyway.

Completely needless. They need to update their contract!

I would have thought it would bounce back to your account. It won't be lost anyway

Please use this as a learning experience. When you’re paying all the various things for your wedding by bank transfer, always choose to get a receipt. You keep this in your own folder for your expenses/contracts and you email your supplier the pdf receipt to ensure they have it. I’m the email reference your contract Ref, total, payment, balance due. You then also have your own “paper” trail of what you paid, when, to whom, when next payment is due and how much.

marqueses · 24/02/2022 15:27

How long ago did you transfer the money? I wouldn't even expect a transfer to a closed account to get through the checks to allow it in the first place

Are you sure they are telling you the trutyh?

watchingrnfire · 24/02/2022 15:30

@marqueses it can still go in even if the account is closed, they don't always bounce back. But should be easy enough to retrieve by contacting your bank, then depends on how long it takes to get back as they need to contact the receiving bank

I get a receipt when the money is received - which it hasn't been because they gave me the wrong account details.

Their fault.
I have transferred money to dead account in the past and it’s bounced back to me automatically

weddingwoes1 · 24/02/2022 16:53

As far as our bank is concerned it is in the correct account now. Hopefully it shows up their end soon.

MischievousBiscuits · 24/02/2022 17:08

You have all the account details so your bank should be able to investigate and sort if it doesn't bounce back. This is definitely their fault, not yours

Thankfully our bank are able to trace it!

And still no money appeared in their account today 😬 eek.

billy1966 · 25/02/2022 16:57

Such incompetence doesn't bode well.

I'd be very wary of such stupidity in someone who was going to be organising my wedding.

That's my feeling. We're going to be transferring much bigger sums of money, it's ridiculous.
Georgeskitchen · 25/02/2022 17:51

So they gave you the wrong account number? How is that your fault?

billy1966 · 25/02/2022 17:53

If you have doubts, back out.
