AIBU to want Asda to tell me the registration number of the van that hit my car?

Hi, I’ve name changed for this (hopefully!).
On 5/2 in the evening, an Asda delivery driver hit my car which was parked outside my house.
I couldn’t see any damage until it was light the next day.
I went to my local store to report it and show photos and was told that they would pass it on to the insurance company.
A week later I returned to the store and was given a “bump card” and told to contact the insurers who were dealing with it.
I contacted them and they need me to give them a registration number or a claim number which I haven’t been given.
So I went back into the store to request these.
They are refusing point blank to give me these details. I am going round and round between calling and visiting the store, calling their customer service number and emailing a store manager with photos and cctv videos.
When I tried to report it to the police 2 weeks ago I couldn’t talk to a real person! I have finally managed to fill in an online form today.

I have once again contacted Asda customer care and got nowhere.
I have emailed the CEO and had no reply.
I have tweeted them and had no response.
I went onto their Facebook page but you can only comment on their posts, not start a thread.
My insurers said that if I go through then, they will treat it as a (my) fault claim.

I am completely tied by this and am getting madder and madder with each passing day!

What can I do?

Oh and when Customer services contacted them, they denied having given me the insurers details. Where did I get the card from then?
They are lying liars and I am so flipping mad!

My friend had this when a co-op lorry hit her car, unfortunately it took her dad calling with a very strongly worded phone call and legal back up to get them to ‘realise’ they did have a lorry in that area that day

I have showed them my cctv. I’ve told them it’s illegal to withhold this information and I’ve told them the drivers name. I’ve even told them- to the second- what time it happened!
I don’t know what the heck else I can do.
Big corporations are scum.
I will never shop there again.

If no attempt was made to stop and exchange details at the time, surely it is a hit and run. So a police matter.

Point this out to ASDA and they may respond differently.

I can't help you sorry, but my friend feels your pain.

A delivery driver for a certain courier company hit her garden wall in the dark 4 or 5 weeks back, and pretty much took half of the 16 foot long stone wall down...

A keen-eyed neighbour got the registration number, and my friend reported it to the company. Basically, the company said there was no evidence this driver hit it, as there was no damage to his van apparently. Hmm

Conveniently, her house insurance doesn't cover garden fences, sheds, or garden walls, so she is out of pocket now for 4 or 5 hundred pounds.

Fucking disgusting, and a weird and shitty little bastard loophole in the system! Nobody is taking responsibility. Not the driver, not company he works for, and not my friend's insurance company.

Such bullshit.

I have rung 101. You can’t talk to a real person. I finally managed to report it to the police and they have emailed that I can give the incident no. to my insurers.
But my insurers were not interested at all in pursuing Asda, they will just repair the damage and class it as a fault claim against me.

That's appalling. Are you U.K.? Failing to stop after an accident or to exchange details is a criminal offence.

Ultimately you'll have to get your insurance to deal with it and take Asda to small claims court for excess in your insurance & related costs, with police report copy and your cctv . It's such a shame that you didn't get vehicle registration number and it's obvious they hit a stationary parked vehicle

Post it in the comments under every post on their page. Keep doing it until you get a response.

I had something similar with AA. They denied it point blank, said they weren't there that night, then said they didn't know which vehicle was there, then said the vehicle didn't have any damage. I told them fine, I'll take legal action, it wont cost me anything because I have legal cover as part of my AA membership. All of a sudden they were willing to fix it!

Can you report them, the omudsman maybe? There must be some regulatory body that you can discuss this with? Have you looked through their complaints procedure?

You need to get your insurance company to sort it out. Only they can request the dashcam of the van due to GDPR.
If it wasn't your fault then you should have no excess to pay and it won't count against you as a claim.

I wondered today about the ombudsman- although against my insurers as they won’t pursue the claim despite me having the company clearly shown in the van livery on cctv.
I haven’t managed to find Asda’s complaints procedure. The store got uppity with me and told me to ring head office when I pointed out that they were breaking the law. “In this country people are innocent until proven guilty”. I have proof that he’s guilty!!
Head office aren’t taking phone calls due to Covid.
I went through customer service and they said they are running it through a complaints procedure (this was last week) but when I called them again today, they still can’t do anything. She just said she will pass the police claim number along to the store.

You can also make a complaint about your insurers conduct. They should not be making it a fault against you

Slippy, when I spoke to my insurers the lady said that “as you are a nurse for the nhs, we will waive your excess as a token of thanks for your service for the past year”.
I thanked her and said how lovely the sentiment was but that I wouldn’t have an excess to pay as it was a non fault claim.
She then said that they wouldn’t pursue Asda as Asda have refused to give me their details!
Local Asda just keep saying that they have requested the cctv from their van but I don’t need or want that, their insurers might want to see it but my cctv shows it very adequately so it’s unnecessary.

It’s all stalling tactics and I have nowhere to turn.
I have tried everything I can think of within the law.
I have been perfectly reasonable and I am getting treated like shit by them!

Can you go wander round the vehicles parked up at your local Asda late at night and match the damage?

If you do get the CCTV, it may be worth it if it is labelled as 'REG NO date'

Do you have legal cover on your home insurance? If so use that and tell your car insurance company you are considering action against them for failing to investigate and making you at blame, this will therefore increase your premiums by the way. Then tell ASDA they are failing to report details of a crime so are therefore effectively aiding and abetting

I'd go down the route of this was hit and run, the police will be contacted next.
My car was hit by a bed delivery company, I wasn't even home. One hell of a crash according to the retired policeman who lives a few houses down. He gave me all the info including where the bed was delivered. The new bed neighbours gave me the delivery info including the drivers name. I was paid double quick.

I’ve contacted the police.
I have given the store the name of the driver- the day after it happened when I initially reported it.
He delivered to my neighbours who told me his name (first name only).

I have put both lots of my cctv as a public post on my own Facebook page now in the hope that it gets shared enough to start trending.
I don’t know how to link it to Twitter but hopefully as I have @Asda ‘d them, it will come to their attention at some point.

If it’s not your fault then claim through your insurance. They should be able to make sure your records don’t show it as a claim against you

Upload the video to YouTube and post the link on Asda's Facebook page and on twitter, tagging them. I'd also consider tagging your insurance company.

Might it be worth going to the local paper to see if they’ll do a story on it? I’ve seen things like this in local papers and usually it suddenly triggers a response from the party as of the bad publicity.
