Dd been sacked for isolating

My 16yr old has a part time job. Me and her dad had tests earlier this week. Unfortunately she was supposed to work so had to call in and say she couldn't.
Today she gets a text saying she's let them down! She's replied and said she can prove the tests were genuine and she had to isolate by law but they've not replied. This isn't bloody right is it?

I feel very much like we are in the middle of a pandemic still. We're waiting for my aunt to die at the minute and our local hospital can't take any more patients. I do hope you're right though!

She's been in to speak to them but the boss wasn't in. He's apparently going to call her later

If she is isolating then how could she have "been in to speak to them". That is very irresponsible and perhaps shows them she is willing to break isolation after all.

The test was negative so no need to isolate now Confused

Daughter texts employer saying she can't come to work tonight. They reply.saying they feel let down. MN advises daughter to call the police.

Can I just say that is not a NHS wide policy, the trust I work in says you are to isolate in this situation

Unfortunately takeaways and cash in hand jobs with no contract often behave this way.

It's exploitative really as they know they will have a long line of people wanting that job, especially at the moment, so they are demanding complete reliability.

Unless your daughter really needs the money I would advise she's better off not working at a place like that as they won't treat her well.

🙄 the tests came back negative. She isn't isolating anymore.

By the sounds of this it is a small business and so if it is the sack (or in a week or two, we don't need you any more because we have less business, which cannot be disproved), given the informal nature of the job, sadly the DD has little grounds to stand on.

If they do sack her I’d put them all over social media. By behaving in this way they are putting their clients at risk.

Is she working cash in hand ? If she is then they can do what they like sadly if it’s all under the table .

Sorry, just seen her age - she won’t have 2 years service. I don’t think she has any legal recourse - it would mostly likely be an unfair dismissal if she had the service to claim it, but I think this is a loophole for employers. She might be able to claim without 2 years service under health and safety?
Unfortunately I think that is the rules

Did she have a message from track and trace telling her to self-isolate? You said the tests came back negative which is odd. I've only been contacted by track and trace and told to self isolate when I had been in contact with someone who had had a positive test. I also was only told to get a test myself if I developed symptoms.

Sorry if this has been covered before.

Also should add that I was required to self-isolate for 10 days. Nothing about that being ended of I had a negative test.

If you live with someone who has symptoms you have to isolate until they get their test result comes back.

If you’ve had contact with someone you don’t live with who has symptoms you only isolate if they are actually positive.

I knew you were going to say takeaway. There's very little part time work for 16 year olds at the best of times. DS got fired from a takeaway because they wanted to employ a family member. Its a tough lesson.

No, it is not a criminal offence. The police would not get involved. It is, however, likely to be an automatically unfair dismissal under section 100 of the Employment Rights Act 1996. This means that, assuming she has been dismissed, she can make a claim even though she does not have two years service.

Not much help but I've been "dismissed " from my job as I am cv and told work I need to shild after people in the office tested positive and still wanted to come into work

It’s a 16 year old in a job so no legal rights as not employed long enough for unfair dismissal. Just tell her to look for something else and to work for nicer people and if you feel strongly ring the manager and tell them she was acting like responsible young person! Good luck

She has no rights but thats the thing with working cash in hand you don't pay contbutions and deductions unlike the rest of us .
Best hope she doesn't have an accident because she certainly won't be insured .
