Posting here for traffic. NC for obvious reasons.
I pulled out of a junction to turn right onto a main road. I bumped into a front wheel of a car that proceeded to go around me as I made my manouver.
They've escalated it to the point where now I have a notice of hearing from the court. Is there anyway this can be stopped? I don't have the courage to defend myself and wish it hadn't got to this point.

Green car flashes the OP to go.
OP (blue car) had nudged forward waiting to go.
Red car comes along and won’t wait for OP to do the manoeuvre so tries to go around but clips the front left of their car.

Has your insurance said anything about your description not matching damage?

Quite a few years ago I had someone hit me, but claimed I hit them. However, where they claimed they were hit was impossible with the manoeuvre they were performing. Yet even with photographic evidence it went 50/50. So there’s hope

As I understand it, OP hit the nearside front of the red car.

@babywalker2 if you were stationary and the car tried to go around you but clipped the front, then I would have said the red car was at fault for hitting a stationary vehicle.
If you were moving (effectively across the path of the traffic) when the collision occurred I would have thought you were at fault.

I should add I have no professional relevant background here, just my opinion.

If @CyclingIsNotOuting's diagram is correct, you're in the wrong.

It doesn't matter that you'd started pulling out or that the other car flashed you to go - you shouldn't have even started pulling out unless you could complete the whole manoeuvre without causing any other cars to have to change their speed etc. It obviously wasn't clear for you to complete the manoeuvre, so you shouldn't have pulled out

I think your first diagram was how it happened @CyclingIsNotOuting.

In which case unless the other driver was speeding really very excessively it would have been the OPs responsibility to check for traffic from both directions despite the third driver flashing them.

I’m still unclear why the DH managed the claim though, unless OP you are a named driver and it’s his policy.

I think the bigger issue is the lying and trying to hide from it. You can admit liability now, avoiding court will likely be in your interests.

You will always be at fault pulling from a side road onto a main road. The main road cars have priority.

Have you explained to your insurance company that you/your DH lied in the original statement? Going to court is scary but at least then it will all be over and sorted.

For Christ’s sake woman you’re an adult, why are you putting yourself in this mess of lying to court and creating court cases? You’re an adult you can write your own statement and deal with insurance yourself. Your insurance are going to be furious at you lying to them…

Talk to your insurance and admit your fault...I can only be your fault as you pulling into a main road from a side road and it's your responsibility to check the path is clear. Never ever trust anyone else but you to check it's clear. Admitting fault best way forward x

Unfortunately you are at fault here (13 years experience of motor insurance claims) and the damage being to the front, left of the other vehicle only supports their argument that you pulled out on them. If they had hit you the damage would be to the front of their vehicle and the right of yours.

The only problem is if you have decided to fight this on your own and not tell your insurer they may not pay the legal costs as you should have reported to them straight away and would have avoided it getting this far.

You don't mention your insurer at all so it's not clear if they know. If they do and are already dealing just let them handle it. If they don't know you really need to tell them and let them take over.
