To think Universal Credit were wrong not to pay me?

incling · 26/06/2021 12:13

I lost my job in Feb due to my department closing down.
Unfortunately I had to make a claim for UC and have been looking /applying for work ever since.
To my shock feb and match my old employer was still reporting to HMRC saying I was getting £1,200 a month (I wasn't getting paid a penny)
This resulted in March /April a £0.00 UC payment.
I contacted my ex employer every day and got them to amend the figures with HMRC
This took over 2 months.

I started a RTI dispute and it came back that HMRC contacted my employer but received no response back.
So I started a mandatory reconsideration.
I uploaded my bank statement showing £0.00 money and also my personal tax account which shows my ex employer amended the details and my income was £0.00

Decision was no payment, according to UC that money might have gone into a different bank account.
So I've lost over £2,000
I went 3 months with zero payments and had to take out a loan to survive.

Aibu to think this isn't right?
My ex employer has amended this with HMRC why can't they just say that's enough evidence.

Well yes this is definitely incorrect.

Are you able to take the decision to appeals court?

ChickenLittle27 · 26/06/2021 12:15

UC is not fit for purpose. It is appalling how they treat people and basically expect people to survive on nothing. I've been in your situation OP. You have my sympathy.

Hwory · 26/06/2021 12:17

Have you contacted your MP? They might be able to get your case looked at by someone with some common sense.

TheQueef · 26/06/2021 12:17

Is there a next stage appeal?
Are you getting any help with this, Advice service etc?

MyDcAreMarvel · 26/06/2021 12:19

@incling try this group , they are a registered charity and very knowledgeable. If there is a further process other than a MR they will know what to do.
Am really sorry it’s not right at all.

I have asked for it to be looked at again.
I've told them that UC is meant to go off the info HMRC provide them.
HMRC have shown that my income was £0.00 so there is no reason for no payment.

I have had help from the money matters team and also my work coach so I'm hoping it gets sorted.
Apparently it's now with another decision maker.
Do you think it's gonna work out?

Except this problem is entirely caused by the former employer making wrong filings, something they have a legal obligation to do correctly. It's not the fault of UC that they are being given false information from what should be the most reliable source.

Unless you think a decent benefits system is one that doesn't need to know what other income you have?

incling · 26/06/2021 12:20

I've been ringing the UC helpline and half the staff seem to not have a clue.
The hilarious thing was when they told me I needed too
"Book a telephone interview to show evidence"
When asked how I could show my evidence over the phone ..she didn't know what to say.

OP posts:
ChickenLittle27 · 26/06/2021 12:24

@RandomLondoner except OPs employer has already corrected the error and UC have still said that she isn't entitled to any help. I have my own negative experiences with UC and it definitely had nothing to do with my employer!

TheQueef · 26/06/2021 12:25

If HMRC is now showing the correct information, plus bank statements, plus fresh eyes they should realise it's an employer error.

Did they say how long decisions are taking?

MyDcAreMarvel · 26/06/2021 12:26

@RandomLondoner Except this problem is entirely caused by the former employer making wrong filings,
I think you are confusing the word entirely with initially. The MR should have resolved the issue and that is why UC is not fit for purpose.

Babyroobs · 26/06/2021 12:27

Uc is calculated on the earnings that HMRC report so your employer is in the wrong here as I'm sure you know. Now that has been rectified by your employer, Uc should definitely pay you what they owe you. I would take it further with UC.

incling · 26/06/2021 12:27

On the HMRC records it says ...
(Employer made some changes after the tax year so is not reflected in table, and that the totals don't add up)
It then says feb £0.00
March £0.00
And under it says I received £2,200 less
And paid £37 less tax
So it all shows that my income was £0.00
I don't know what more they want

OP posts:
RandomLondoner · 26/06/2021 12:28

Actually I take it back. It is UC fault. It should be easier to inform them of correct income, and past systems did allow you to self-report.

(Yes I see OP has said it's been corrected with HMRC, but it's not clear that means the RTI records have been corrected. Though I'm not sure what else it could mean. If the RTI records have been corrected, then this is definitely UC fault. If HMRC know there was no pay and haven't amended RTI records, then this is HMRC fault.)

incling · 26/06/2021 12:28

He said I can provide more proof to to the MR if I want and that's when I explained everything
So I hope another decision maker will over look everything and sort this out.

OP posts:
incling · 26/06/2021 12:29

See this is the confusing part.
They have said the RTI feed hasn't been changed
Yet when I look on my tax account I can see the amended info.

Is my tax account not the RTI feed then ?

OP posts:
RandomLondoner · 26/06/2021 12:42

I've just had a look in my tax account and there is no monthly salary information there. The only thing is my tax code, which only determines how much should be deducted from future payments. That's definitely not the same thing as RTI information, if that's what you're saying had been adjusted.

Having said that my salary is below the threshold for tax, so maybe that would make a difference to the information shown? (Though I don't see why it should.) Be interested to hear if anyone else can see their monthly payslip information in the tax account, I don't know if that's a thing that exists.

RandomLondoner · 26/06/2021 12:44

The RTI feed should I think resemble the information that's on a payslip, it should show gross salary, amount deducted, the exact date, for each payment.

RandomLondoner · 26/06/2021 12:48

Looking at your previous posts it does look like you are seeing monthly information, that does sound like the RTI feed.

incling · 26/06/2021 12:48

@RandomLondoner when I go on If I click paye information
Then click previous tax years
It has my employers name on with the amount I've received in a year
Then when I click on it
It will say 29th jan £1,100 then tax etc
Feb ,March etc

Time4change2018 · 26/06/2021 12:53

Try making an account on HMRC - personal tax account. This will show HMRC have amended this - upload this to your journal. Call after and kick up a stick and ask for another MR based on this new information

RandomLondoner · 26/06/2021 12:55

I feel like a prune now. Yes, for previous tax years I can see monthly information. That does look like the right information.

I know the information gets passed on from HMRC to UC, so I'm guessing corrections are not getting passed. This now looks like a UC IT problem.

thefourgp · 26/06/2021 13:00

UC are a nightmare to deal with when things go wrong. They tell you to use the online system then ignore perfectly reasonable and rational messages you add onto it. Not the exact same circumstances but they stopped my payments in error when I moved home. I tried their complaints route and had to go to my MP. My MP got it sorted and they backdated the payments but I never even got an apology from UC, just a two line letter saying they were back-dating my payments. I understand your frustration and distress. Go to your MP.

incling · 26/06/2021 13:08

The whole thing has drove me crazy.
It's been going on weeks.
It takes them a week to respond to messages.
Then when they do they don't make sense.
They ask the same questions.

The UC helpline is even worse.

I'm another who says contact your local MP. Mine is Lyndsay Hoyle and he is fantastic with stuff like this. One phone call from him and people have had benefits cock ups sorted out immediately. It shouldn't have to be like this but I can imagine you are fed up with it all, so it's worth making an appointment at your MPs surgery or emailing them. Good luck.
