Dd been sacked for isolating

My 16yr old has a part time job. Me and her dad had tests earlier this week. Unfortunately she was supposed to work so had to call in and say she couldn't.
Today she gets a text saying she's let them down! She's replied and said she can prove the tests were genuine and she had to isolate by law but they've not replied. This isn't bloody right is it?

OP posts:

I don't know what the whole story is. But yes zero hours contracts mean employers can get away with this if a person has done less than 2 years service. It's a huge flaw in our isolation strategy. Even if you give people £500 they might lose their job and so might not feel it's worth isolating

BruthasTortoise · 23/01/2021 19:15

It's a crime? Why wouldn't you ring the police? If she has been made redundant because she had to self isolate that is a criminal offence.

SchrodingersImmigrant · 23/01/2021 19:17

😂 police😂 ffs.
Environmental health will too nit be interested because she wasn't told she was sacked. It can easily be a miscommunication due to them writing short messages.

I wonder when will 101 start asking "And where di you hear you should call us?" And find out 75% of calls about bullshit are generated by mumsnetters😂

Bunnybigears · 23/01/2021 19:17

@BruthasTortoise for a start being made redundant and being sacked are two completely different things, secondly we don't even know if she has been sacked yet.

SmidgenofaPigeon · 23/01/2021 19:18

@BruthasTortoise

It’s a crime?! ring the police?! What are you on?

Nicknacky · 23/01/2021 19:19

@BruthasTortoisen There has been no crime committed. Give your head a wobble FFS.

No one's been made redundant, where are you getting that from?
LIZS · 23/01/2021 19:23

How is it a crime fgs? She cancelled her shift a couple of evenings ago and only got the text today, by which time she is no longer isolating. When is she due to work next or is it casual?

BruthasTortoise · 23/01/2021 19:24

The legislation says that employers who compel employees to come to work if they know they are meant to be isolating are committing a criminal offence. Threatening to or actually sacking people for isolating would meet that requirement. IF this girl has been sacked for isolating I'm not sure how you're not seeing the criminal offence?

Nicknacky · 23/01/2021 19:25

@BruthasTortoise She wasn’t compelled to go in.

There is no criminal offence committed so stop encouraging people to waste police time.

And incidentally, can you link to that offence? I would be interested to read it.

This was not compelling though. 101 isn't employment advisory service either. What would they do?
BruthasTortoise · 23/01/2021 19:26

Apologies I used redundant interchangeably with sacked. The point is employers can not legally use punitive measures to get their employees to come to work if they are meant to be isolating. Surely this is a good thing? And we should be expecting employers to do their duty?

Nicknacky · 23/01/2021 19:28

@BruthasTortoise Absolutely employers should be doing the right thing, no one disagrees with that.

But you are making up offences.

SemperIdem · 23/01/2021 19:28

If she’s cash in hand with no contract - then she’s not legally employed is she?

BruthasTortoise · 23/01/2021 19:29

They would advise the OP if a criminal offence has been committed under the Coronavirus Regulations.

SmidgenofaPigeon · 23/01/2021 19:30

@BruthasTortoise no criminal offence has been committed whatsoever.

Nicknacky · 23/01/2021 19:30

@BruthasTortoise So can you link to the offence that you believe has been committed?

SchrodingersImmigrant · 23/01/2021 19:30

Do you have that link pp asked?
SchrodingersImmigrant · 23/01/2021 19:31

@BruthasTortoise

Also. Again. Not an employment advisory service.
BruthasTortoise · 23/01/2021 19:32

I may have got this wrong and if I have I apologise but my read of this is that an employer has potentially commited a criminal offence if they behave the way the OP states they have.

Nicknacky · 23/01/2021 19:34

@BruthasTortoise You appear to have posted the wrong links as that is nothing like this situation.

SmidgenofaPigeon · 23/01/2021 19:35

@BruthasTortoise doesn’t apply to this situation.

Nicknacky · 23/01/2021 19:35

@BruthasTortoise This might be the point where you retract your advice to phone the police.....l

BruthasTortoise · 23/01/2021 19:36

How so? IF she has been sacked for self isolating how does it not fall under this legislation?
