Neighbours car

There is a patch of land next to my detached garage that may belong to me, one land search say it does another shows it as unclaimed land. About 2 years ago my drug dealing neighbours in the rented property next door parked a car there. At the time I told them the land wasn't theirs to park on, he said it was just for a week. Anyway 2 years later and the cars never been moved. Its now got flat tyres and has been vandalised. I have asked numerous times for him to move it he just says yes but never does. I think its a fire risk if it goes up my garage will too. AIBU to contact the council/police and report it as an abandoned vehicle? Does anyone know what will happen if I do?

2 years?! Yes, report it

1987qwerty · 28/06/2021 17:04

If it's off road police won't care.

MrsMackesy · 28/06/2021 17:08

The scrap man should give a decent amount of money for it and collect it too. Values are good at the moment. Your neighbour will have to agree though, IF he owns it.

Notwavingbutdrowing3 · 28/06/2021 17:10

So if you are sure it is your land and can prove it is ( see a solicitor) you may consider investing in action tow company to move it onto the note after a cease and desist letter to them that car will be removed as it is illegally dumped in your property and they have been repeatedly asked to move it (recorded delivery).

You need to enclose your land with fencing straight away, same time as removing their car and take photos, because neighbours can eventually do an adverse possession if you let this continue for years. It is a civil matter and one I would not left drift as they clearly aren't interested in the fact it is your land/property.

Notwavingbutdrowing3 · 28/06/2021 17:11

*tow company to remove it into the road from your property, following fair warning from your solicitor.

Notwavingbutdrowing3 · 28/06/2021 17:12

This is the time a solicitor is worth spending a few hundred on as the land could be worth £10 of thousands and it is an abandoned vehicle.

Notwavingbutdrowing3 · 28/06/2021 17:14

If it turns out to be council owned land, you can report abandoned vehicle on their land to the local council

Imagiraffe · 28/06/2021 17:16

What if I call the council and say its a fire risk? Trouble is I can't afford to get a solicitor to make sure the land is mine. Next door definitely doesn't own it or have access from his garden to it and its fully concreted and joined to my garage foundations.

The police do not have the powers to remove the vehicle. If it's on private land neither will the council or DVLA. You need to establish who owns the land - if it's yours you can have it removed.

ForeverSausages · 28/06/2021 17:20

You just report it to your council. They should have a link to report abandoned vehicles.

Imagiraffe · 28/06/2021 17:21

I really can't afford a solicitor at the moment but I could do with reclaiming what is probably my land. I've lived here for 20years and my garden is very big but I've been through some tough times so not bothered to much with it. My mental health is now alot better but I've taken a huge hit financially and don't have anyone to help me out. The land if not mine is not council owned. It adjoins some waste ground at the end of a lane behind a row of terraces mines the last garage in the row.

You need to establish ownership of the land so you can work out who's responsible for it

Also why mention he lives in rented accommodation?

londonscalling · 28/06/2021 18:01

You could tell the council that you've seen young kids playing under it and it's dangerous. Years ago my sister in law had a chest freezer dumped near her house. It was reported to the council and they did nothing. She then reported it again and said she'd seen kids getting inside it and that it was extremely dangerous (she hadn't) and the council removed it quickly!

Imagiraffe · 28/06/2021 18:04

Yaykyay I mentioned he rents because its relevant. He rents a house that doesn't have a garage or private parking. All other houses on the street do. When he chose to rent that house he could see it didn't have access to the land behind. Hes not a nice man, deals drugs. If I knew who owned the house I could speak to them but I don't. Its not about me having more money than him Yaykyay because I don't.

Check you deeds and do a land registry search, which is only a few pounds

Imagiraffe · 28/06/2021 18:38

Londonscalling good idea i may try that

There is only one official source of information and that's the Land Registry. What result does a map search on their website give you?

None of that is relevant. Call the council and get it removed. Sort out if it's your land or not then fence it off.
Imagiraffe · 28/06/2021 18:49

Slippy78 The first one that I had stored with all my house documents from when I bought 20yrs ago show it as unclaimed as far as I can see although the previous owner was using it. There was plans drawn up for housing on the rest of the waste land a few years ago and they have a red line around both the land in question and my garage thus looking as if it is mine if that make sense

I reported an untaxed vehicle parked on our road. The police tried to contact the owner, but they were out of the country. They stuck on "police aware" tape which was apparently all they could do. It then got vandalised - I let them know, as there was broken glass all over the place - and at that point they could move it because it was a hazard.

Tiredmum12389 · 28/06/2021 19:20

We had an untaxed car parked outside our house for 3 years. Reported it numerous times. The owner was in prison on a ten year sentence. It only finally got moved when someone paid for it to be transported to the owners families house.

Imagiraffe · 28/06/2021 19:25

Does anybody know how i find out who the actual owner of the car is. It has a number plate. I've checked for tax and mot it hasn't got either.

AngelSings · 28/06/2021 19:34

Had a similar problem with 2 cars on common land. Reported them to the council. They checked if the cars were MOT'd or taxed (were neither). The vehicle owner was contacted and given 2 weeks (?) to remove the vehicles himself or the council would do it and bill him. He removed both just before the deadline. Such a nuisance and so much effort because someone couldn't be bothered to take care of their own cars.

The local council should be able to do this if you report the vehicle as abandoned.

No, that doesn't make sense. Planning documents have absolutely nothing to do with land ownership. You need to check the link I posted earlier as that's the only official record.
