To think a major fast food chain has a responsibility to protect their female staff from sexual harassment

DD16. Started work a month ago. Has been reporting the constant sexual harassment by the Deliveroo/Uber eat drivers since she started. Management say they are aware of the problem but can’t do anything about it as they don’t work for the company.

  • DD has been grabbed twice by these men
  • constantly harassed for her phone number
  • they’ve moved the girls off the delivery counter and put boys on there for a time but then moved them back when they were short staffed
  • asked how old she is and leered at
  • refused to give order numbers unless she gives a phone number

I’ve told her to quit but she won’t.

All employers are responsible for safeguarding staff whilst at work. They can’t abdicate that by blaming others, such as customers or delivery drivers. If local management won’t deal with it, escalate.

I'd say that ultimately it's the responsibility of Deliveroo/Uber to protect all of the public from sexual harrassment by their employees; and the responsibility of the fast food chain to do what they can (reporting it every time it happens, banning individual offenders from site).

She shouldn't have to leave her job, so good for her staying

Management need to sort this out and take responsibility.

Can she report the grabbing to the police, its a sexual assault

It is up to Management to keep her safe when she is at work and that includes from colleagues, staff and suppliers

Has she put a compliant in writing?
I agree she shouldn't have to put up with it, but she/you/her father will have to keep labouring the point otherwise it sounds like her managers won't do anything.

I personally would be worried about her personal safety, how does she get to work snd back home again? Is she safe if one of these creeps decided to wait for her to finish work? I know it's shot to have to think of this - I had the same/similar issues with guys at that age when I worked in a customer racing role, I would never work in a role like that again (even though I very capable of looking after myself now)

I'm an employment lawyer. Her employer can be vicariously liable for the actions of these drivers (also customers etc). She should make a formal complaint, follow the grievance process and look up sexual harassment under the Equality Act 2010. Speak to ACAS or an employment lawyer.

I totally agree that she shouldn’t be made to feel like this and that any driver acting like this should be banned from the store.

I also think she is absolutely right not to quit. She should get angry, not meek. Now might be a good time to teach her a variation on the MN classics
: “did you mean to make me feel uncomfortable?” If she learns now to say “I’ve told you I’m not interested and if you ask for my number again i will consider it harassment” it could come in useful in many situations in future.

We drop and collect her. She has text me that they’ve moved the boys to delivery today - which just shows the company know they have an issue!

Put it on Facebook and name and shame them. Then watch these businesses move like lightning to solve the issue.

Is there a whistleblower number.

As the op said she could raise a formal grievance citing harassment.

If this is something like McDonalds their HR dept will step in at that point.

I watched two older delivery drivers checking out one of the young girls who was handing over the food to them and when she turned her back he touched his groin to his friend. You could tell she looked uncomfortable doing the task. A colleagues daughter has had similar issues to your daughter at McDonalds.

Please don't suggest that name and shame on SM that will only her your DD fired.

Recommend she launches a formal complaint. Could colleagues also be persuaded?

Yes it’s one of the big chains. I went in at the end of the shift and the drivers are grim, crowding them as they hand the food over, leering, massively getting in their personal space

I didn’t because I’m not going to kick off in my daughters work place. But I won’t ever use them again, not least because one of them had a hacking cough and then picked up the food bags with the hand he’d been coughing and spitting all over 🤮

I’ve used deliveroo and Uber a fair bit over the last few months, yes because it’s convenient but also because it gives local employment. This is making me think twice. I’d rather go and collect my own food than subsidise sexual harassment

Yes the health and safety at work act puts a duty of care on employers to provide a safe place of work for employees and protect them from accident or illness and this includes mental anguish etc. If not and it caused her stress or she had to leave she could sue them.

Errr no it won’t. We live in ‘new too’ times. Any business allowing it tolerating any hint of harassment will jump by over hoops to fix it as soon as there is a whiff of bad publicity.

Come on ladies, please support eachother. It's difficult to address these groups of men, especially when calling them out on their behaviour. I've seen this all over London when getting food for myself. They are rude, they push in front of eachother to get their delivery bags and yes they leer at customers and staff. If I see it, I address it but then I am in a uniform of some sort.

@Shamidam please talk to management about your daughters experience at work. It is not acceptable and they are being lazy. She has good grounds for a sexual harassment case and they should know it
