Who's fault is this and what should I do? - Dogs

One of my neighbours fence panels is partly down at the moment, enough for their dog to get through to our garden. They have a female, we have a male, neither have been done (my female dog is done so didn't do the male)
I left the back door open a few hours whilst I was busy cleaning and I think they were outside together!!
Next door apologised and sorted fence when he realised his dog had gotten out.
I asked if she was done and he said no she's in season!!
What now?? Who's fault is this? Worried the dog will now be pregnant.
Any advice welcome!

You might want to suggest he contact the vet.

There is a morning after type pill for dogs. The ball is in your neighbours court.

Agree, your neighbour needs to contact their vet and sort this out.

Anyone whose bitch is in season is responsible for ensuring it doesn't get pregnant.

If the fence is theirs, then it's their responsibility to secure it. I wuld check and be very sure that it is their fence, and if it is, then say no more about it.

Why didn't you get your male dog done? And the same question to your neighbour about their female dog.

Yes definitely their fence.

Well it's not the law to get your dogs done and as my female is done I didn't think this would be a problem.

So the neighbour's fence is down and his bitch is in season but it's partly the OP's fault?

100% their fault! They are responsible for keeping their fence maintained in such a condition that their dog can’t get out, regardless of season. Some owners are so utterly irresponsible with dogs in season though, one person near us kept taking their in season dog to the park and complaining when male dogs approached it and tried to mount - idiot!

100% Neighbours fault. They have a responsibility to stop their dog getting out of their garden.

They knew the fence was broken and that their dog is small enough to get through the gap, they should have prevented this.

Well it's not the law to get your dogs done and as my female is done I didn't think this would be a problem.

It is your neighbours problem not yours. However your logic for not getting your dog done is quite unusual. I don’t have a female dog, I still got my male done, most people get their animals done unless they are breeding from them.

@Teeturtle I have a 4 year old male labrador that isn’t done.. why would I when there’s absolutely nothing wrong with him? My mum has a female lab, even though we don’t have live together I do take him round sometimes but they’re just kept apart when she’s in season. I’ve never had a dog done unless it was absolutely necessary.

Just too add a different perspective re neutering in response too a previous poster, there is often valid reasons not too Neuter a pet, for example a Male dog that is nervous sometimes it is not in the best interest of that particular dog as it can then become nervous aggressive, (obviously an assesment from a behaviourist shoild confirm this) or some blood clotting disorders would disuade from major surgery. Sometimes a blanket rule doesn't fit every scenario so not every dog can be neutered.

None of my males are done because they’re always in my complete control whether they’re in our very secure garden or out on a walk. I do have a female that’s done. If my neighbours fence was broken and her unspayed bitch came on to my property then any resulting unwanted litters would be her responsibility.

Irrespective of who owns the fence you are both responsible for ensuring your dogs are secured in your own gardens so you were negligent too as your dog could have got in their garden. You need to secure your garden before you let your dogs out unsupervised again.

He didnt seem bothered when I said he's not done and he said she's in season. Just sort of shrugged it off as if it was nothing.
Not sure if I should bring it up again.

Not your problem in any way. Not your fence, not your dog and therefore not your responsibility. Your dog should be allowed enjoyment of your garden and knowing the bitch wasn't spayed they should have been careful of letting it out. They maybe even did it on purpose.

I thought my dog was secure in the garden, otherwise I wouldn't of left the back door open.

At this point neither of you needs to be blaming each other.

The other owner needs to get their dog to the vet asap to avoid a potential pregnancy going ahead. Have you advised them to do this, or are they already sorting it out?

I think the dog and free run of the house and back garden, don't think they close their back door.

No the conversation ended there as I was just leaving the drive way, hopefully I can see him tomorrow but I don't know if he would even bother.

This, surely. He person whose fence it is doesn't have to make it dog-proof, theh only have to maintain the boundary.

But if you have dogs, then you obviously need to ensure that they cannot get out. So it's both of your faults.

You do realise there is no legal responsibility on your neighbours to even have a fence? You both have responsibility to keep your dogs in your space.
