To think I can get a refund?

I bought a new vacuum in January, a few months later the handle snapped off, I haven’t been able to return it to Argos as my local store has been shut throughout lock down and has only just opened again. I called Argos before returning but the woman said that before I could return it I would have to speak to the manufacture first, so she put me through, however they were just trying to send me out a new one which I don’t want even after explaining I want my money back. Aibu to think I can still return it in store for a refund? I don’t want to have a wasted journey as I don’t drive so will need to carry it down there and it is heavy, surely I’m entitled to my money back?

Well if they won’t take my item back after 4 months can’t see them taking something back from a year ago sorry the thing is it broke ages ago so wasn’t even 4 months, broke about 2 months ago 🙁 I’m going to return it tomorrow morning So will update if they do!

I didn’t even notice the knives comment was too busy worrying about them not accepting it back! Would like to know more about that too 🤭

I would print off the relevant sales act and take it with you, that works for a friend of mine!

Happycat1212 · 14/05/2021 10:33

Well thought I would update this! 🤬 I’ve just walked a mile and a half to my local store carrying the vacuum and it’s fucking shut!! I called Argos and they didn’t give a shit I’ve just carried the thing a mile and a half. So much for all the shops are open now 🙄

Shock

Did you check Google first? It lists opening hours.

Floralnomad · 14/05/2021 10:37

It’s hardly Argos fault that you didn’t check opening times .

Happycat1212 · 14/05/2021 10:37

Yes it says open Angry

@BoyTree

NO!! Please explain more about the knives situation *@Comefromaway*
Ha ha! I thought when I typed it that it sounded dodgy!

She works for a company who are employed by retailers to do age compliance audits. So basically she has to write a report on whether she gets asked for ID or not along with other aspects of customer service. She is allowed to keep any alcohol at supermarkets etc but Argos request that auditors on knife audits obtain a refund.

mainsfed · 14/05/2021 10:41

@Happycat1212

It says it’s open!
That is shit, this gives you more ammunition to complain now, as you're tried to resolve twice now.

Have you tweeted them?

Comefromaway · 14/05/2021 10:41

She does age restricted video games too.

Happycat1212 · 14/05/2021 10:43

I’m not going to complain. I want to but they said the only way to do that is by post, which I’m not going to do. Haven’t got the energy for that. No email complaints apparently

OP posts:
mainsfed · 14/05/2021 10:44

But complaining increases your chance of getting a refund.

GabsAlot · 14/05/2021 11:06

well like people said you should hav rung first

mainsfed · 14/05/2021 11:16

Shops very rarely answer the phone ime

WillWonderer · 14/05/2021 11:23

You're entitled to a repair or replacement, not a refund. But, you have a contract with Argos so it's up to them to sort it out, not the manufacturer. Companies like Argos are determined to tell people it's not their problem and it 10000000% is.

BelleBlueBell · 14/05/2021 11:24

@GabsAlot

While ringinh could confirm that the shop is open you can't know that an unanswered phone means the shop is closed.

I can't be the only person who hears the phones is shops ringing and not being picked up because the staff are, rightly, serving the customers who are actually there.

Very strange that a random branch of Argos would be closed when every shop in the rest of the country is closed - suggests some emergency on the day. A couple of weeks ago I walked past a branch of McDs that had a sign on the door saying they were closed as the computer wasn't working. Maybe it was all branches, I don't know, but an unexepected emergency that no could have predicted when they set off to go to the shop.

vivainsomnia · 14/05/2021 11:25

Surely if you had something and it broke within 4 months it would put you off wanting another?!
No it wouldn’t. One thing braking doesn’t mean the whole product is deficient let alone that all similar products of the same brand are unreliable.

If you buy a new car and the wipers stop working after 12 months, are you going to ask them for your full money back because it means the car is unreliable and so are all of the same make? That would be quite absurd

This happened to me, but I didn't want the same wipers from the manufacturer. I got my local garage to put in new ones, much better quality and don't squeak.

A lot of Argos stores won't be reopening at all. Are you sure yours isn't one of them?

I only discovered the other day that our local one has closed permanently and we now have to order and pick up in Sainsbury's.

Happycat1212 · 14/05/2021 11:53

Well I’ve traveled 5 miles to the next store and they’ve point blank refused a refund. They said my contract is with dyson not with them even when I quoted that my contract is with them if it’s under 6 m. Oh well!

Yeh the store 5 miles away said it sounds that way. Waste of a day either way.

I have a Dyson and had a long guarantee
Their customer services are usually accommodating and even offer a courier to pick up the Faulty item
Between my son and I we have lots of their products
I don't think they are obliged to refund though, only replace parts in first instance

uncomfortablydumb53 · 14/05/2021 15:08

Also your contract is with Dyson and not Argos

NotAnotherPushyMum · 14/05/2021 15:10

@uncomfortablydumb53

No it isn’t. The contract is with the person you buy it from.
LookItsMeAgain · 14/05/2021 15:15

@uncomfortablydumb53

No, it really isn't.

The OP has bought the appliance from Argos and they are who she has her contract with.
They have to offer a repair, a replacement or a refund. It's very simple.
Staff in Argos don't know what they are talking about (and it seems like many on this thread don't actually know their own consumer rights too should anything ever go wrong with a purchase they might make).

YOU (@Happycat1212) have to go in armed with the knowledge of the relevant consumer protection act that can help you.

I posted details earlier in the thread including a link to a Which report that lists what steps a consumer needs to take if something they purchase develops a fault.
