Car crash not my fault

Just wondering people's thoughts on this. Been driving for 15 years, 12 years no claims on my own policy. Was hit by a young driver from behind as I was waiting to pull off at the roundabout, she was really upset and I said its OK. I got her to pull over, told her to put hazards on and checked our cars.

There was more damage to hers than mine, I have some scuffs and some paint mark. I told her again not to worry and asked for insurance details, she said she didn't know them. She was upset so I also spoke to her dad and said there was only a bit of damage and we were both OK. I told them. I had the car in for a service the next day so would get it checked for safety. Dad also apparently did not know insurance details.

Got the girls number went home and messaged all my details, again she apologised and said if there were any repairs she would pay. I said that's fine I probably just need a new car seat it's probably not worth repair.

I asked again for details to cover myself in case of injury or something turned up wrong with the car she again refused. Then her dad got involved and started messaging saying he didn't have to provide details and they would pay for the car seat. I said if I didn't get them I would notify insurance and police. He said he's already made a police report.

I had to take the day off work and had to take it today, so I've been and got checked I have whiplash. In the end I got sick and rang my insurance and have asked them to deal with it all.

I feel really bad as her insurance will go up and the damage wasn't major, but I got sick of asking and I am actually injured and there is damage to my car. Am I the asshole here?

Your premium shouldn't increase - you're claiming the whole lot through her insurance - that shouldn't impact on your own premium.

My insurance premium went up when someone drove into me. They admitted fault, their insurer paid to fix my car and although I notified my insurer I didn't even need to claim. But the premium still went up.

DD1 was hit by an uninsured driver (though he insisted he was insured, turned out he wasnt). MIB dealt with the claim. Took a fair while to resolve as DD had whiplash which required assessment and then physiotherapy.

On the face of it the car didnt look too badly damaged but when the assessor got down on the ground and had a look at the underside he described it is being corrugated. Total write off.

I have had to use this service, but you can use a basic check free. In my case the arsehole (I use that word advisedly because that’s what he proved to be), was not insured and gave me the runaround for sometime. Eventually the uninsured driver scheme took over the claim so I did not lose out. Amongst the stunts he tried was telling me that “his mate” would fix my car. Well yes, of course I’m going to let him repair £2000 worth of damage to my almost new car. Who wouldn’t!

Highly likely that she is not fully insured, you were right to report, might as well use the insurance you have paid for!

If your insurers have checked MID and the car is insured you don't need to concern yourself if the girl is covered. Her insurer will pay anyway.
If your car has such minor damage they may put you to strict proof of your whiplash.
Also the government cracked down on whiplash claims in May so you'll likely only get a couple of hundred quid and unless you want a solicitor to take a chunk you have to sort it all out yourself too. You just get a medical report as no insurers are allowed to pay out on whiplash claims without one now

How dies she know they'll pay?
When you sign up fir insurance, one of the terms if the policy is that you have to inform them of all accidents, even if you dont want to claim.
There's only one arsehole here and that's you

Sometimes people offer to pay then take the piss, you pay insurance to sort this out for you so why not use the service. You may see an increase in premiums but dealing with randomers about these things is not worth the stress.

Make the PI claim as well. Someone wrote my car off by driving into the back of it many, many years ago. I had 'minor' whiplash. I still have a restricted range of motion in my left shoulder compared to my right. Wish I'd pursued the claim and had a lot of physio!

Accidents often pan out differently over time. Best to go via your insurance in the circumstances. If they want to deal directly with your insurer it's up to them.

The Road Traffic Act says that you must report the accident to a police constable or police station within 24 hours.

@bg21 didn't realise you were a medical expert and a car seat specialist??? She's obviously damaged her car more than mine as mine is bigger and higher than hers and has a sturdy bumper, her car was cracked and dented so enough force that hers was in a worse state that mine. As it stands I've had two days off work with neck pain and migraine.

This is from the car seat company: We are sorry to hear you have been involved in an accident and hope you are ok.

It is the opinion of the company and many other manufacturers that in the event of any collision, the best and safest course of action is for the seat to be replaced. This also applies to car seats fitted but not in use at the time of the collision. It may not be obvious or clearly apparent that the car seat has been compromised however, the difficulty occurs when testing to determine if the car seat is safe this in itself would destroy the car seat. Insurance companies in most cases include the cost of a replacement seat within a claim. For further advice please refer to the link below: -

I think I'll take the opinion off the car seat manufacturer as my childs safety is paramount.

You should definitely make a police report, it's against the law to leave the scene of an accident without providing your insurance details. Dare I suggest she doesn't actually have insurance?
